RESOLUTION
WHEREAS, a public hearing was held on June 24, 1974, in the
chambers of the Board of County Commissioners, Weld County, Colorado,
for the purpose of hearing the petition of Greeley Sand & Gravel Company,
a Colorado Corporation, Greeley, Colorado, requesting permission to
locate a gravel pit operation on the following described property;
The Northeast Quarter (NE+) and all that part of the
East Half (E+) of the Northwest Quarter (NW9), the
Southwest Quarter (SW-4) of the Northwest Quarter
(NW4), the Northeast Quarter (NE-4) of the South-
west Quarter (SW4), and the North Half (NZ) of the
Southeast Quarter (SE4) of Section Thirty-five (35),
and the Southeast Quarter (SE4) of the Northeast Quarter
(NE4) of Section Thirty-four (34), lying North of the
right of way of the Colorado and Southern Railway;
also, a tract of land situate in the Northwest Quarter
of the Northwest Quarter (NW+NW4) of Section Thirty-
five, which considering the North line of said North-
_ west Quarter as bearing due East and West and with
all bearings contained herein relative thereto is con-
tained within the boundary lines which begin at a point
on the West line of said Northwest Quarter (NW4) said
point bearing South 00° 28'30" West 239. 28 feet from the
Northwest corner of said Northwest Quarter (NW4) and
run thence South 00° 28'30" West 1086. 10 feet to the
Southwest corner of the Northwest Quarter of said North-
west Quarter (NW4 NW-4-); thence North 89° 46' East
1389. 12 feet along the South line of the Northwest Quarter
of said Northwest Quarter (NW4 NW+) to the Southeast
corner of the Northwest Quarter of said Northwest Quarter
(NW4 NW4); thence North 00° 19' East 1319. 63 feet along
the East line of the Northwest Quarter (NW4) of said North-
west Quarter (NW4) to the Northeast Corner of the North-
west Quarter of said Northwest Quarter (NWI NW4-); thence
West 347, 37 feet along the North line of said Northwest
Quarter (NWa'-), thence South 02° 49' 30" West 232. 07 feet;
thence South 75° 08' West 169. 68 feet; thence South 89°22'
West 39. 57 feet; thence South 69°36'40" West 368. 11 feet;
thence North 69° 25' West 87. 55 feet; thence North 60° 19'
West 194. 78 feet; thence North 70° 16' West 76. 10 feet;
thence North 85° 42' West 157. 58 feet to the true point of
beginning, all in Township North, Range 66 West of the
6th P. M. , Weld County, Colorado, containing 368. 966 acres,
more or less,
and,
WHEREAS, the petitioner was present and represented by one
its officers, Thomas J. Cowan, and
WHEREAS, there was one person who objected to the request
of petitioner for the location of said gravel pit operation, and
WHEREAS, the said requested gravel pit operation is located in
an agricultural zone as set forth by the Weld County Zoning Resolution,
and

WHEREAS, according to Section 3. 3(8) and Section 6. 1(3) of the
Zoning Resolution of Weld County, said gravel pit operation may be
authorized upon the approval of the Weld County Planning Commission
and the Board of County Commissioners of Weld County, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present; has studied the request of
the petitioner and studied the recommendations of the Weld County
Planning Commission, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the application of Greeley Sand & Gravel Company,
Greeley, Colorado, to locate a gravel pit operation on the premises
indicated above be, and it hereby is granted under the conditions following:
1. That any water and sanitation facilities to be installed shall
be approved by the State Health Department.
2. That the owner, contractor or operator, prior to opening
any pit, shall submit location of pit, owner's name, and description of
pit operation to the Weld County Engineer, and shall submit complete
unit development plans for each gravel pit operation for approval by the
Weld County Planning Commission and such unit development plan shall
be filed in the office of the Weld County Clerk and Recorder.
3. That petitioner shall proceed with due diligence to effect
construction of said gravel pit operation and that he shall have up to
one year from date hereof to begin the construction of same; otherwise,
the Board may, for good cause shown, on its own motion, revoke the
permit herein granted.
4. That the operation and development of each gravel pit
excavation and rehabilitation shall be in accordance with the rules and
regulations for the operation of gravel pits as adopted by Weld County,
Colorado.
5. That all applicable subdivision regulations and zoning
regulations shall be followed and complied with in accordance with the
Zoning Resolutions of Weld County, Colorado.

conveys to WELD COUNTY, COLORADO, a right of wayfora public
highway over and across the following real property situate in the
County of Weld and State of Colorado, to-wit:
A 20 foot wide right—of-way-ea-serrrent located in Section
35, Township B North, Range 66 West of the 6th P. M. ,
Weld County, Colorado, being more particularly
described as _follows:
A 20 foot strip of land, which is bounded on the north
by the north Section line -of the NE* of said Section 35;
bounded on the south by the northerly right-of-way of
the Colorado and Southern Railroad; bounded on the
east by-the existing west right-of-way of Weld County
