USR21-0012, FOR SIX (6) SEMI -TRAILERS OUTSIDE OF SUBDIVISIONS AND
HISTORIC TOWNSITES IN THE A (AGRICULTURAL) ZONE DISTRICT -
CAMILA LOPEZ AND YOEMNI ORTEGA MARRERO
A public hearing was conducted on October 20, 2021, at 10:00 a.m., with the following present:

The following business was transacted:
hereby certify that pursuant to a notice dated September 14, 2021, and duly published
September 17, 2021, in the Greeley Tribune, a public hearing was conducted to consider the
request of Camila Lopez and Yoemni Ortega Marrero, for a Site Specific Development Plan and
Use by Special Review Permit, USR21-0012, for six (6) semi -trailers outside of subdivisions and
historic townsites in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney,
made this a matter of record.
Maxwell Nader, Department of Planning Services, presented a brief summary of the proposal
for six (6) semi -trailers, to be used for personal storage and parked next to the outbuilding onsite,
which will be utilized as screening; however, a Condition of Approval has been added for
screening from surrounding property owners (SPOs). Mr. Nader relayed the applicant does have
a current zoning violation, #ZCV21-00142, due to the storage of additional semi -trailers without
first obtaining appropriate land use permits, as well as the presence of a mobile home, which has
since been removed from the property. He stated one (1) anonymous complaint was received,
with concerns regarding a business on the site and report of more than just parking of
semi -trailers. Mr. Nader stated, during the site visit, there was one (1) commercial vehicle onsite,
which is an accessory use, per the Weld County Code in the A (Agricultural) Zone District, and
there were no signs of a business being operated. Mr. Nader provided a brief overview of the
Department of Planning Services Engineering, stating the parcel has two existing accesses onto
County Road (CR) 12, the western access is a permitted residential access located approximately
2,645 feet east of CR 37, and the eastern access is a non -permitted, residential access, located
approximately 120 feet east of the western access, and no traffic counts are available in the
vicinity of the subject parcel. He further stated the traffic information submitted indicated no
increased traffic due to this USR request. Mr. Nader explained no Drainage Report or Detention

Pond Design is required and shared the site is located within the three-mile referral area of the
City of Fort Lupton and the Towns of Hudson and Lochbuie, relaying the City of Fort Lupton
expressed no concerns. Mr. Nader stated the site is also located within the Intergovernmental
Area (IGA) of the City of Fort Lupton. He explained the surrounding uses, displayed images of
the site and surrounding views, and entered the favorable recommendation of the Planning
Commission into the record as written.
Lauren Light, Department of Public Health and Environment (EH), stated since the containers
are for private storage, they do not require water and sewer; however, EH does review sanitary
services that are existing, explaining the septic system for the existing house is not permitted but
was installed prior to permit requirements, and the applicant has applied for a Statement of
Existing for the septic system. She shared the property has a domestic well, and Development
Standards that address water, sewer, dust and waste have been added.
Camila Lopez, applicant, explained they had the old trailers in storage and wanted to move
the trailers closer, since they own the acreage, and the mobile home was already on the property
from the previous owners. In response to Commissioner James, Ms. Lopez confirmed they live
onsite.
No public testimony was offered concerning this matter.
The Board reviewed the Conditions of Approval and Development Standards and agreed to
all of the proposed conditions and standards.
In response to Chair Moreno, Ms. Lopez indicated she had reviewed, and agreed to abide
by, the Conditions of Approval and Development Standards, as presented.
Commissioner James moved to approve the request of Camila Lopez and Yoemni Ortega
Marrero for a Site Specific Development Plan and Use by Special Review Permit, USR21-0012,
for six (6) semi -trailers outside of subdivisions and historic townsites in the A (Agricultural) Zone
District, based on the recommendations of Planning staff and the Planning Commission, with the
Conditions of Approval and Development Standards, as presented. The motion was seconded by
Commissioner Buck, and it carried unanimously. There being no further discussion, the hearing
was completed at 10:11 a.m.
