Tuesday, March 16, 2021
A regular meeting of the Weld County Planning Commission was held in the Weld County Administration
Building, Hearing Room, 1150 O Street, Greeley, Colorado. This meeting was called to order by Vice Chair,
Gene Stille, at 12:33 pm.
Roll Call.
Present: Butch White, Dwaine Barclay, Gene Stille, Lonnie Ford, Sam Gluck, Tom Cope.
Absent/Excused: Elijah Hatch, Skip Holland, Troy Mellon.
Also Present: Chris Gathman, Michael Hall and Tom Parko, Department of Planning Services; Lauren
Light, Department of Health; Melissa King and Zack Roberson, Department of Public Works; Bob Choate,
County Attorney, and Kris Ranslem, Secretary.
Motion: Approve the March 2, 2021 Weld County Planning Commission minutes, Moved by Butch White,
Seconded by Lonnie Ford. Motion passed unanimously.

Chris Gathman, Planning Services, presented Case USR20-0034, reading the recommendation and
comments into the record. Mr. Gathman stated that no correspondence or phone calls from surrounding
property owners have been received for this case. The Department of Planning Services recommends
approval of this application with the attached conditions of approval and development standards.
Zack Roberson, Public Works, reported on the existing traffic, access to the site and drainage conditions
for the site. Mr. Roberson said that the applicant is requesting a new access point to County Road 47, and
to be consistent with the Weld County Access Code in Chapter 8, Public Works is requesting that the new
driveway be at least 150 feet from any other access point on that particular road.
Lauren Light, Environmental Health, reviewed the public water and sanitary sewer requirements, on -site
dust control, and the Waste Handling Plan.
Victor Schenck, 16160 CR 47, LaSalle, Colorado, stated that his nephew recently got out of the service and
would like to build a home for his family.
Commissioner Cope asked how far apart the driveways will be. Mr. Schenck said that from their driveway
to the new driveway is several hundred yards. Mr. Cope clarified if it will be difficult to meet the requirement
of being 150 feet apart. Mr. Schenck said that they will be able to meet that.
The Chair asked if there was anyone in the audience who wished to speak for or against this application.
No one wished to speak.
The Chair asked the applicant if they have read through the Development Standards and Conditions of
Approval and if they are in agreement with those. The applicant replied that they are in agreement.

LEGAL DESCRIPTION: PART OF THE NW4 OF SECTION 31, T7N, R65W OF THE 6TH P.M., WELD

LOCATION: SOUTH OF AND ADJACENT TO CR 76, EAST OF AND ADJACENT TO CR 37,
WEST OF AND ADJACENT TO STATE HIGHWAY 85.
Michael Hall, Planning Services, presented Case USR20-0033, reading the recommendation and
comments into the record. Mr. Hall noted that the USR does not seek to permit the church as it is a
grandfathered use, however, it will permit the preschool only. Additionally, the applicants are requesting a
32 square foot free-standing sign visible from Highway 85, which exceeds the maximum 16 square foot
sign allowed in the agricultural zone district. No written correspondence or telephone calls were received
from surrounding property owners regarding this application. The Department of Planning Services
recommends approval of this application with the attached conditions of approval and development
standards.

Lauren Light, Environmental Health, reviewed the public water and sanitary sewer requirements, on -site
dust control, and the Waste Handling Plan.
Richard Leffler, Leffler Engineering, 456 Kathryn Drive, Loveland, Colorado, stated that he is a member of
this church as well as a council member. Mr. Leffler said that this is a much -needed facility and they have
requests for more students to attend. This will be the only childcare facility that will offer childcare for infants
through pre-school age in the area. He added that it will be the only facility open during the summer months
as well.
The Chair asked if there was anyone in the audience who wished to speak for or against this application.
No one wished to speak.
Mr. Leffler referred to Development Standard 16 and said that it indicates the facility shall comply with the
Colorado Retail Food Establishment Rules and Regulations as applicable. He said that they don't cater to
the public and asked if they are okay with the kitchen they have there now Ms. Light said it is applicable
because there are children there and if it is not prepackaged foods then they will need to go through the
Weld County Consumer Protection Division and get a license. Mr. Leffler clarified that this will only be for
the preschool and not the church. Staff stated that was correct.
Mr. Leffler referred to Development Standard 22 with regard to parking or staging of vehicles on public
roads and said that part of the parking spaces are within the public right-of-way and assumes it is okay to
use those as long as it doesn't interfere with traffic on the public road. Ms. King said technically there
should be no parking on the public right-of-way. She added that she didn't specifically address this but it
will be addressed when the applicant obtains an Access Permit, is the fact that currently the access width
is 235 feet wide and that is way too big for what is allowed. Therefore, when the applicant comes in for the
Access Permit, they will address not only how traffic will access the site but also the parking. Mr. Leffler
stated that they were acceptable to that.
Commissioner Cope said that the regulations are very specific on the size of sign. He doesn't have an
issue with the proposed sign but suggested that the County Commissioners make the determination on the
size of the sign.

Chris Gathman, Planning Services, presented Case USR21-0002, reading the recommendation and
comments into the record. Mr. Gathman noted that one (1) letter was received outlining concerns about
noise and that the landowner intends to build a residence on their property in the future. Mr. Gathman
stated that the Town of Erie does not support the request as it conflicts with their Comprehensive Plan and
added that the adjacent property is in the platting process for residential development and requests that the
outdoor dog facilities be located a minimum of 300 feet from this property. He added that the size and
shape of this property does not allow the design of the facility in a manner where the actual facility could
be a minimum of 300 feet from the town limits. If they would relocate the facilities it would be encroaching
closer to the existing residences to the east. A letter of support from one of the surrounding property owners
to the east of the site was submitted today. The Department of Planning Services recommends approval of
this application with the attached conditions of approval and development standards.

Cassidy Orr and Dane Kornasiewicz, 620 State Highway 52, Erie, Colorado. Mr. Kornasiewicz stated that
they intend to build the dog diving facility and added that it is a pool facility that encourages dog sport,
recreation and rehabilitation. He said that they are planning to pump water to the pond from the Left Hand
Water District or import the water through a water service. He said that they have had discussions with Left
Hand Water on whether or not they would need a commercial water tap; however, Left Hand Water District
had said that it is not necessary based on the amount of water that will be used for this facility.
Commissioner Gluck asked if it is an above ground pool. Ms. Orr said it would be a 45 -foot above ground
dock and a 40 -foot above ground pool.
Commissioner Cope asked how close the pool is to the back property line. Ms. Orr said that it would be 25
feet from the property line.
Commissioner Cope asked what the rationale is for having a saltwater pool. Mr. Kornasiewicz said that
salt water is better for dogs than a chemical pool.
Commissioner Stille asked if there is a lot of barking. Ms. Orr said that they are doing hourly bookings and
they do not bark when running or swimming. The times they anticipate barking is when there is competition

and they have to be in their crates. Mr. Kornasiewicz said that the noise level will be pretty low at the
property line and there should be no concerns.
Commissioner Stille asked if this is a year-round facility. Ms. Orr said the facility will operate during the
warm summer months between April and October.

ORDINANCE 2021-06

IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS,
CHAPTER 23 ZONING, OF THE WELD COUNTY CODE.
Tom Parko, Planning Director, presented Ordinance 2021-06, and stated that when they rewrote the zoning
code last year, meat processing was removed from the agricultural zone district and is only permissible in
the industrial zone districts. He added that they didn't anticipate landowners to pursue meat processing on
a bigger scale. Staff has been approached by three landowners in the County that want to do something
bigger than 5000 square feet but not as big as what JBS is doing.
Therefore, the proposed change is to the custom meat processing definition by increasing the size of the
square footage of the building from 5,000 to 30,000 square feet. This change also states that there shall
be no retail sales at the facility. Mr. Parko stated that this would capture some of the people who want to
take their own cattle and process them. This would be permitted through the ZPAG (Zoning Permit for
Certain Ag Uses) permitting process.
