BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
MONDAY, JULY 12, 2021
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, July 12, 2021, at the hour of 9:00 a.m.
Ca ▪ ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:

El M• INUTES: Commissioner Saine moved to approve the Minutes of the Board of County
Commissioners meeting of July 7, 2021, as printed. Commissioner Buck seconded the motion, and it
carried unanimously.
• P• UBLIC INPUT: No public input was given.
• AMENDMENTS TO AGENDA: There were no amendments to the agenda.
El CONSENT AGENDA: Commissioner James moved to approve the Consent Agenda, as printed.
Commissioner Saine seconded the motion, and it carried unanimously.
PRESENTATIONS:
1) PRESENTATION OF THE FAIR BOOK BY WELD COUNTY FAIR ROYALTY: Chair Moreno invited
the 2021 Fair Royalty to make their presentation of the Fair Book. Emerson Lobato, Fair Attendant,
introduced herself and highlighted her 4-H events, Women in Business Conference, and upcoming fair
events. Ella Niccoli, Fair Attendant, stated she is a 12 -year 4-H member, provided a brief introduction of
her fair project and activity involvement, and announced the public entertainment events and participating
vendors. Shelby Tieten, Fair Queen, reviewed her offices of service, introduced her family, and shared
she will begin studies at Colorado State University this fall. Miss Tieten acknowledged this past 1.5 years
has been vastly different; however, the Fair Royalty Court remained busy with a wide variety of activities,
including summer parades and the Women in Business conference, and they are looking forward to
upcoming events celebrating agriculture. The Commissioners, in turn, commended the Fair Royalty Court

for representing Weld County and showcasing all of the participant projects. They thanked the fair
sponsors, recognized the agricultural heritage of Weld County, expressed their pride in hosting the 2020
Fair despite the COVID-19 pandemic and voiced their appreciation of the benefits of 4-H for youth, pride
in the young leadership in Weld agriculture, and thanked Pat Kindvall for serving as the Royalty sponsor.

ILA COMMISSIONER COORDINATOR REPORTS: Commissioner James reported on the Statewide
Transportation Advisory Council Committee. Commissioner Buck shared the Department of Human
Services has granted $2,800,000.00 in Emergency Rental Assistance program funds, processed 1,497
requests, and evaluated 1,020 households. She also reported the department was awarded a grant for
the Promoting Safe and Stable Families program, and the Foster Care and Kinship support group will be
resuming in August. Commissioner Saine presented photographs (Exhibit A) and reported on a meeting
with representatives from the Town of Dacono, City of Frederick, Colorado Department of Transportation
(CDOT), and Colorado Department of Local Affairs (DOLA) regarding possible improvements to a
dangerous intersection.
l WARRANTS:
1) GENERAL WARRANTS - JULY 7, AND 9, 2021: Commissioner Saine moved to approve the General
Warrants, as printed. Commissioner Buck seconded the motion, and it carried unanimously.
---� 2) GREELEY-WELD COUNTY AIRPORT AUTHORITY WARRANTS - JULY 9, 2021:
Commissioner Freeman moved to approve the Greeley -Weld County Airport Authority Warrants, as
printed. Commissioner James seconded the motion, and upon a roll call vote, the motion passed four (4)
to one (1), with Commissioner Saine opposed.
BIDS:
1) APPROVE BID #B2100100, 2021 SLURRY SEAL - DEPARTMENT OF PUBLIC WORKS: Rob Turf,
Purchasing Department, explained this item was continued from July 7, 2021, to allow staff additional
time to review the scope of work and remove portions of the project to ensure the overall scope remains
within budget. He stated staff recommends awarding to A-1 Chip Seal Company, for the total amount of
$969,452.51, which is within the 2021 budget, and noted the work is expected to begin in July, and end
in late September, 2021. Commissioner Buck moved to approve said bid, as recommended by staff.
Commissioner James seconded the motion, and it carried unanimously.
Ea NEW BUSINESS:
1) CONSIDER ACCEPTING ASSIGNMENT OF CONTRACT, AS AMENDED, TO BUY AND SELL REAL
ESTATE (S1/2, S30, T6N, R65W), APPROVE CONTRACT AND AMENDMENTS, AND AUTHORIZE
CHAIR TO SIGN ALL NECESSARY DOCUMENTS: Toby Taylor, Director of the Facilities Department,
stated this is an assignment of a contract to purchase property for the amount of $4,113,134.00, which
requires public notice, according to the Home Rule Charter, because it is in excess of $2,500,000.00.
No public testimony was offered concerning this matter. Commissioner James moved to accept the
Assignment of Contract, as amended, approve said contract and amendments, and authorize the Chair
to sign all necessary documents. Seconded by Commissioner Buck, the motion carried unanimously.
ie 2) CONSIDER APPOINTMENT OF CERTIFYING OFFICIAL FOR ENVIRONMENTAL REVIEWS
OF COMMUNITY DEVELOPMENT BLOCK GRANT FUNDED PROJECTS: Don Sandoval, Community
Development Block Grant Manager, stated the U.S. Department of Housing and Urban Development
(HUD) process requires appointment of an Official to certify release of funds, thus enabling approved
environmental projects to then submit requests for release of funds. Commissioner Buck moved to

approve the appointment of Don Sandoval, with Ryan Rose, Director of Administrative Services, as an
alternate. The motion was seconded by Commissioner James, and it carried unanimously.
3) CONSIDER ESTABLISHING CHANGE FUND AT WELD COUNTY SHERIFF'S OFFICE FOR
SOUTHWEST SUBSTATION BOOKING UNIT: Barbara Connolly, Controller, explained the Sheriff's
Office will be opening the Southwest booking station and will need a $500.00 change fund. Commissioner
Freeman moved to approve establishment of said change fund. Commissioner James seconded the
motion, and it carried unanimously.
=,1 4) CONSIDER CONTRACT ID #4984 MEMORANDUM OF UNDERSTANDING FOR 2021
EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT (JAG) PROGRAM AND AUTHORIZE
CHAIR TO SIGN — CITY OF GREELEY: Karin McDougal, Assistant County Attorney, on behalf of Donnie
Patch, Undersheriff, stated this agreement names the City of Greeley as the fiscal agent, through which
Weld County will receive $13,558.00 as its portion of the grant. Commissioner James moved to approve
said Memorandum of Understanding and authorize the Chair to sign, which was seconded by
Commissioner Saine, and it carried unanimously.
• 5) CONSIDER CONTRACT ID #4986 MEMORANDUM OF UNDERSTANDING FOR JAIL BASED
BEHAVIORAL SERVICES AND AUTHORIZE CHAIR TO SIGN — NORTH RANGE BEHAVIORAL
HEALTH: Ms. McDougal stated North Range Behavioral Health will provide mental health services for
inmates in the jail, which is funded through a State of Colorado grant. Commissioner Freeman moved to
approve said Memorandum of Understanding and authorize the Chair to sign. Seconded by
Commissioner James, the motion carried unanimously.
• 6) CONSIDER CONTRACT ID #4855 AGREEMENT FOR WEATHER DATA ACCESS SERVICES
AND AUTHORIZE CHAIR TO SIGN - SYNOPTIC DATA PBC: Jacob Mundt, Geographic Information
Services, stated IT has been using meteorological overlay data for Snow Desk operations free of charge;
and this agreement details a new annual $500.00 fee. Commissioner Buck moved to approve said
agreement and authorize the Chair to sign. The motion was seconded by Commissioner James, and it
carried unanimously.
• 7) CONSIDER SUMMARY OF GRANT AWARD TERMS AND CONDITIONS FOR ENERGY AND
MINERAL IMPACT ASSISTANCE FUND (EIAF 9371) PROGRAM GRANT FUNDS FOR CR 43
IMPROVEMENTS PROJECT (MARCH CYCLE -TIER I): Elizabeth Relford, Deputy Director of the
Department of Public Works, stated the County has been awarded $100,000.00 of the $200,000.00
requested, and noted the project may be delayed while waiting on the asphalt supply. Commissioner
Freeman moved to approve said grant award terms and conditions. The motion was seconded by
Commissioner James, and it carried unanimously.
8) CONSIDER INSTALLATION OF TRAFFIC CONTROL DEVICES ON CR 45 AND REMOVAL OF
SAME FROM CR 66 TO SWITCH TRAFFIC CONTROL DIRECTION AT SAID INTERSECTION:
Cameron Parrott, Department of Public Works, stated staff discovered a discrepancy in regard to traffic
counts on County Road (CR) 66; therefore, it makes sense to reverse the traffic control and stop traffic
on CR 45. Commissioner James moved to approve said installation and removal of traffic control devices.
Commissioner Buck seconded the motion, and it carried unanimously.
9) CONSIDER REMOVAL OF TRAFFIC CONTROL DEVICE ON CR 3.5 AT VISTA VIEW DRIVE:
Mr. Parrott stated staff received complaints regarding the intersection as it has only three Stop signs on
a four -legged intersection; therefore, it has been determined that removal of the Stop sign for northbound

traffic will help alleviate confusion and decrease potential accidents. Commissioner Freeman moved to
approve said removal of traffic control devices. Commissioner Buck seconded the motion, and it carried
unanimously.
le 10) CONSIDER PROFESSIONAL SERVICES AGREEMENT FOR 2021 WELD COUNTY FAIR
AND AUTHORIZE CHAIR TO SIGN - COLORADO REGULATORS: Jenette Masarie, CSU Extension
Service of Weld County, stated the Colorado Regulators show will be on July 24, 2021, in the grandstand
arena. Commissioner Saine moved to approve said agreement and authorize the Chair to sign.
Seconded by Commissioner James, the motion carried unanimously.
11) CONSIDER AGREEMENT FOR 2021 WELD COUNTY FAIR ONLINE MARKETING SERVICES
AND AUTHORIZE CHAIR TO SIGN — CCI.LIVE, LLC: Ms. Masarie stated the platform will Live Stream
the Jr. Livestock sale, support online bidding, and allow families to watch remotely. She relayed a different
platform was utilized last year, but this platform allows for additional benefits. Commissioner Saine moved
to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner
Buck, and it carried unanimously.
e PLANNING:
1) CONSIDER VACATION OF AMENDED USE BY SPECIAL REVIEW PERMIT,
AMUSR-1501 -ANDERSEN PROPERTIES, LLC: Michael Hall, Department of Planning Services, stated
this is a complete vacation for a railcar loading facility, due to a new administratively approved Site Plan
Review on the property (SPR20-0013), which supersedes the previous USR and includes Condition of
Approval #1.B requiring said vacation. He confirmed referral agencies have submitted comments on the
SPR, the Board of County Commissioner's Resolution will satisfy COA #1.B, and then the SPR map may
be recorded, since all other conditions are satisfied. Commissioner Freeman moved to approve said
vacation. Commissioner Buck seconded the motion, and it carried unanimously.
2) FINAL READING OF CODE ORDINANCE #2021-10, IN THE MATTER OF REPEALING AND
REENACTING, WITH AMENDMENTS, CHAPTER 21 AREAS AND ACTIVITIES OF STATE INTEREST,
OF THE WELD COUNTY CODE (SITING OF SOLAR ENERGY FACILITIES): Commissioner Freeman
moved to read Code Ordinance #2021-10 by title only. Seconded by Commissioner James, the motion
carried unanimously. Bruce Barker, County Attorney, read said title for the record. Tom Parko, Director
of the Department of Planning Services, stated this Ordinance establishes the process for 1041 Solar
Energy Facilities. He relayed there have been no changes since the Second Reading. No public
testimony was offered concerning this matter. Commissioner James moved to approve Code Ordinance
#2021-10 on Final Reading. Commissioner Saine seconded the motion, and it carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. Code Ordinance #2021-10 was approved on Final Reading.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
