Attorney and Counselor at Law 2450 35`h Ave. Ct.; Suite B Greeley, Colorado 80634 970-371-5368 warren@schaefferlaw.net August 26, 2021 Weld County Commissioners Greeley, Colorado Weld County School Board, Weld RE -4 Windsor, Colorado Re: K-12 COVID policy Dear Commissioners and Members of the School Board: via hand delivery '/z r/2 I I am writing this day at the request of "Weld RE -4 GUARDIANS" a grass -roots coalition of concerned Parents of children attending school in the Weld RE -4 district. All of the members of the RE -4 School Board are familiar with this organization. I had the pleasure of attending the school board public meeting held Tuesday, August 24, 2021 and now write at the request of "The Guardians" to share with you my impressions and reinforce the more salient objections the parents raised to the "mask mandate" supported by Governor Polis and his administration. It is regrettable, in my view that the elected officials closest to their constituents seem to have placed so little consideration to the concerns raised by those same constituents whom are their neighbors and likely parents of school children as well. The meeting began with everyone joining in the Pledge of Allegiance. Thank you! That was a most encouraging start and dispelled my initial suspicion that the meeting was simply "pro forma" to humor the parents before announcing a predetermined decision. Sadly, that suspicion was rekindled after the initial presentation of Health Department "data" showing an alarming rise in "cases" in Weld County in particular. The problem is this: by relying solely on "positive cases", the department (and now the school board) is making a serious health decision for the children of this school district which, as was pointed out by the members of the audience, is not merely a "known" negative health impact but in fact is a certain health impact both physically in terms of basic human development but emotionally as well. Little was said about the phenomenal spike in adolescent suicides, depression, and anti- social behavior resulting from the draconian restrictions placed on the students out of an irrational fear of a heretofore unknown virus. The political winds blowing these decisions are no more reliable than the winds during severe storms. CDIC and Dr Fauci change their analysis almost weekly. Local government "experts" then parrot those concerns and rubber-stamp restrictive "suggestions" by their superior powers. Co Kt-tun:Coet-►onS oq fog/ ( 2021-2619 Your constituents cried out for leadership. Their pleas seem to have fallen on deaf ears. The following is an abbreviated list of the known health hazards resulting from mandatory mask mandates. All of the following were raised by knowledgeable parents during the open meeting: 1. Cloth masks are ineffective against COVID. They are not custom fitted N95 protective masks. 2. When in use over protracted periods of time, the developing brain is robbed of oxygen which is critical to healthy brain development. 3. The standard commercially available masks which are commonly used traps and reinfects the user with harmful bacteria and should be replaced every 20 minutes because of moisture retention which enhances bacteria and mold growth; 4. Even medical masks adversely affect respiratory physiology and function and lower oxygen levels in the blood, raise carbon dioxide levels in the blood, and trap exhaled viral (and other) pathogens in the mouth/mask inter -space, increasing viral/infectious load, and increase the severity of disease; this is why they are disposed of immediately after a single use in the hospital environment. 5. SARS CoV-2 Becomes More Dangerous When Blood Oxygen levels decline 6. Mouth breathing leads to bacteria growth in the mouth causing cavities 7. Masks compromise communication ability along with learning capabilities 8. Wearing a face mask makes the exhaled air (respiratory plumes) go into the eyes which carries the viruses, bacteria, and mold 9. Face masks are dangerous and contraindicated for a large number of people with pre- existing medical conditions and disabilities; 10. Masks have been shown to cause PTSD and overall fear in children and can also cause headaches, depression and dehydration; 11. Masks force the user to re -inhale carbon dioxide which therefore increases blood levels (called Hypercapnia). This causes increased anxiety, shortness of breath, sluggishness, sleepiness (aka "brain fog"); 12. Extended mask use can also cause facial Acne because of increased bacteria growth on the skin. As an attorney myself, I wholeheartedly agree with the opinion of the Board's counsel: the district COULD be held liable for exposing children to KNOWN health risks. Counsel is exactly right. There is, however, a distinction between "known risks", and "feared risks". Knowing that Counsel's legal conclusion to be accurate, I then ask: "why is the Board exposing the entire student population to the known, extreme risks listed above? On behalf of the parents of Weld RE -4, I respectfully ask all elected officials to listen carefully to their constituents and LEAD; even when that leadership requires opposing conventional political whims from above. Thank you for your consideration. It appears the teacher did not like the fit of the mask on the child and assumed the right to tighten it to a painful degree. The parent complained, of course, to the principal and was told the teacher had that "right". NO! What is next? Perhaps shackles and tasers for disobedient children? Does a teacher have the "right" to unilaterally remove articles of clothing he or she finds offensive? I see little difference between forcefully attaching articles of clothing (masks) and forced removal. Please clarify. WWS/ns cc: file, U.S. Representatives Hello
