RE: AGREEMENT BETWEEN WELD COUNTY AND THE STATE OF
COLORADO
WHEREAS, there has been created within the Department of Local
Affairs of the State of Colorado, a Division of Property Taxation, and
WHEREAS, it is the desire of the Division of Property Taxation
with participation of Colorado counties to create an Advisory Board to
the Division, and
WHEREAS, it is the further desire of said Division of Property
Taxation, with the advice of the Advisory Board, to research, initiate,
install and operate a data-processing valuation system for ad valorem
taxation records throughout Colorado, and
WHEREAS, the State of Colorado, for the use and benefit of the
Department of Local Affairs, by the Division of Property Taxation, has
submitted an agreement to create an Advisory Board to the Division of
Property Taxation and for the installation and operation of a data processing
valuation system in Colorado, and
WHEREAS, the Board of County Commissioners, Weld County,
Colorado, believes it to be in the best interest of the County to enter
into such an agreement on the basis recited therein;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that the agreement submitted
by the State of Colorado, for the use and benefit of the Department of
Local Affairs by the Division of Property Taxation, to create an Advisory
Board to the Division and to install and operate a uniform data-processing
valuation system in Colorado, copy of which is attached hereto and made
a part hereof by reference, be, and it hereby is approved.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 16th day of December,
1970.

AGREEMENT OF STATE OF COLORADO
AND
VARIOUS COUNTIES
RE: DATA PROCESSING VALUATION SYSTEM
This Agreement made on this 16th day of December , 1970
by and between the State of Colorado, Department of Local Affairs for the
use and benefit of the Division of Property Taxation (hereinafter referred
to as the Division) and the county signatories (hereinafter referred to as
the counties).
WITNESSETH:
WHEREAS, the parties propose to research, initiate, install and
• operate a data-processing valuation system for ad valorem taxation
records (hereinafter called the project), and
WHEREAS, this contract is to provide a means to direct research and
operation of such a system and provisions for sharing costs by the Division
with the direction of an advisory board (hereinafter referred to as the Board).
NOW, THEREFORE, the parties agree as follows:
1. The parties hereby authorize the Division with the guidance of the
Board to make studies, investigations, reports and to execute contracts
in connection therewith.

2. The parties further agree, that in the event the Board authorizes
the installation of a data-processing valuation system for ad valorem
taxation records, the Division shall direct the operation and administra-
tion of said system under the guidance of the Board.
3. Each county participating in the project shall appoint one
representative to the project. An advisory board of five members shall
be elected by the representatives of the Counties. Said election shall be
conducted on a yearly basis.
4. The Counties shall share expenses in connection with paragraph
one and two of this agreement in proportion to their benefit from the
project as determined by the Board.
5. Additional counties may be added as participants in this project
and appoint representatives to the project based on standards and rules
adopted by the Board. Any counties joining this project in addition to the
original signatories shall assume all responsibilities and have all rights
as the original parties including responsibility to pay a pro-rata portion
of all costs of research, operation and administration of the project.
6. Vacancies on the Board shall be filled-by Board rule or regulation.
7. The Board shall have the power to act as agent for the participating
counties, to accept donations, grants and contributions from the partici-
pants, foundation grants, or the Federal Government. The Board shall
determine the limit of expenditures in connection with the project, but the

Division will administer the details of the project with the guidance of the
Board.
8. The Board shall, with the help of the State, annually file a financial
report with the participating counties detailing the income and expenditures
on the project.
9. The supervision and acceptance of all valuation systems shall be
subject to approval by the Division.
10. The Division shall act as fiscal agent for the contract. The assess-
ment and collection of all monies, grants and donations through the Board
shall be dispersed and disposed of through the Division. The Division shall
account for monies and report to the Board on a monthly basis.
11. All financial contributions shall be based upon the calendar year
and a financial commitment for the year shall not be retractable during
that year. Each new financial apportionments and commitments by the
counties shall be approved by the Division.
12. Admission or withdrawal of participation in this project shall be on
a yearly basis and shall be pursuant to proper County resolution ninety
days prior to the end of the calendar year. Upon withdrawal, a county shall
have no rights to the valuation system, except as negotiated with the Board
and approved by the Division.

13. It is the intent of the contracting parties to effect a joint ownership
of the system and programs of the ADP valuation system. Upon dissolution
of the contract, the participating members shall have a right to the existing
valuation system with the guidelines for distribution to be determined by
the Advisory Board and the Division of Property Taxation. Upon dissolution
of the contract, the State of Colorado, through the Division of Property
Taxation, has no future financial obligation for the maintenance or operation
of the system. The State of Colorado shall have no other obligation than
specifically designated in the contract. All programs, and tapes created or
designed for this project shall be the property of the State of Colorado.
14. This Agreement shall not be deemed valid until it shall have been
approved by the State Controller or such assistant as he may designate.

It is with intense pride that I can report that for the first time Colorado
counties and the State have banded together to solve their mutual problems.
Approval to participate in the state-county automatic data processing
(ADP) venture has been received from Boulder County, El Paso County,
Arapahoe County, and Weld County. Together with the Tax Commission,
these five participants will form the nucleus of an earth-shattering experience
in local government.
Please accept my congratulations and my assurance that all moneys
will be spent wisely and frugally. At this time it is sufficient to have
received your letter of intent. The submission of checks will not be necessary
until the organization is formally accomplished in the very near future.
