Timber Ridge Parkway, Severance, Co 970.686.1218 Cc: so(RS), p1-(TP), CH(AT/TP/TP), ?W(ER/crt/EP) AsR(o (/zG), GIS(S(,) oT/3o/ZI 2021-2598 PETITION FOR ANNEXATION DREILING ANNEXATION (40504 County Road 17) To the Board of Trustees of the Town of Severance; Colorado The undersigned (the "Petitioners"), in accordance with the Municipal Annexation Act of 1965 as set forth in Article 12, Title 31, Colorado Revised Statutes, as amended and as in effect on the submission date set forth below ("Annexation Act"), herby petition ("Petition") the Board of Trustees of the Town of Severance, Colorado ("Town Board"), to annex to the Town of Severance ("Town") the unincorporated territory located in the County of Weld, State of Colorado, Which properly is more particularly described in Exhibit A attached hereto and incorporated herein by reference ("Property"). In support of this Petitioner, Petitioners avow that: 1. It is desirable for both Petitioners and Town that the Property be annexed to the Town. 2. The requirements of Sections -104 and -105 of the Annexation Act exist or have been met. 3. Not less than one -sixth (1/6) of the perimeter of the property is contiguous with the Town's current municipal boundaries. (Approximately one -quarter (22%) of the perimeter of the property is contiguous with the Saddler Ridge development or Severance's portion of County Road 17 adjacent to Saddler Ridge). 4. A community of interest exists between the Property and the Town. 5. The Property is urban or will be urbanized in the near future. 6. The Property is integrated with or is capable of being integrated with the Town. 7. Petitioners comprise more than fifty percent (50%) of the landowners in the Property owning more than fifty percent (50%) of the Property, excluding public streets and alleys and any land owned by the annexing municipality, and Petitioner hereby consents to the establishment of the boundaries of the Property as shown on the annexation plat submitted herewith. 8. The Property is not presently a part of any incorporated city, city and county or town; nor have any proceedings been commenced for incorporation or annexation of an area that is part or all of the Property; nor has any election for annexation of the Property or substantially the same territory to the Town been held within the twelve (12) months immediately preceding the filing of this Petition. 9. The proposed annexation will not result in detachment of area from any school district or attachment of same to another school district. 10. The proposed annexation will not extend the municipal boundary of the Town more than three (3) miles in any direction from any point of the current municipal boundary. 11. The proposed annexation will not result in the denial of reasonable access to any landowner, owner of an easement, or owner of a franchise adjoining a platted street or alley which has been annexed by the town but is not bounded on both sides by the Town. 12. In establishing the boundaries of the Property, no land which is to be held in identical ownership is being divided into separate parts or parcels without the written consent of the landowner or landowners. 13. No portion of a platted street or alley is to be annexed. 1 14. The legal description of the land owned by the Petitioners is set forth on Exhibit A, attached hereto and incorporated herein by this reference. 15. The affidavit of the circulator of this petition certifying that the signature on this Petition is the signature of the person whose name it purports to be and certifying the accuracy of the date of such signature is attached hereto as Exhibit B and is incorporated herein by this reference. 16. This petition is accompanied by four prints of an annexation map containing, among other things, the following information: a. A written legal description of the boundaries of the Property; b. A map showing the boundary of the Property; c. Within the annexation boundary map, a showing of the location of each ownership tract in unplatted land and, if part or all of the area is platted, the boundaries and the plat numbers of plots or of lots and blocks; and d. Next to the boundary of the Property, a drawing of the contiguous boundary of the annexing municipality abutting the Property. 17. In connection with the processing of this Petition, Petitioners request that the Town: a. Institute zoning processes for the Property in accordance with Section — 115 of the Annexation Act and Chapter 16 of the Municipal Code of the Town; and b. Approve and execute an annexation agreement ("Annexation Agreement") which establishes vested property rights for the Property for an agreed -upon term greater than three years pursuant to Article 68, Title 24, Colorado Revised Statutes. 18. Petitioner has filed this Petition subject to the following conditions: a. Concurrently with its approval of annexation of the Property, the Town Board: (i) approves "Development Node" zoning which will provide the property with a variety of potential legal uses in the future; and (ii) approves and authorizes execution of the Annexation Agreement. b. Petitioner hereby reserves the sole, exclusive and unilateral right to withdraw this Petition by so notifying the Town Clerk in writing at any point prior to the later to occur of: (i) forty (40) days after the latest effective date of the final ordinance(s) approving annexation of the Property, the Annexation Agreement, or zoning of the Property as requested pursuant to this Petition; or (ii) any later date contemplated in such Annexation Agreement. c. Prior to expiration of the period described in the foregoing subparagraph (b) without Petitioners having withdrawn the Petition, neither Petitioners nor the town shall Cause or permit the occurrence of the conditions to effectiveness of the annexation as set forth in Section — 113(2)(b) of the Annexation Act. It is expressly understood that the term Petitioners, as used in this Petition, means the then -current owner of the Property and specifically, all applicable rights of Petitioner set forth in this Section 17 and Section 18 shall only be available to the then -current owner of the Property as applicable. 19. Upon the annexation of the Property becoming effective, and subject to the conditions set forth in this Petition and to be set forth in the Annexation Agreement, the Property shall become subject to all ordinances, resolutions, rules and regulations of the Town, except as otherwise set forth in the Annexation Agreement, and except for general property taxes of the Town, which shall become effective on 2 January 1 on the next succeeding year following adoption of the annexation ordinance. 20. Except for the terms and conditions of this Petition and of the Annexation Agreement, which terms and conditions Petitioners expressly approve and therefore do not constitute an imposition of additional terms and conditions within the meaning of Section — 106 (l)(g) of the Annexation Act, Petitioners request that no additional terms and conditions be imposed upon annexation of the Property to the Town. THEREFORE, Petitioners request that the Board of the Town of Severance, Colorado, complete and approve the annexation of the Property pursuant to the provisions of the Municipal Annexation Act of 1965, as amended. The property includes three structures, one sin gle family residential home and two outbuildings. The property's borders include: • North: Private property in Weld County. • East: Undeveloped land in Weld County and 100' Telecommunications Tower • South: Saddler Ridge Development located in the Town of Severance • West: The terminus of Weld County Road 17 . (TriLynx) is a software company that develops and maintains a software application that receives data from regional environmental monitoring. ETI Instrument Systems, Inc. As it is business and not additional residences we don't have any concerns with the project moving forward." Severance Police Department Impact The Town of Severance reached out to the Severance Police Department and Police Chief Jim Gerdeman. Chief Gerdeman notified the Town that with Dreiling Annexation not proposing any new structures that, "The annexation of this parcel will not have much impact on the Severance Police Department." Poudre Fire Authority Impacts The parcel is currently included in the Poudre Fire Authority. The applicant is working with Windsor Severance Fire Rescue to petition and annex into the Fire District and has submitted a petition at this time. The Town of Severance reached out to the Windsor Severance Fire Rescue, Fire Marshal Sandra Friedrichsen's provided some comments on the project which are as follows. "Thank you for passing this on to us. This property is not in our fire district as of right now, so they will need to petition to annex into our fire district. I have forwarded this to Chief Kazian, as he is working on our annexations with the attorney right now. Please continue to include us in the approval process. Thank you and please let me know if there are any questions." North Weld County Water District (NWCWD) Impacts The Town of Severance reached out to NWCWD and Jared Rauch Development Review Engineer for NWCWD commented, "NWCWD doesn't have any comments at this time." Traffic Impacts The Town of Severance Transportation Master Plan adopted June 22, 2021 provides an in-depth analysis of existing conditions and anticipated needs through year 2040. The analysis projects build out of residential and commercial uses, the traffic that would be generated and the road improvements necessary to accommodate the traffic at acceptable levels. With no proposed development or improvements this project will have minimal impact on traffic in the area. Environmental Impacts Existing land use has been residential. Currently staff has no concerns. Resident Impacts Very little impact is anticipated to surrounding residents. Most affected would be the Saddler Ridge Neighborhood to the south and unincorporated Weld County residents to the east, west, and north. With no new buildings being proposed no construction noise, dust, or trash is anticipated. Operations of these small businesses will be entirely conducted indoors and will not generate smells, noises, or have any visual impact on existing residents. Economic Impact The Town of Severance will gain three established businesses that will now be headquartered in Severance. They will be properly licensed with the Town and the Town is anticipated to see some sales tax revenue. Hello
