HomeMy WebLinkAbout20212200.tiffRESOLUTION RE: APPROVE RENEWAL APPLICATION FOR AN OPTIONAL PREMISES (COUNTY) LIQUOR LICENSE FROM IHRF, INC., AND AUTHORIZE CHAIR TO SIGN - EXPIRES AUGUST 1, 2022 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 30th day of June, 2021, the Board considered the application of IHRF, Inc., for renewal of an Optional Premises (County) Liquor License, for the sale of malt, vinous, and spirituous liquors, subject to the rules and regulations found in Article 3, Title 44, C.R.S., and WHEREAS, at said hearing, the Board found that pursuant to the procedures as set forth in Chapter 12, Article II, of the Weld County Code, there is probable cause to believe that one or more of the factors described in Section 12-2-40 of the Weld County Code exists, and WHEREAS, the Board found evidence that the licensee has violated, does not meet or has failed to comply with any of the terms, conditions or provisions of Chapter 12, Article II of the Weld County Code, or any rules and regulations promulgated pursuant to the Colorado Beer Code or the Colorado Liquor Code, as provided in Section 12-2-40.A of the Weld County Code, including: 1) Evidence that patrons have brought alcohol from off -premises onto the licensed premises in violation of C.R.S. §44-3-901(1)(i) and 1 CCR 203-2:47-914; 2) Evidence of overserving and overconsumption in violation of C.R.S. §44-3-901(1)(a) and 1 CCR 203-2:47-900; 3) Evidence that the events during which alcohol is being served (car and truck shows) do not comply with the outdoor sports and recreational facility for which the Optional Premises (County) Liquor License was approved (horse match racing), and WHEREAS, the Board deemed it advisable to schedule a Public Hearing on Wednesday, July 21, 2021, at 9:00 a.m., to consider whether good cause exists to refuse to renew said Optional Premises (County) Liquor License for failure to comply with Chapter 12, Article II, of the Weld County Code, and Article 3, Title 44, C.R.S., and WHEREAS, at a public hearing held on the 21st day of July, 2021, the Board deemed it advisable to dismiss said evidence of violation and consider renewal of the Optional Premises (County) Liquor License, and WHEREAS, pursuant to Exhibit 5-H of the Weld County Code, said applicant has paid the sum of $175.00 to the County of Weld for the renewal of the existing license, and cc: SOCRS/ rem/AC), eAcacl (%/1-71D1 2021-2200 LC0057 RENEW OPTIONAL PREMISES (COUNTY) LIQUOR LICENSE - IHRF, INC. PAGE 2 WHEREAS, said applicant has exhibited a State Liquor License for the sale of malt, vinous, and spirituous liquors for consumption by the drink on the premises only, outside the corporate limits of any town or city in the County of Weld at the location described as follows: 18233 County Road 96 Pierce, Colorado 80650 WHEREAS, the Licensee shall require "responsible vendor" training of each employee, as agreeable to the Colorado Department of Revenue, Liquor Enforcement Division, and the Licensee shall provide documentary evidence that each employee has been "responsible vendor" trained upon request by the Weld County Sheriff's Office or the Colorado Liquor Enforcement Division. NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Weld County, Colorado, having examined said application and the other qualifications of the applicant, does hereby grant License Number 2021-12 to said applicant to sell malt, vinous, and spirituous liquors for consumption by the drink on the premises only, at retail at said location; and the Board does hereby authorize and direct the issuance of said license by the Chair of the Board of County Commissioners, attested to by the Clerk to the Board of Weld County, Colorado, which license shall be in effect until August 1, 2022, providing that said licensee operates in strict conformity to all of the laws of the State of Colorado and the rules and regulations relating thereto, per Article 3, Title 44, C.R.S., heretofore passed by the Board of County Commissioners of Weld County, Colorado, and any violations thereof shall be cause for revocation of the license. Thank you, Ana Ornelas Amend Sec. 12-2-70. Standards for issuance of Optional Premises Liquor Licenses. The following standards for the issuance of an Optional Premises Liquor License or Optional Premises for a Hotel and Restaurant Liquor License are adopted pursuant to C.R.S. §44-3-310. The standards are considered additional to all other standards applicable to the issuance of liquor licenses pursuant to the Colorado Liquor Code and the Colorado Liquor Rules. These two (2) types of licenses are collectively referred to in this Section as "Optional Premises License" unless specifically identified separately. A. Eligible facility. An Optional Premises License may be approved for any facility that is located on or adjacent to an outdoor sports and recreational facility, as defined in C.R.S. §44-3- 103(33). B. No minimum size. There is no minimum size restriction for the outdoor sports and recreational facility to be eligible for the approval of an Optional Premises License. However, the Board of County Commissioners may consider the size in relationship to the number of optional premises locations requested for the facility. C. Number of optional premises. There are no restrictions on the number of optional premises locations which any one licensee may have on his or her outdoor sports or recreational facility. However, any applicant requesting approval of more than one (1) optional premises location shall demonstrate the need for each optional premises location in relationship to the operations of the outdoor sports and recreational facility and the activities of its guests. D. Submittal requirements. When submitting an application of an Optional Premises License, in addition to meeting the application requirements set by the State of Colorado, the applicant shall submit: 1. A map or other drawing illustrating the outdoor sports and recreational facility boundaries and the approximate site of each optional premises location requested. Such optional premises locations shall be numbered and shown in such a manner as to clearly depict the area encompassed in each location. After license approval, the applicant shall update the map or drawing on an annual basis. 2. A description of the method which shall be used to indentify the boundaries of the optional premises locations when in use. 3. A description of the provisions which have been made, including locations, for storing malt, vinous and spirituous liquors in a secured area on or off the optional premises for use on the optional premises. After license approval, the applicant shall update the description upon the provisions for storage being changed. 4. If the applicant does not own the proposed optional premises, a notarized written statement by the owner of the premises approving the application sought. This concluded an administrative investigation into complaints of violations to her current license. On 07/03/2021, I was assigned this investigation with initial assessment being a truck rally to be take place on the 4th of July. I attempted to observe the event; however, it had been canceled I was provided with several videos that had been posted onto YouTube that appeared to show several violations to her liqueur license. These included serving bottle service and allowing outside alcohol on the premise. The videos all revolved around truck shows that occurred in 2019 and 2020. With the video that showed the most violations being from an event in June of 2020. On 07/11/2021, I noticed a horse racing event taking place on the property and asked Deputy Tanner to drive through and observe the operation. Per Deputy Tanner's report under case number 21W027149, he observed security searching vehicles upon entry, from a location where security should not have been able to observe him, they continued to search as he approached the property. He worked his way inside and observed both Modelo and Michelob Ultra being drank by the patrons. As he approached the serving huts, the liqueur license was easily visible. He spoke with the servers who advised that they serve opened cans of the above, up to 4 at a time. He concluded that did not observe any violations at that time. I spoke with Anna by phone and set up a voluntary interview at the South East Substation in Fort Lupton for the 07/13/2021 at 1100 AM. We met her there and conducted the interview in the conference room of the substation. Deputy Brandon Stupka took the primary position as I observed and added questions as I saw fit. Email: tmiller@weldgov.com Anna was asked general questions as to how she serves alcohol at the property, she immediate and openly stated that at an event last June while she still had her dancehall permit, she served bottle service of Buchanan's Scotch to a VIP section in front of the stage. This was a violation of her Optional Premise Alcohol License. She no longer serves spirits and only serves the open cans of Modelo and Michelob Ultra. At the same event she was serving mixed drinks of Buchanan's and pineapple juice in clear plastic cups. She explained that the open cases of Modelo that were observed near the stage was for the band to take as they wanted, rather than having wait staff need to bring them drinks all day. In the video I observed another case that appeared to be stuffed with something near some dancers, however I could not tell if it had any cans of beer, or trash in it. Anna stated that she uses the wrist band method to determine who is of age to drink, continuing that she changes the color and design every event. Anyone who is caught drinking underage or sneaking privately owned alcohol in, is immediately escorted off the property and not allowed back. She has security searching the vehicles upon entry to so that patrons do not bring in their own alcohol as that would take profits out of her pocket. They are also looking for other contraband and weapons. Anna canceled her 4t" of July event because she needed to make an amendment to her USR to allow ATV's. At today's renewal hearing, the Weld County Board of Commissioners set a public hearing for July 21, 2021, to see if there is probable cause to consider suspending or revoking the liquor license based on the below videos. The County Attorney's Office requested the Sheriff's Office conduct an inspection as well, but they are short staffed on the 4th and LED is more versed with liquor violations. Because the complaint was submitted anonymously and the videos were not taken by County staff or LED, it would be extremelyhelpful to the Board to have information directly from LED to support their decision should they choose to suspend or revoke the license. To Whom it May Concern, This letter is to provide some information about the Imperial Horse Race Facility misuse of liquor license. They are having a license renewal hearing on Wednesday June 30th. During some of the events that are held at the Pierce facility at 18233 CR 96, Pierce, CO, 80650 people are served to excess. Also outside liquor is clearly shown to be consumed on site. People are so out of control that the private security has to pepper spray people on a regular basis. The security personnel carry shotguns at the ready to try to control the crowd. The events that they are holding at the facility are not what they are zoned for currently. It was zoned for straight line horse racing. Attached are a few of the numerous videos and pictures of the drunken events that are taking place at this facility. The local fire department has had numerous "Fire Calls" for injured and intoxicated people. It is only a matter of time before someone is maimed or killed at one of these events. Please take some time to look into these events online. Search for "Takuacheland 2020" They are planning to have another one of these truck events on July 4th 2021. The information is from call notes, which are taken by dispatchers when a call is received. Reports were not generated because involved persons had left the scene by the time deputies arrived and there was no information we could follow-up on. 21W016760, Accident with injuries, May 5, 2021 @ 5:15 pm : Caller states person fell from an ATV and was injured during a special event. Medical resources were cancelled by the reporting party. The person was transported to the hospital by private vehicle. 21W016770, Assault, May 5, 2021 @ 6:14 pm: Caller states there was a physical altercation occurred where two men kicked a third person in the head. The victim was bleeding and in and out of consciousness. The suspects and victim left the area. The event was described by the caller as a "big event". RP tells deputy that there was no ambulance on site and victim transported to the hospital by private vehicle. Security tells deputy that there were a couple of fights that got broken up. Suspects and victim not on scene when deputy arrives. We don't have the ability to get information on medical/fire calls at that location after the fact. Deputy estimated 30 security personnel and 6 portable toilets on scene. 19W030487: 08/17/2019 Adult female reports that she was hit in the face by another female. Two days after the assault the victim called in to the deputy handling the case. The victim refused to prosecute and would not provide the deputy the suspects name. 19W030488: 08/17/2019 A security guard was hit in the head while trying to break-up a fight. His injury required a trip to the hospital. He received 6 staples to treat the injury. Unknown suspect. A check in Spillman for the applicant Ana Ornelas provided no information.
