RESOLUTION
WHEREAS, a public hearing was held on Wednesday, October 27,
1971, in the chambers of the Board of County Commissioners of Weld
County, Colorado, for the purpose of hearing the petition of E. R. Austin,
1203 9th Street, Greeley, Colorado, requesting a change of zone con-
cerning two tracts of land and designated on submitted plat as follows,
to-wit:
No. 1: TRACT A - from "E" Estates District to "H-UD"
High Density Unit Development;
No. 2: TRACT B - from "E" Estates District to "R-UD"
Residential Unit Development, and
WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the changes of zone, and
WHEREAS, the Board of County Commissioners has studied the
request of the petitioner and studied the recommendations of the Weld
County Planning Commission as submitted, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners, that the petition of E. R. Austin for changes of zone
concerning the following two tracts of land, to-wit:
No. 1: TRACT A - from "E" Estates District to "H-UD"
High Density Unit Development;
No. 2: TRACT B - from "E" Estates District to "R-UD"
Residential Unit Development;
said tracts being more particularly described as follows:
TRACT A: H-UD Development - A tract of land located in
the Northeast Quarter of the Northeast Quarter (NEB'-NE+)
of Section 14, Township 5 North, Range 66 West of the
Sixth Principal Meridian, Weld County, Colorado and
being further described as follows: Commencing at the
Northeast corner (NE Cor) of said Section 14 and
considering the east line of the Northeast Quarter (NE.t)
of said Section 14 to bear South 0° 41 ' 10" East with all
bearings contained herein relative thereto; thence South
01° 41 ' 10" East along said East line of the Northeast
Quarter (NE.) of said Section 14, a distance of 945. 96
feet to the true point of beginning of Tract "A". Thence
continuing South 01° 41 ' 10" East along the East line of
the Northeast Quarter (NEB'--) of said Section 14, 538. 70
feet; thence South 89° 58' 20" West, 615. 23 feet, thence
North 27° 59' 32" East, 434. 29 feet, thence North 89°
57' 32" East 140 feet; thence North 01° 41 ' 10" West
147. 57 feet; thence North 88° 18' 50" East, 260. 00
feet to the true point of beginning. Said tract of land
contains 5. 3720 acres.

TRACT B: R-UD Development - A tract of land located in the
Northeast quarter of the Northeast quarter (NE 1/4NE 1/4) of
Section 14, Township 5 North, Range 66 West of the Sixth
Principal Meridian , Weld County, Colorado and being further
described as follows: Commencing at the Northeast corner
(NE Cor) of said Section 14 and considering the east line of
the Northeast Quarter (NE 1/4) of said Section 14 to bear
South 0°41'10" East with all bearings contained herein
relative thereto: thence South 01°41'10" East along said East
line of the Northeast quarter (NE 1/4) of said Section 14, a
distance of 1484 .63 feet; thence South 89°58'20" West,
615 .23 feet to the true point of beginning of Tract "B" .
Thence continuing South 89°58'20" West, 810.00 feet; thence
North 03°33'00" West 383 .70 feet, thence North 89°57'32 "
East, 1037 .59 feet; thence South 27°59'32" West,434 .29 feet
to the true point of beginning. Said tract of land contains
8 .216 acres;
are hereby granted under the conditions following:
1 . That any water and sanitation facilities to be installed shall
be approved by the State Health Department.
2 . All applicable subdivision regulations and zoning regulations
shall be followed and complied with in accordance with the zoning
resolutions of Weld County, Colorado.
3. Subject to the Greeley Code of Ordinances, providing that the
developer shall comply with all the rules and regulations of the City of
Greeley relating to drainage outside the city limits , including the payment
of drainage fees; and that contractual agreement shall be made with the
City of Greeley to provide water and sewer services which are necessary
for the type of development proposed for said tracts.
4. That said changes of zone here granted are conditional only for
a period of twelve months from date hereof, on condition that developer
proceeds with due diligence to begin development of the areas re-zoned
and submit plans for such development for the approval of the Weld County
Planning Commission; and that major construction shall commence thereon
within said twelve month period; otherwise, the County may take action to
re-zone the property to its present classification.
