HomeMy WebLinkAbout20211528.tiffRECORD OF PROCEEDINGS MINUTES - PART 1 BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MONDAY, JUNE 14, 2021 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, June 14, 2021, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Steve Moreno, Chair Commissioner Scott K. James, Pro -Tern - EXCUSED Commissioner Perry L. Buck Commissioner Mike Freeman - EXCUSED Commissioner Lori Saine Also present: County Attorney, Bruce Barker Clerk to the Board, Esther Gesick Controller, Barbara Connolly MINUTES: Commissioner Saine moved to approve the Minutes of the Board of County Commissioners meeting of June 7, 2021, as printed. Commissioner Buck seconded the motion, and it carried unanimously. El READ ORDINANCE BY AUDIO: Commissioner Saine moved to read Code Ordinance #2021-10 by audio. The motion was seconded by Commissioner Buck, and it carried unanimously. 1 PUBLIC INPUT: No public input was given. AMENDMENTS TO AGENDA: There were no amendments to the agenda. CONSENT AGENDA: Commissioner Buck moved to approve the Consent Agenda, as printed. Commissioner Saine seconded the motion, and it carried unanimously. IR COMMISSIONER COORDINATOR REPORTS: Commissioner Buck reported the Department of Human Services has approved $2,144,000 in Emergency Rental Assistance funding, and 1,229 requests have been processed. She shared House Bill, HB21-1264, was passed and signed by the Governor which will provide $60 million from the American Rescue Plan for the Workforce Development system. She also provided reports concerning youth employment offered through the Weld Works for Youth Program, volunteer activities of the Workforce Development Board, the findings of the Older Americans Act Audit, and services provided by Meals on Wheels for older citizens throughout the County. Commissioner Saine reported the CSU Extension Service is having a Youth Dairy Extravaganza costume o-7 roe/D1 Minutes, Monday June 14, 2021 Page 1 2021-1528 BC0016 event tonight at Island Grove. Chair Moreno reported a lot of work was accomplished by the Board while attending the Colorado Counties, Inc. (CCI) conference last week, and he commended the various staff members, local agencies, municipalities and citizens who responded and volunteered to provide support to citizens impacted by last week's tornado event near Platteville, Colorado. WARRANTS: 1) GENERAL WARRANTS - JUNE 8, AND 11, 2021: Commissioner Saine moved to approve the General Warrants, as printed. Commissioner Buck seconded the motion, and it carried unanimously. • BIDS: 1) APPROVE BID #B2100094, 1400 FACILITY CABLING — DEPARTMENT OF INFORMATION TECHNOLOGY: Ryan Rose, Director of the Department of Information Technology, stated staff recommends selecting the lowest bidder who met specifications, Sturgeon Electric Company, Inc., for a total amount of $22,747.48. The motion to approve said bid was made by Commissioner Buck, seconded by Commissioner Saine, and it carried unanimously. 2) PRESENT BID #B2100083, CISCO UNIFIED COMMUNICATIONS MAINTENANCE AND SUPPORT — DEPARTMENT OF INFORMATION TECHNOLOGY: Mr. Rose presented the one (1) bid received and stated staff will make a recommendation on June 28, 2021. • 3) PRESENT BID #B2100099, PAVING FABRIC SUPPLY - DEPARTMENT OF PUBLIC WORKS: Rob Turf, Purchasing Department, stated 14 suppliers downloaded the specifications, he presented the one (1) bid received, and stated staff will make a recommendation on June 28, 2021. el 4) PRESENT BID #62100101, CR 47 AND SH 392 SIGNALIZATION PROJECT - DEPARTMENT OF PUBLIC WORKS: Mr. Turf stated 75 suppliers downloaded the specifications, he presented the one (1) bid received, and stated staff will make a recommendation on June 28, 2021. ▪ NEW BUSINESS: 1) CONSIDER COUNTERPROPOSAL AND CONTRACT TO BUY AND SELL REAL ESTATE (41150 TEGAN AVENUE, AULT) AND AUTHORIZE CHAIR TO SIGN ANY NECESSARY DOCUMENTS - CLIFF SIMPSON: Toby Taylor, Director of the Facilities Department, stated these documents are for the new Ault Grader Shed property, for the purchase price of $283,140.00. Commissioner Saine moved to approve said contract and counterproposal and authorize the Chair to sign any necessary documents. Seconded by Commissioner Buck, the motion carried unanimously. El 2) CONSIDER RENTAL CONTRACT FOR WELD COUNTY FAIR AND AUTHORIZE CHAIR TO SIGN - FLEXX PRODUCTIONS, LLC: Bruce Barker, County Attorney, stated this contract is for the rental of various supplies to be used during the Weld County Fair. Commissioner Saine moved to approve said rental contract and authorize the Chair to sign. The motion was seconded by Commissioner Buck, and it carried unanimously. le 3) CONSIDER CONTRACT ID #4829 COMMON USE AND FACILITY RELOCATION AGREEMENT FOR O STREET SPUR PROJECT AND AUTHORIZE CHAIR TO SIGN - COLORADO DEPARTMENT OF TRANSPORTATION AND DCP MIDSTREAM, LP, DBA DCP OPERATING COMPANY, LP: Elizabeth Relford, Deputy Director of the Department of Public Works, stated the O Street East Spur project has been in process since 2014, and this agreement will provide an alternate connection for properties to access the U.S. Highway 85 Bypass. She explained the Colorado Department of Transportation (CDOT) has completed the design, acquired the necessary right-of-way Minutes, Monday June 14, 2021 Page 2 2021-1528 BC0016 and utility relocations, and is responsible for the cost of the construction. The County will be responsible for acceptance and maintenance of the right-of-way, and DCP will relocate its utilities at CDOT's expense. Commissioner Saine moved to approve said agreement and authorize the Chair to sign, which was seconded by Commissioner Buck, and it carried unanimously. le 4) CONSIDER CONTRACT ID #4830 COMMON USE AND FACILITY RELOCATION AGREEMENT FOR O STREET SPUR PROJECT AND AUTHORIZE CHAIR TO SIGN - COLORADO DEPARTMENT OF TRANSPORTATION AND NORTH WELD COUNTY WATER DISTRICT: Ms. Relford stated the terms of this agreement are the same as the previous item with relation to the relocation of utilities owned by the North Weld County Water District. The motion to approve said agreement and authorize the Chair to sign was made by Commissioner Buck, seconded by Commissioner Saine, and it carried unanimously. 5) CONSIDER CONTRACT ID #4842 COMMON USE AND FACILITY RELOCATION AGREEMENT FOR O STREET SPUR PROJECT AND AUTHORIZE CHAIR TO SIGN - COLORADO DEPARTMENT OF TRANSPORTATION AND PUBLIC SERVICE COMPANY OF COLORADO: Ms. Relford stated this is the third agreement related to the O Street East Spur project and the relocation of utilities; however, in this case, Public Service Company of Colorado (Xcel) will sign last. Commissioner Buck moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Saine, the motion carried unanimously. IR 6) CONSIDER TEMPORARY CLOSURE OF CR 60 BETWEEN CRS 53 AND 55.5: Amy Mutchie, Department of Public Works, stated County Road (CR) 60 will be closed from June 22, 2021, through June 25, 2021, for an upgraded culvert replacement, and the one -mile gravel detour route will be sprayed with water to control dust. Commissioner Buck moved to approve said temporary closure. Commissioner Saine seconded the motion, and it carried unanimously. El 7) CONSIDER DECLARING CERTAIN EQUIPMENT AS SURPLUS PROPERTY, APPROVE SALE OF SAME AT AUCTION WITH ROLLER AND ASSOCIATES, AND DELEGATE AUTHORITY TO CONTROLLER TO SIGN ANY NECESSARY DOCUMENTS: Barbara Connolly, Controller, explained the listed equipment has been replaced and is ready to go to auction. Commissioner Saine moved to declare said equipment as surplus, approve the sale of same at auction, and authorize the Controller to sign any necessary documents. The motion was seconded by Commissioner Buck, and it carried unanimously. (Clerk's Note: Following the meeting, Exhibit A was modified to include an additional piece of equipment slated to go to auction.) El 8) SECOND READING OF CODE ORDINANCE #2021-11, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 8 PUBLIC WORKS, OF THE WELD COUNTY CODE (VACATION OF ROAD RIGHT-OF-WAY): Commissioner Saine moved to read Code Ordinance #2021-11 by title only. Seconded by Commissioner Buck, the motion carried unanimously. Mr. Barker read said title for the record. Dawn Anderson explained the proposed revisions are a result of procedural changes and are also consistent with the Resubdivision amendments proposed in Chapter 24, and she indicated there have been no changes since First Reading. No public testimony was offered concerning this matter. Commissioner Buck moved to approve Code Ordinance #2021-11 on Second Reading. Commissioner Saine seconded the motion, and it carried unanimously. Minutes, Monday June 14, 2021 Page 3 2021-1528 BC0016 PLANNING: 1) SECOND READING OF CODE ORDINANCE #2021-08, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 24 SUBDIVISIONS, OF THE WELD COUNTY CODE (RE VACATION AND LOT LINE ADJUSTMENT): Commissioner Saine moved to read Code Ordinance #2021-08 by title only. Seconded by Commissioner Buck, the motion carried unanimously. Mr. Barker read said title for the record. Tom Parko, Director of the Department of Planning Services, indicated there have been no changes since First Reading. No public testimony was offered concerning this matter. Commissioner Saine moved to approve Code Ordinance #2021-08 on Second Reading. Commissioner Buck seconded the motion, and it carried unanimously. la 2) SECOND READING OF CODE ORDINANCE #2021-09, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 23 ZONING, OF THE WELD COUNTY CODE (MISCELLANEOUS ZONING): Commissioner Saine moved to read Code Ordinance #2021-09 by title only. Seconded by Commissioner Buck, the motion carried unanimously. Mr. Barker read said title for the record. Mr. Parko indicated there have been no changes since First Reading. No public testimony was offered concerning this matter. Commissioner Saine moved to approve Code Ordinance #2021-09 on Second Reading. RECONVENE: Chair Moreno reconvened the meeting at 9:23 a.m. El NEW BUSINESS (CONT'D): 9) FIRST READING OF CODE ORDINANCE #2021-10, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 21 AREAS AND ACTIVITIES OF STATE INTEREST, OF THE WELD COUNTY CODE (SITING OF SOLAR ENERGY FACILITIES): Tom Parko, Director of the Department of Planning Services, explained the previous public hearing (Docket #2021-39) designated the County as an area of State interest, and this Ordinance establishes the 1041 procedures for the areas as shown on Appendix 21-B. He further explained there is a zoning permit process in place for solar energy facilities which are five (5) acres or less, the medium facilities are permitted through the Use by Special Review process, and this Ordinance revision will accommodate the large solar energy facilities. Commissioners Buck and Saine thanked staff for working with the stakeholders and commented this procedural structure will likely serve as an example across the state. No public testimony was offered concerning this matter. Commissioner Saine moved to approve Code Ordinance #2021-10 on First Reading. Commissioner Buck seconded the motion, and it carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Code Ordinances #2021-08, #2021-09, and #2021-11 were approved on Second Reading, and Code Ordinance #2021-10 was approved on First Reading.
