RESOLUTION CONCERNING RIGHT OF
WAY FOR ROAD THROUGH E2 E2 of "THE SE4 OF SECTION 13, AND
E2 E2 OF THE NE4 OF SECTION
24, TOWNSHIP 2 , RANGE 65. . •
. Commissioner Straight moved the adoption of the- following
resolution: _
WHEREAS , H. C. Longan and this Board have submitted to
arbitration the question of compensation for about 4.7 acres of
his land taken for a road, and the compensation has been fixed
. on a basis of 4.7 acres of land at $30.00 per acre; Cattle pass
to be constructed $150.00; One and one held miles of four wire
£ence to be constructed $36000, total $64y.00, •And H. C. Longan is now present and has declared his
preference to have the said cattle pass and fence constructed
•r" by the County, and has executed his deed. -
RESOLVED, that in consideration for his deed delivered
• this date to the County, Quit Claim for said 4.7 acres , as more
' particularily described by the center line of said strip, Tarrant

shall .be "issued tothe said H: ._0.. Longan for the sum of $ `7_.00. _
• The County agrees on construction of said road to build
on either sider thereof, a four wire fence complete with- tdvo gates
and"with posts ;of cedar'-two rods apart. And the County agrees
- that it will also at ' the- same time build under said road .a cattle
pass 14 feet in width and 7 feet in height at- some draw to be
selected by H. C. Longan, to be done -in -a Workman like manner,
' timbering work to be maintained by the .county for the - period of
15 years. And said work- and construction to be accepted as
complete compensation for all damages for taking of said- land
and damages to residue if any.

AGREEMENT FOR ARBITRATION., )1
THIS AGREEMENT made this day of
Aarbrat , 1924 between H. C . Longan, as first party,
and the Board of County Commissioners of Weld County,
Colorado , as second party, WITNESSETH:
WHEREAS, action has been taken by the . second
party to establish a public road sixty (60) feet in
width on the line described as follows :
Beginning at a point on the North line of the SE4
of Section 13, Township 2 North of Range 65 West of the
6th P. M. 1125 feet West of the Northeast corner of said
SE4 of Section 13 :
Thence S . 5 00' E. 900 feet :
Thence S .21° 46 ' E. 1427 feet ;
Thence 5 .34 14?' E. 1081 feet to a point
514 feet South of the Northeast corner of Section 24,
Township 2 North of Range 65 West ; thence South on the
Section line between Section 24, Township 2 North of Range
65 West and Section 19, Township 2 North of Range 64, West,
to the South line of the Northeast Quarter of Section 24,
TWP 2 N. R. 65 West and the Northwest Quarter of Section
19, Twp . 2 N. R. 64 West.
WHEREAS, First party is the owner of the- NE4 of said

Section 24 and the St4 of said Section 13, and is willing
to give possession of the strip of land for said road as
above described on said land, but claims damages for the
taking thereof, and the parties hereto being unable to
agree upon the amount of said damages therefor.
It is now agreed to submit the question of damages
to three arbitrators as hereinafter set forth, and that
when said award has been made the said H. C . Longan will
execute Quit Claim Deed of said strip of land occupied •
by said highway to Weld County, Colorado and the said
parties pursuant to the provision of Chapter 26 of the
Colorado Code do hereby submit the question of said damages

The Board of County Commissioners of Weld
County, Colorado, shall cause to be paid to

in full settlement of any and all damages and
compensation to which he may be entitled by reason
of the takinc, for county highway purposes of a strip
of land sixty feet in width described an follows :

following Resolution:
RESOLVED, that a Public Road sixty feet in width be
established across portions of Sections 13 and 24 , Township
2 N - R 65W 6 P. M. , on a line described as follows :
A strip of land thirty feet in width on each side of the
following described center line:
Beginning at a point on the North line of the SE4 of
4'\\ Section 15, Township 2 North of Range 65 West of 6th P. M.
1125 feet West of the Northeast corner of said SE- of Section
13:
1\ Thence S. 5° 00' E. 900 feet;
k r ; Thence S. 21° 46 ' E. 1427 feet;
Thence S. 34 14 ' E. 1081 feet to a point
514 feet South of the Northeast Corner of Section 24, Township
2 North of Range 65 hest; thence South on Section Line between
Section 24 , Township 2 North of Range 65 West and Section 19,
Township 2 North of Range 64 West , to the South line of
Northeast Quarter of Section 24 , Twp 2 , N. R. 65 . lest and
the Northwest Quarter of Section 19 , Twp 2 N. R. 64 West,
and that for determining what compensation, if any, shall be
paid H. C. Longan, the owner of the Right of Way for said
road the Board of County Commissioners shall enter into an
agreement with him for arbitration of said compensation by:
