The following narrative helps explain the proposed USR application
This application seeks to permit a Use by Special Review for Commercial Rodeos and Commercial Roping
Arenas, which is a permittable use per Section 23-3-40 E of the Weld County Code Specifically, for a barrel
racing facility and for other rodeos and equestrian events No new structures, parking, access changes,
arenas, lighting, signage, fencing or landscaping are proposed All site components are existing
This facility was originally permitted by Use by Special Review permit number USR-1224, recorded March
8, 2000, reception #2754165 Then in 2013, Two -lot Recorded Exemption RECX13-0078, recorded
September 22, 2014, reception # 4047532, split the parent parcel of land on which USR-1224 was located
The USR was to be associated with only Lot B of RECX13-0078 and would require the USR to be partial
vacated (to decrease the size of the USR) in order to match only the Lot B boundary Therefore, the USR
boundaries were reduced in size via USR-1224 Partial Vacation, recorded October 15, 2014, reception
#4054272 Then in 2019, Amended Recorded Exemption 1AMRECXI9-13-0078 increased the boundaries
of Lot B of RECX13-0078 on which the USR was located Condition of approval #2 A of the Amended
Recorded Exemption staff report, dated June 18, 2019 required either 1) the USR application to be
expanded via a Major Amendment to the USR, so that it would match the new, larger property boundary
or 2) that the USR be vacated in which case, the USR would be removed from the property The property
owner, Barton Land and Cattle, Inc selected the USR vacation option, as documented in the letter dated
August 6, 2019, signed by Denise Barton The USR-1224 vacation hearing was scheduled for and heard by
the Board of County Commissioners on August 19, 2019 USR-1224 was thereby vacated by the Board of
County Commissioners by Resolution, signed August 28, 2019 and recorded September 5, 2019, reception
#4520882 Following the recordation of the USR vacation Resolution, the 1AMRECXI9-13-0078 plat was
recorded November 20, 2019, reception #4543374

However, the Planning Department was then contacted by the property owners regarding the USR and
that the USR was vacated accidently and unintentionally As a result, the property owners are re -
permitting the same facility that was previously permitted and operated in the past for the same use via
the proposed USR20-0038 application

USR Planning Questionnaire
Barton Land and Cattle, INC.
1 . The proposed name for this USR is Barton Land and Cattle , Inc . The proposed use will be
for farming and ranching as well as rodeo events .
2 . To generate income as it relates to the agricultural industry for farming and ranching as well
as rodeo . Primarily barrel racing and limited similar equestrian activities ( gymkhana )
3 . The current use of the land is farming , ranching , and rodeo events . The previous use of the
land was ranching and rodeo events .
4 . The proposed use proximity will be no closer than 500 feet to any other residents .
5. The surrounding land use of the proposed site is farming , ranching , and various other
agricultural uses .
6 . The hours and days of operation will be Sunday through Monday, 7 AM until 7 PM .
7. There are two full-time employees , 1 rodeo contractor by the name of True West Barrel
Racing productions, and our daughter who lives on site . The rodeo contracting company will
be present 4-6 weekends out of the year.
8. During the majority of the year, there will be 4-8 people on the site at a time . During rodeo
events , in the summer, approximately 4-6 weekends a year, there will be about 50
contestants and 50 spectators at any 1 time .
9 . During the majority of the year, there will be 10- 15 horses on the property at any given time .
In the summer months, during rodeo eventing weekends , there will be up to 50 horses at
any given time .
10 . There will be haying equipment, a manure truck , tractors, and livestock trailers on the
premises throughout the year. There will normally be 6- 10 pieces of equipment at any one
time , but will increase during the summer months as livestock trailers come during the day.
The livestock trailers that come during the day will not stay overnight.
11 . The current existing structures on the property are as follows : 1 hay storage barn , 4
livestock shelters , 15 fenced corrals , 1 fenced arena , 1 home with attached office and
garage , 1 empty commodity shed , as well as a public restroom . No new proposed structures
at this time .
12 . Hay will be stored in the hay barn and manure will be spread on other farm ground .
13 . The 2 cubic yard dumpster for trash is removed weekly by Waste Management, Inc. Manure
from the pens is removed daily and put into a large pile that is removed monthly. Currently,
there is an abandoned mobile home and boat on the northwest side of the property that will
be removed properly in the next coming months . Portable toilets , if needed , in the summer
months will be maintained weekly by Country Johns and disinfected daily.
14 . There will be no continued construction of this operation . This property had a USR since
1989 that was erroneously vacated in 2019 .
15 . There are no proposed lot surface changes. The existing lot surface type are gravel
roadways and parking , a sandy arena , grass, landscaping , dirt , and buildings that sit on
approximately 70 acres . Please see map .
16 . Parking is abundant on gravel parking lot. It can accommodate 50-75 trucks and livestock
trailers with overflow parking that can fit 20-30 additional livestock trailers and trucks if
needed . There are an abundance of handicapped accessible spaces.
17 . There are no new proposed fencing or screening for the site . The current fencing is white
vinyl fence around the home , shop , and public restroom . There is piped fence around the
arena and pens and there is barb-wired on the boundaries of the property. The hay barn is
used for hay storage .
18 . There will be no new proposed landscaping for the site . The existing landscaping for the site
includes barley and grass crop , sand in the arena , gravel for parking , and dirt in the pens .
19 There will be no reclamation procedures to be employed as they are all consistent with a
farming and agricultural landscape
20 There will be no burning of materials on site at any time The roads will be kept open for
emergency fire personnel There are two fire extinguishers on site, 1 in the garage and 1
outside the commodity shed There is plenty of water available should a fire need to be put
out
21 This proposal is agricultural based and supports the agricultural and farming community
22 This proposal in consistent with the intent of an agricultural and farming district in which it is
located
23 This proposal will be compatible with the future development of the surrounding area based
on its agricultural and farming ideals
24 This proposal will not impact the protection of the health, safety, or welfare of the inhabitants
of the surrounding areas
25 This property has no irrigation water There is no well The only water available to this site is
a commercial water tap by the Weld Central Water District The agricultural land will not be

southwest stalls There are flood lights in every bay of the commodity shed There is a

Waste Handling Plan
All manure will be removed from premise monthly. It will be piled on west end of property until it is loaded into a
manure spreader and spread on our neighboring farm ground.
All trash will be collected using a 2yd trash dumpster (not visible from the road) and picked up by Waste Management
every Wednesday. There will be multiple trash cans located throughout the property on event days.
There are no other wastes identified.

Damage to Underground Public Utility Facilities
Generals
Colorado Interstate Gas Company (CIO) is a Federally regulated natural
gas transmission company which owns and operates an interstate
pipeline system for the gathering, transmission, and wholesale
distribution of natural gas. CIG's primary markets are distribution
companies along the front range of the Rocky Mountains.
Scope:
This document, in compliance with Section 1, Title 9, Article 1.5 of
Colorado Revised Statutes 1973, contains; 1) the name, address and
telephone number from which information concerning the location of
underground facilities within the county may be obtained, and 2) a
general pictorial description of CIO's facilities in the county.
NOTE: These maps are not to be used for the purpose of locating
facilities.
Notification:
.Any person requiring information about CIO facilities in held County,
Colorado, as per Section 1, Title 9, Article 1.5, Colorado Revised
Statutes 1973, may obtain such information by calling collect or

MEMORANDUM OF AGREEMENT

This Memorandum is made this 1s'4- day of August 2011, by Noble Energy, Inc
("Noble"), 1625 Broadway, Suite 2200, Denver, CO 80202
On July 29, 2011, Harold W Northrup, ("Surface Owner") and Noble entered into a
Surface Use Agreement (the "Agreement") providing for the use of the surface of the land
described below by Noble m connection with certain oil and gas operations and the
compensation to Surface Owner for all damages (except as provided in the Agreement) to
the surface of the land associated with the drilling, testing, completion, recompletion,
reworking, reentry, pumping, operation and maintenance of the wellsites to be located in
Township 4 North, Range 64 West, 6th P M
Section 8 NW/4NE/4
This Memorandum of Agreement is executed by Noble and placed of record in Weld
County, Colorado for the purpose of placing all persons on notice of the existence of the
Surface Use Agreement A true and complete copy of the Agreement is available from
Noble to any person with an interest in the above -described land
