Akins Jr. , 2950 Pearl Street, Boulder, Colorado, requesting a change of zone from "A" Agricultrual District to "MH-UD" Mobile Home Unit Development of a parcel of land more particularly described as follows, to-wit: The Southeast Quarter of Section 28, Township 1 North, Range 68 West of the 6th P. The south 30 feet and the east 30 feet of described parcel shall be for county road-way purposes. Said parcel contains 3. 593 acres, more or less, which acreage includes the 30-foot parcels for county roadway, all as appears on plat as submitted and made a part hereof by reference, came on for hearing on June 30, 1972, and the Board of County Commissioners of the County of Weld, having heard the testimony and evidence adduced upon said hearing, and having heard the testimony, evidence and recommendations of the Weld County Planning Commission filed with said Board, and having carefully weighed the same, now makes the following findings: 1. The evidence discloses that the applicant failed to sustain the burden of proof as to the need for change of zone, or that the present zone is erroneous or that circumstances warrant a change of zone at this time. 2. The evidence discloses that the present zoning is complimen- tary to the surrounding area. 3. The evidence and investigation shows that the inhabitants of the immediate vicinity of the area sought to be rezoned are unanimously opposed to the change of zone. 4. The evidence further discloses that the area sought to be rezoned does not have adequate water and sewer to serve a development as contemplated. 5. That each of the preceding findings in and of themselves, and independent of each other, constitutes a separate and individual ground for denial of the change of zone. RESOLUTION WHEREAS, the Board of County Commissioners of the County of Weld has heard the application of Guy B. Akins Jr. , 2950 Pearl Street, Boulder, Colorado, for change of zone from "A" Agricultrual District to "MH-UD" Mobile Home Unit Development of said parcel of land as here- inabove recited and made a part hereof by reference, and WHEREAS, said Board has made its findings on the evidence and testimony submitted to it, which findings precede this Resolution and by reference are incorporated herein and made a part hereof, and WHEREAS, said Board has carefully considered the petition, evidence and testimony and the recommendations of the Weld County Planning Commission, and has made an investigation of the area, and given the same such weight as it in its discretion deems proper, and is now fully advised in the premises; -2- NOW, THEREFORE, BE IT RESOLVED, that the petition of Guy B. Akins Jr. , 2950 Pearl Street, Boulder, Colorado, requesting a change of zone from "A" Agricultural District to "MH-UD" Mobile Home Unit Development of the parcel of land indicated above be, and it hereby is denied upon each of the grounds set forth in the Board's findings therein. Quite frankly, I could understand any objections from the Weld County Health Department based on a hookup to the present plant. The plans of Ranch View Park, letter of commitment from the Lafayette City Council and affirmative recommendation from the Lafayette Planning Commission state service to the development will only be provided by a new waste water treatment plant. This new plant is to be constructed in approximately two years and is to be designed and constructed to serve the entire Coal Creek drainage basin. The service of an entire basin by one major waste water treatment plant is the philosophy the Environmental Protection Agency has been promoting since that agency came into existence. The design, engineering, construction, and occupancy of Ranch View Park will be geared to service by a new waste water treatment plant. It can be arranged so that other property owners in the area will be able to hook onto this utility. This would be a benefit to the present property owners and to Weld County. Domestic Water Outlot B of Ranch View Park has been reserved for water storage and pumping facilities. This was done by our engineers with consideration of the present needs and the sometimes inadequate water pressure of the present water system in the area. Upon consideration and analiza- tion by Left Hand Water engineers another alternate is available, that is Ranch View Park to join with the water company in new pumping facilities and the installation of a new main from the existing storage tank, approximately one mile north of Ranch View Park on Weld County Road No. 7, to the Ranch View Park site. Regardless of which one of the two methods would be required all the people getting water from Left Hand Water Co. would benefit from improved service. Fire hydrant locations are shown on the plan for that purpose. The water system design will provide for water pressure that will meet required fire flows. Weld County Comprehensive Plan The Weld County Planning Staff states that this project "does not lend itself to the Weld County Comprehensive Plan concept" . Weld County has made much progress in meeting the requirements in the State Statutes that must be adhered to in the development of a County Comprehensive Plan. But even with the progress made thus far, at this point in time Weld County does not have an officially adopted Comprehensive Master Plan or a publicly accepted Comprehensive Plan Concept. Boulder County Plan The Weld County Planning Staff states that this project "does not fit the Boulder County plan" . Boulder County and the City of Boulder worked for several years to develop what is known as The Boulder Valley Comprehensive Plan. This plan was officially adopted by the County and the City in December 1970 and covers an area approximately 42 times the size of the City of Boulder as it existed in 1970. The east boundary of this plan, which is nearest to the Ranch View Park site, is Boulder County Road No. 25 which is a distance of nine miles from Ranch View Park. There is no other plan which has been accepted or adopted by the Boulder County Commissioners. -Lafayette Comprehensive Plan The Weld County Planning Staff states that "Lafayette has no comprehensive plan to accommodate such a large development" . Lafayette is also in the process of developing a Comprehensive Plan. This community may not be in a unique position, but it is a difficult one in terms of developing a Comprehensive Plan. It lies close to the juncture where Weld County, Adams County and Boulder County boundaries all meet and must coordinate its planning efforts with three different County Planning Staffs, three different Planning Commissions and three different Boards of County Commissioners as well as accommodate the wishes of the citizens of Lafayette. This is a progressive community that wishes to have controlled growth and I am sure that it will. Mr. Lorenson stated to me that the planning staff generally supports the recommendations of the various city planning commissions and city councils, whether they are actually in Weld County or not. This support of the various legally constituted bodies will be a great assistance to the communities as well as to developments such as Ranch View Park. Timing of this Application I feel that an excellent job of identifying a need and planning for that need is being done here. When it comes to planning for the future nothing is really premature. As a matter of fact I know that you gentlemen and the planning staff would appreciate two years "lead-time" on planning and development matters , but we all know that advanced planning is not always done. I respectfully state that the planning for services such as water and sewer are viable plans that will be realities as soon as we are allowed to proceed. I believe a good job of farsighted planning is being done here. Ranch Eggs Subdivision Ranch Egg-s is a residential area that allows a specific home occupation. Twenty Two of the residences in the subdivision have facilities to house chickens. Fifteen of the residences do not have facilities to house chickens. • It is truly a residential area with some of the _owners engaged in a home occupation. Ranch View Park will also be residential area. Ranch View Park, has a den-sity of 5. 14 units per acre which by land planning standards is low to medium density, and the other, Ranch Eggs Subdivision, with one acre or larger lots is by the same standards low density. The land use will be almost identical, which is simply providing homes or home sites to those who need them. Size and Location I feel that the size of Ranch View Park, 157 acres, is ideal. from the economic viewpoint of the developer as well as the economic view of the County and the needs of the area. It is large enough to allow the developer to install proper utilities to the site which also are a benefit to other properties in the area. The size permits the developer to leave 51. 93 acres in major and interior green areas , it will also allow the developer to provide excellent community facilities and the other amenities we all desire. I will go into the details of the economic value of the development to the County in a few minutes. As far as location goes it is ideal it is right in the center of where most of the people new and old, in the State would like to live. 1 have lived in Colorado my entire life and traveled and worked in _five of the surrounding States in the past fourteen years. In doing so I have talked to many people in various capacities and I can say that the most talked about area, as far as desirability to live is concerned, is the eastern slqpe here in Colorado. It is quite obvious that Colorado is growing, particularly along the eastern slope, and it is very obvious to me that we should plan ahead for accelerated growth. That is what we are attempting to do with this project. School Facilities There is the obvious possibility that this development could increase the student enrollment within the school district. It also can be stated that developments such as this have a high percentage of retired people and young working married couples with no children and a low percentage of people with school age children and thus it would not substantially increase school enrollment. -Regardless of which argument is used they are both strictly conjectures and both points of view can be proven valid or false depending on what is trying to be shown. I feel that the need to provide for the possibility of additional educational facilities must be planned for and we have done this . The northeast corner of Ranch View Park amounting to 9. 15 acres is reserved for dedication to the school district, and will be done upon instructions to do so from you gentlemen. This will be done at no cost to the school district or to the county. We all know that it takes considerably more than a site to make a school a reality. I researched the major source of income that make schools and there operation possible, namely the property tax. In doing so I found some interesting facts that not only show that Ranch View Park will pay for a school that may be needed but also shown that the economic gain to the county would be greater than any costs the county may incur in any service it would be called upon to do. Before I get into the figures there are four things I wish to point out. R First; all the area is in the assessor's tax di-strict JR1-4 . Second; all the sections to be described were on two separate sheets in the assessor's land book and are last years assessed values , those for this year are not done. Third; for purposes of comparison Z totalled the assessed values of the two separate sheets. Fourth; The actual value for Jlanch View Park was derived by using -the Weld County Assessors method. A value of -$2 , 000 .00 per acre plus $2 , 300. 00 per space equals -actual value. 30% of this total equals assessed value. I will now present the assessed values , mill levy, and tax _revenue for existing properties and improvements and -for Ranch View Park. The request has been submitted to the City of Lafayette Planning Commission and the Lafayette City Council, both un- animously voted in favor of the project. The request was presented to the municipality according to State requirements which require change of zoning requests within three miles of a city to be referred to that city for formal consideration and action when such city has an active Planning Commission and has, or is in the process _of adopting, a Master Plan. The proposed proj eDt corresponds to the City of Lafayette projected • growth, service and planning area. In accordance with the Weld County Planning Commission rules the following written information must he submitted: l.. The land cannot, according to its current zoning classification, be developed in the manner pro- posed. It is the opinion of the owner—applicants that the mobile home park would be the best and highest use of the subject land. • 2. The proposed rezoning would benefit the entire County by allowing a development which is needed. There is a definite need for mobile home spaces in the southwest part of Weld County. People are in need of a -place to live, which they can afford. The present cost of housing in the surrounding area (Weld, Adams and Boulder Counties) is very high in price and consequently not available to many people in the middle or low income bracket. It is realized by the applicant that there are mobile home parks in other parts of Weld County with available spaces . April 10, 1972 3. There would he a long range benefit to the lands adjoining the area in which we are requesting the zoning change. There would be an increase in land values in the area, and sewer service would also be available to existing homes -and property. 4. Other land in the area could be rezoned the same as that in this request. The only comment here is that the owner of any such land so re-zoned should be required to participate in the cost of the sewer trunk line and follow the other procedures required by this applicant. 5. The other areas in Weld County already zoned according to this request are unsuitable for the reason of location or distance from the proposed area of development. • The proposed development would serve Lafayette, Erie, the southwest portion of Weld County and the northwest corner of Adams County and would • be a benefit to the area. 6. The zoned classification assigned to the area was not necessarily at fault when originally done. However, since that time there have been many changes of u.-se in the area and there has been a demand for housing created in the area, as has been the case throughout the eastern portion of the State. ' It is the need to serve this demand and the change of condition-s related to this demand on which we base this request to have the zoning classifica- tion -changed. Akins, Principal Planner • GBA: jd Ranch View Park re-zoning request and how it relates to the "Weld County Land Use Policy" as adopted by the Weld County Planning Commission on August 16 , 1971. First - "Retain prime agricultural land for agricultural use" . The owners of the property do not feel that this is prime agricultural land. It is dry . land farming and the only type crop has been wheat. The production ha-s been on a "marginal or less" return. The proposed development is also within a recognized urbanizing area. Second - "Retain and build upon existing communities , normal residential , business and industrial uses will be encouraged to develop in the 27 Weld County incorporated towns to the extent to which the Town wishes the growth. Towns will serve as seeds to future urban growth" . Although the proposed development is not in the area of influence of a Town in Weld County it is within the planning area of Lafayette in Boulder County. The Lafayette Planning Commission, at a -formal meeting, heard this proposal and unanimously voted in favor of serving the development with sewer service. The only stipulations were that the park and sewer be designed to the Town' s standards and that the property would be -annexed to the Town when such annexation is possible. It is the feeling that this will happen in the near future since Lafayette is one of the few Towns in Boulder County encouraging growth. The Lafayette City Council also was presented with the proposal at a regular meeting. The recommendations of the Town :Planning Commission were read by the Chairman of the Planning Commission. The City Council unanimously voted in favor of the proposal and directed Mr. Flewelling, City Manager, to write to the Weld County Planning Commission and inform that commi-ssion of their decision. A copy of the letter is -enclosed with this application. Third - "Agricultural green belts and allocation of resources , the main resource being water, land and utilities" . Over 30% of the total area of the development will be left in open space or _green belt and it probably should not be described as agricultural green belt . However, there are areas in the vicinity that lie below existing irrigation ditches that are or could be put into a more productive agricultural use and would he retained as agricultural green belts. -2- There is also property in the area that has been undermined and is unsuitable for Ievelopment. This will, in all probability, also remain as agricultural green belt. Water usage will not be transferred from agricultural to residential use. Left Hand .Water Supply Company has given a committment to serve Ranch View Park. A letter to that effect is -enclosed. Other than the -sewer intercepter line, utility line • extension would not be needed. The area is presently served by the following: 1. Water; Left Hand Water Supply Company. 2. Gas; Public Service Company of Colorado. 3. Electric; Union REA 4. Telephone; Mountain Bell. The sewer intercepter line would be built to the west and tie into the n-ew Lafayette main collection line. "Perogative and approval of local jurisdication " . As stated before this proposal has been presented to the Lafayette Planning Commis-sion and the City Council and -they approve of the proposed development. "Expansion and prosperous growth - need not be chaotic or uncontrolled" . The development of Ranch View Park will make it one of the better tax bases in southwest Weld County. It is well planned and will have much more than the minimum engineering done in all areas of concern. It will be an asset to Weld County and will meet a definite and well defined need. LAND USE AND DENSITY RANCH VIEW PARK LAND USE AND DENSITY (TOTAL ACRES 157) Land use will he limited to the following : 1. 802 Mobile Home Spaces 2. One (1) single family resident on outlot A, (1. 77 acres) . 3. Water storage tank and open area on outlot B, (1. 40 acres) . 4. Community Building, Office, Post Office Boxes, day care center, and other recreation and open space on northeast corner of property. If requested by Weld County a portion -of. this tract will be dedicated for a -school site or other appropriate public use. 5. Ball Park and Open area on southwest corner of property. 6. Boat and Camper storage, 256 spaces as shown. 7. Major Green Area (2) 32. 63 Acres. 8. Interior Green Areas 19. 30 Acres. 9. Streets 20. 22 Acres. Access to adjoining properties has been provided on all sides of the site. Mr. Akins has requested a commitment from the City of Lafayette for sewage treatment service. The City Planning Commission and Council has approved Mr. Akins request on the following basis: 1) Such treatment would be available only when Lafayette's major metro sewer treatment plant is in operation. Planning and grant applications for -this plant are presently under way. 2) Since it is not inconceivable that the mobile home park would be adjacent to or within the City cf Lafayette at some future time, we would request that design and • engineering of the mobile home park comply with Lafayette's mobile home code. . 3) The developers of Ranch View Park would be required to extend the trunk line from the mobile home development to the nearest Lafayette outfall line. The developers would also be required to agree -to annexation to the City in the event the boundary ever becomes contiguous. Z- 197 ; 72 ; 60 ; which is a request by Mr . Guy Akins , Jr. for a tuning change from agricultural to Mobile Home Park east of the City of Lafayette in Section 28, Tl , R68. We have previously contacted you concerning the City ' s conditional commitment to provide sewer service to this mobile home park and I believe that the letter written concerning the sewer service is self explanatory . However, we feel that some clarification might be need- ed concernin-g fire protection services for this mobile home park . Lafayette ' s Fire Department is a City oper- ated one manned by volunteer firemen and derives no revenue from outside City property owners . A letter, from the City regarding this action is enclosed as is one from the City Engineer regarding preliminary sewer design. An outfall line will have to be constructed. WATER: Left Hand Water Supply Company has given 'a written committment to serve the development with domestic water. A letter to that effect is enclosed. Mr. Ken Rollin, P.E. , Engineer for Left Hand Water, has been contacted about the interior water system design. The Company has no specific requirements on design other than it be a good system without leaks. The Engineer -does have copies of the .proposed utility design. The Water Company has an existing main in County Road #7 in front of the subject property. GAS : Public Service Company of Colorado has been contacted concerning this service. There is an existing gas main in County Road #7 in front of the property. The preliminary utility design was reviewed by their Engineering Department. They stated that a "Blanket Easement" would meet the Company requirements . This Blanket Easement will be given to all utilities. ELECTRIC: Union Rea has service to the area and has been contacted regarding this project. Copies of the Plat and utility plan have been submitted to the Company. They are able to serve the Development. Upon approval of the change of zoning request, final • engineering design will be undertaken and said design will be in complete co--operation with the aforenamed companies . All utilities will be placed underground. Terminals and meters will be placed on the back lot lines of the trailer spaces and will not be in the green areas separating the trailer spaces . LANDSCAPING The individual Mobile Home Space yards and Green Areas will be grassed. Each lot will have at least two trees. The Green Areas will also have tree plantings, for shade, screening, and Park like appearanc-e. The exact type and location of -each planting will he determined by -a Landscape architect. It is anticipated that evergreens such as Ponderosa Pine and Eastern Red Cedar combined with Russian Olive, Maple and other decorative trees such as Flowering Crab, will be used. Mature trees will he used along County Road 07 (Huron Street) and around. the Community Building, as well as being planted in areas throughout the Park. These trees will be at least four inches in diameter, five feet above the ground when planted. All other trees will be at least three feet in height upon planting. • Decorative Bushes also will be used throughout the area. It is our intent to make Ranch View Park an aesthetically pleasing place to live.
