CHANGE OF ZONE (COZ)
QUESTIONNAIRE
Answer the following questions on a separate sheet. If a question does not pertain to your use, please respond with
"not applicable".
1. Describe the purpose of the proposed Change of Zone.
This Change of Zone is required so that Dan's Garage may construct a new facility because he is being displaced by
CDOT at his current facility on CR 44. The existing zoning is Ag and the proposed zoning is I-2
2. Explain how this proposal is consistent with the Weld County Comprehensive Plan.
'veld County encourages Commercial and Industrial Uses along the HW 85 corridor which this property is. It is also
between HW 85 and a very large Commercial Feedlot which would discourage residential uses in the future.
Explain how the proposed rezoning will correct what the applicant perceives as faulty zoning, or how the proposed
rezoning will fit with what the applicant perceives as the changing conditions in the area.
The proposed I-2 zoning is an ideal fit along a busy State Highway 85. The site is also between a large
commercial feed lot, Oilfield Storage facility and HW 85. The existing zoning is Ag
4. Explain how the uses allowed by the proposed rezoning will be compatible with the surrounding land uses. Include
a description of existing land uses for all properties adjacent to the subject property.
Farmland surrounds the property on all sides. There is a residence across CR 85 east of the east side that site.
The Bakers will place their buildings south of that house to not obstruct the views. There are (2) residences
along CR 46 that are adjacent to the south side of the property. They are not on the property.
5. Explain how this proposal complies with Article V and Article xl of Chapter 28 if the proposal is located within any
Overlay Zoning District (Airport, Geologic Hazard, or Historic Townsites Overlay Districts) or a Special Flood
Hazard Area identified by maps officially adopted by the County.
This site in not within any special overlay districts.
Does the sail report indicate the existence of moderate or severe soil limitations? If so, detail the methods to be
employed to mitigate the limitations for the uses proposed.
There are no sail limitations on the site.
7. Describe the proposed source of drinking water source an the property. If utilizing a drinking water well, include
either the well permit or well permit application that was submitted to the State Division of Water Resources. If
utilizing an existing public water tap, include a letter from the water district, a tap or meter number, or a copy of
the water bill. If public water is proposed for new development, provide a "will -serve" letter from the water provider.
Dan's Garage has water taps at his current facility that Central 'Feld has agreed to transfer to this facility since
he is being displaced by CDOT.
Describe the proposed sewage disposal system is on the property. If utilizing an existing septic system, provide
the septic permit number. If there is no septic permit due to the age of the existing septic system, apply for a
septic permit through the Department of Public Health and Environment prior to submitting this application. If a
new septic system will be installed, please state "a new septic system is proposed." Only propose portable toilets
if the use is consistent with the Department of Public Health and Environment's portable toilet policy.
A leach field will be provided for sewage disposal at the facility. There are currently no existing leach fields on
the property. There are currently no buildings on the property.

There is no plan for development crossing pipelines at this time. We understand we will

The image below illustrates the proposed facility in relationship to the existing boundary of Evans (blue parcels). The
property outlined in red is within the City's Urban Growth Boundary. I don't see how it can be in the Milliken UGB
being this far east. The Future Land Use reap in the Comprehensive Plan designates this property for Commercial Uses,
which a Repair Shop is a use allowed through a Special Review process in Evans. The City of Evans can process an
Annexation/Zoning and SUP permit concurrently in approximately 5-6 months after submittal of a complete
application. The City would like to have a discussion about this project with the applicant.
Tom and Max, contiguity can be met most likely through properties and not through annexation of WCR46. Eric, the
City of Evans has annexed WCR33 to the northern boundary of WCR 46. An access permit will be needed from the
County if contiguity can be met outside of annexing Road 46.
