HomeMy WebLinkAbout20210614.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MONDAY, MARCH 3, 2021 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, March 3, 2021, at the hour of 9:00 a.m. W = ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Steve Moreno, Chair Commissioner Scott K. James, Pro-Tem Commissioner Perry L. Buck Commissioner Mike Freeman Commissioner Lori Saine Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Isabella Juanicorena Controller, Barbara Connolly MINUTES: Commissioner Freeman moved to approve the Minutes of the Board of County Commissioners meeting of March 1, 2021, as printed. Commissioner Saine seconded the motion, and it carried unanimously. Ei PUBLIC INPUT: Steve Teets, Greeley resident, presented a flyer regarding the Greeley Food Tax Rebate Program, requested permission to post said flyers, and further submitted, on behalf of the Citizens' Bus Improvements Committee, a proposal for a regional route system (Exhibit A). AMENDMENTS TO AGENDA: Commissioner Freeman moved to delete item #4 under Consent Agenda -Miscellaneous. The matter was seconded by Commissioner James, and it carried unanimously. PA CONSENT AGENDA: Commissioner James moved to approve the Consent Agenda, as amended. Commissioner Freeman seconded the motion, and it carried unanimously. PROCLAMATIONS: 1) WELD COUNTY RANCHING, LIVESTOCK AND MEAT -IN DAY - MARCH 20, 2021: Chair Moreno thanked Commissioner Saine for bringing the matter forward to support the agricultural business in Weld County. Chair Moreno read the proclamation for the record. Itgl Kevin Ochsner, Kersey resident and cattle rancher, expressed gratitude towards the leadership of Weld County for supporting the agricultural industry, which supplies nutritious food and clothing products to the state of Colorado and to the world. He shared the challenges that the industry faced over the past ©5/o5/a0al Minutes, Wednesday, March 3, 2021 Page 1 2021-0614 BC0016 year, but was pleased to have people who step up to support and strengthen the industry and the families of Weld County. • John Scanga, Ault resident and member of the Colorado Beef Council, thanked the Board for their leadership and for doing what is right and standing up against politicizing issues of human rights. Tami Arnold, Hudson resident, stated she is raising the next generation of ranchers who will support agriculture and raise cattle that will feed the world. She thanked the Board for standing up for what is right for Weld County and the agricultural industry as a whole. • Paul Hill, Nunn resident, represented those who have moved to Weld County because of the agricultural industry, on which he and his family rely for income. • Commissioner Saine encouraged those in attendance to speak with the Commissioners after the meeting to take the concerns to the State. She recognized those who have the fundamental decency to grow the food, tend livestock, and care for their community, and stated farmers are the original stewards of the land who produce more outputs than inputs. She noted an all plant -based diet does not provide the same quality/quantity of necessary nutrients for a healthy diet, which would ultimately have an impact on low income families. She thanked farmers and ranchers for allowing the citizens of Weld County to pursue the American Dream. • Commissioner James thanked those for attending, and accredited his career and success to the value of hard work that was instilled in him from working on farms and ranches in his younger years. He commented on the principle that free people who engage in free enterprise will always make the best decisions for the community and their families, and regarding menu planning, the government should not be involved. He stated that agricultural operations make $1.7 billion of annual financial input, meaning $4.7 million per day; therefore, he supported the proclamation for agriculture and thanked farmers and ranchers for their efforts. • Commissioner Freeman, 4th generation Weld County resident and farmer, commented on the principle of the matter, and expressed frustration with the continuous attacks from the State, whether it be on the oil and gas industry, the agricultural industry, or the pandemic. Despite the attacks, he stated Weld County will continue to stand up for what is right for the community, and fight for every citizen's constitutional rights. He commented on the impact that government has on the youth when rules are forced upon them. He reiterated Weld County will support the citizens and fight to protect the community's rights and liberties. ,_= Commissioner Buck was honored by the public engagement and commented on how she owes her father, Bill Webster, President of the Colorado Livestock Association and inventor of customer cattle feeding operations, everything she has, and further will continue to support the citizens and farmers. Chair Moreno concurred with all previous comments and reiterated Weld County is Number 1 in the state for agricultural production, which further supplies products to the rest of the world. He encouraged citizens of Weld County to support agriculture on March 20, 2021, and thanked those who attended. Commissioner Freeman moved to approve said proclamation, which was seconded by the rest of the Board, and carried unanimously. (Clerk's note: the group gathered for a photo opportunity.) Minutes, Wednesday, March 3, 2021 Page 2 2021-0614 BC0016 El WARRANTS: 1) GENERAL WARRANTS - FEBRUARY 26, 2021, AND MARCH 1, AND 2, 2021: Commissioner Freeman moved to approve the General Warrants, as printed. Commissioner James seconded the motion, and upon a roll call vote, the motion carried four to one, with Commissioner Saine opposed. BIDS: 1) APPROVE BID #62100055, FLASHING STOP SIGNS - DEPARTMENT OF PUBLIC WORKS: Barbara Connolly, Controller, stated staff recommends selecting the lowest bidder who met specifications, Traffic and Parking Control (TAPCO), for a total amount of $24,000.00. Commissioner James moved to approve said bid, the motion was seconded by Commissioner Saine, and it carried unanimously. _= 2) APPROVE BID #B2100056, ROOF REPLACEMENT FOR LAW ADMINISTRATION BUILDING - FACILITIES DEPARTMENT: Ms. Connolly reviewed staff's recommendation to award Select Roofing Contractors, the low bidder meeting specifications, for a total of $79,640.00. Commissioner Freeman moved to approve said bid, the motion was seconded by Commissioner Buck, and it carried unanimously. • 3) APPROVE BID #62100057, PARTIAL ROOF REPLACEMENT FOR JAIL 2 EAST - FACILITIES DEPARTMENT: Ms. Connolly stated the Facilities Department is requesting the approval be extended to March 10, 2021. Commissioner James moved to continue the matter to March 10, 2021, the motion was seconded by Commissioner Freeman, and it carried unanimously. • 4) APPROVE BID #B2100059, UPS PREVENTATIVE MAINTENANCE AND REPAIRS - FACILITIES DEPARTMENT: Ms. Connolly stated the Facilities Department is requesting the approval be extended to March 10, 2021. Commissioner Freeman moved to continue the matter to March 10, 2021, the motion was seconded by Commissioner Buck, and it carried unanimously. • 5) PRESENT BID #B2100050, ENFORCEMENT SERVICES (MOWING AND/OR SPRAYING) - DEPARTMENT OF PUBLIC WORKS: Ms. Connolly stated staff received ten (10) bids and will make a recommendation on March 17, 2021. • NEW BUSINESS: 1) CONSIDER CONTRACT ID #4462 AGREEMENT FOR PROFESSIONAL SERVICES FOR CORONER BUILDING ACCESS CONTROL AND AUTHORIZE CHAIR TO SIGN - LONG BUILDING TECHNOLOGIES, INC.: Toby Taylor, Director of Facilities, stated the agreement is for upgraded Control access doors to be installed in the new Coroner's Building, and to accomplish this task, he noted the total cost is $32,530.00. Commissioner Freeman moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner James and it carried unanimously. • 2) CONSIDER CONTRACT ID #4452 AGREEMENT FOR PROFESSIONAL SERVICES FOR HOME -BASED INTERVENTION AND CASE CONSULTATION AND AUTHORIZE CHAIR TO SIGN - AMANDA HARTSHORN: Jamie Ulrich, Director of the Department of Human Services, stated the agreement is for on -site nursing consultation, case management, and home -based services provided by Amanda Hartshorn. Commissioner James moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Buck, the motion carried unanimously. Commissioner Freeman moved to approve said agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner Buck, carried unanimously. 4) CONSIDER CONTRACT ID #4454 INDIVIDUAL PROVIDER CONTRACT FOR PURCHASE OF FOSTER CARE SERVICES IN A FOSTER CARE HOME AND AUTHORIZE CHAIR TO SIGN - SONIA CHAVEZ: Ms. Ulrich stated the contract is for a new provisional kinship home in Longmont, Colorado. Commissioner James moved to approve said contract and authorize the Chair to sign. Commissioner Freeman moved to approve said contract and authorize the Chair to sign. Minutes, Wednesday, March 3, 2021 Page 6 2021-0614 BC0016 • 29) CONSIDER CONTRACT ID #4509 COOPERATIVE AGREEMENT FOR ADULT PROTECTIVE SERVICES AND AUTHORIZE CHAIR TO SIGN - 19TH JUDICIAL DISTRICT ATTORNEY: The motion to approve said agreement and authorize the Chair to sign was made by Commissioner Buck, seconded by Commissioner James, and it carried unanimously. • 30) CONSIDER CONTRACT ID #4503 TRANSPORTATION SAFETY GRANT APPLICATION AND AUTHORIZE CHAIR TO SIGN AND ELECTRONIC SUBMITTAL - E-470 PUBLIC HIGHWAY AUTHORITY TRANSPORTATION SAFETY FOUNDATION: Ms. Ulrich stated the Weld County Youth Conservation Corps (WCYCC) is requesting to apply for a $2,500.00 grant through the E-470 Public Highway Transportation Safety Foundation to provide relevant and comprehensive defensive driver training and First Aid/CPR/AED training to crew leaders and members of the WCYCC. Commissioner Buck moved to approve said submittal of the online application and authorize the Employment Services of Weld County to sign and electronically submit. The motion was seconded by Commissioner James and it carried unanimously. • 31) CONSIDER CONTRACT ID #4504 AGREEMENT FOR RESPITE SERVICES AND AUTHORIZE CHAIR TO SIGN - JAMES AND REBECCA SMITH: Ms. Ulrich stated this agreement is for a new respite care provider in Greeley, Colorado. The motion to approve said agreement and authorize the Chair to sign was made by Commissioner James, seconded by Commissioner Freeman, and it carried unanimously. • PLANNING: 1) CONSIDER TWO -LOT RECORDED EXEMPTION, RECX20-0131 - CASEY AND CAREY HORN: Chris Gathman, Department of Planning Services, described the property location, reviewed the property division case history, and explained the Bull Canal was not shown as a deeded in -fee ditch; however, following a survey, it was determined that a portion of the lot was not owned by the applicant, in which the remaining acreage for Lot A does not meet the 1.0 -acre net requirement. He noted staff is recommending denial, but clarified the lot size is the only reason for concern. Casey and Carey Horn, applicants, stated their daughter currently resides on the property that was purchased in 2009, and mentioned their family has participated in 4-H over the years, and would like to build their home on the remainder of the property. In response to Commissioner Freeman, Mr. Gathman confirmed the only reason for the size limitation is related to the classification of the in -fee versus simple ditch. The applicant agreed to abide by the Conditions of Approval, as presented. Commissioner Buck moved to approve said Recorded Exemption. The motion was seconded by Commissioner Saine and it carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. We are thus, sending the following Regional Route System Proposals. We should have had a Highway 34 regional route system by now. Around 2010, there existed a 34 -Express Route that lasted for about 2 years, and should have lasted at least 3 years (since the planning phases called for a 3 -year trial run). From what I have been told over the years, a new route takes takes 3 years to see if it will succeed. The 34 -Express did not get a fan- chance to determme whether or not it would work. The reasons it didn't work are as follows: 1.) The 34 -Express Route was not optimally planned well. It didn't have good connectivity with other routes. The 34 -Express stop at the Loveland Chamber of Commerce (East side of Loveland) connected on only one Loveland bus route. It needed to connect into all of the Loveland bus routes at their Orchard Square Transfer Center. On the other end of the 34 - Express (in Greeley), the route could begin at the Downtown Transfer Center mstead of the Greeley Mall. 2.) The 34 -Express Route was not optimally marketed/advertised well. If it was better advertised, it would have a better chance of succeeding. Corresponding with the establishment and the effectiveness of successful advertising, the efficiency and the reliability of the bus system must exist. 3.) 'Having a Regional Transportation Authority (R.T.A.) would also be helpful (it did not exist at the time and still is yet to be formed). 'According to my understanding, the M.P.O. and the state of Colorado were paying for the 34 -Express. 3 days before the 34 -Express was stopped, a new route began froth Fort Collins to Longmont (the FLEX route). That route was/is successful (Yea!). The FLEX route is so successful it has been in operation for about 10 years, and approximately 2 years ago extended a route to Boulder at certain times. Around 2010, entities including'the North Front Range Metropolitan Planning Organization (N.F.R.P.L.O.) tried to save the 34 -Express route system, but failed. If the 34- Express/Regional route were running today, not only would it go back and forth between Greeley and Loveland, but 'also would connect into FLEX, Bustang, Loveland and Greeley/Evans bus systems. In the past 5 years the state of Colorado became involved with transit (bus) systems more than in the past. At least 3 or 4 more routes have been successful. A new route from downtown Denver to Craig has been added just this year. What happened to Greeley/Evans and Weld County? If we had a 34 -Regional route today it would succeed if the connectivity of routes were well planned (as mentioned above, in #1.). It is puzzling why for the past 20 years, the west side of I-25 has been more progressive with a better transit/transportation system (at least in the terms of mobility and accessibility) than the East side of I-25. The Greeley/Evans area (along with the communities of Windsor, Johnstown, etc.) have ballooned in population, so why haven't the services kept up? In following this trend, we should have a 34 -Regional route and an 85 -Regional route (to help certain rural areas along Highway 85) in operation. Likewise, we believe that since Windsor, Johnstown, Milliken have grown significantly, there should be within the next year or two, a route from Windsor to Johnstown and Milliken via. Highway 257. There is a Park -and -Ride area at the intersection of Highways 34 and 257. There is a saying that If you build it, they will come," and that is what happens. So, I am going to take that principal and say, "If you build and have an "Effective," "Efficient," "Reliable" bus system, the people/passengers will come. 'Also, just like if one starts a business, if you have a "good product," "good service," "reasonable/affordable prices," you will have the customers/clients and, thus a better chance of success. The funding must be there!?! There are a lot of opportunities for funding out there for transit/bus, and transportation in general. Funding isn't the problem. It's the priorities/needs of the government placed before the primities/needs of the people. 'Having a good bus system is like oil to a car. It helps things run better and smoother. If the people have a good bus system, there exists an opportunity to improve their "quality of life." I'll leave you with these thoughts: "The lifeblood of a community is transit," and, "The lifeblood of economics is transportation/transit." We believe it would be an investment and profitable to all communities. Remember, the population is ballooning. How are the transit needs of the communities going to be met? Here's an afterthought: 'Let's not forget the Hill -N -Park and St. Michael's areas. These points illustrate why we think the proposals given to you are very important and need to be implemented.
