Tuesday, January 19, 2021
A regular meeting of the Weld County Planning Commission was held in the Weld County Administration
Building, Hearing Room, 1150 O Street, Greeley, Colorado. This meeting was called to order by Chair,
Elijah Hatch, at 12:30 pm.
Roll Call.
Present: Butch White, Dwaine Barclay, Elijah Hatch, Gene Stille, Lonnie Ford, Sam Gluck, Skip Holland,
Tom Cope, Troy Mellon.
Also Present: Chris Gathman and Michael Hall, Department of Planning Services; Lauren Light,
Department of Health; Melissa King, and Zack Roberson, Department of Public Works; Bob Choate, County
Attorney, and Kris Ranslem, Secretary.
Motion: Approve the December 15, 2020 Weld County Planning Commission minutes, Moved by Tom
Cope, Seconded by Butch White. Motion passed, with Gene Stille abstaining as he was absent at the
last hearing.

with a neighboring property owner in regard to the installation of screening.

Michael Hall, Planning Services, presented Case COZ20-0008, reading the recommendation and
comments into the record. Mr. Hall said that this parcel currently consists of Agricultural zoning and a small
portion of C-3 (Business Commercial) zoning. This application seeks to rezone the property all to the I-3
(Heavy Industrial) zone district. He added that the split zoning appears to stem from a lack of detail and
proper surveying when this portion of the county located in northeast Greeley was rezoned in 1962. This
parcel was historically the Union Pacific Railroad right-of-way and was conveyed from Union Pacific to
Anderson Properties in 2005.
Mr. Hall stated that this property and railroad spur were permitted as an industrial use in the agricultural
zone district for a rail car loading area for recyclable materials for the offsite Anderson Salvage yard, under
USR-1501 in 2006. This USR did not accurately reflect the property boundary and did not mention that the
portion of this lot was zoned C-3. Therefore, following discussions with the applicant in February 2020, the
Department of Planning Services and Weld County Attorney's office deemed that a change of zone was
necessary to accommodate new proposed modifications to the existing rail loading facility.
Mr. Hall noted that no correspondence or phone calls were received from the surrounding property owners.
The Department of Planning Services recommends approval of this application with the attached conditions
of approval and notes on the plat.
Melissa King, Public Works, reported on the road classifications and access to the site. Ms. King requested
to delete Condition of Approval 1.B as it is not applicable at this time.
Lauren Light, Environmental Health, reviewed the public water and sanitary sewer requirements.
Dean Anderson, Anderson Sales and Salvage, 1490 East 8th Street, said that they own 125 feet on each
side of the track. When they initially received their USR permit they stayed on the south side of the track
only. He added that their current application is to grow on the north side of the track to pre -stage material
there. Mr. Anderson said that there won't be any additional truck traffic and added that all of the shredded
and cut steel is shipped on rail from this site. By allowing them to expand on the north side, they can pre -
stage more material.
Commissioner Cope asked if the steel is coming from the site the applicant owns on East 8th Street. Mr.
Anderson replied yes.

The Chair referred to the request from Public Works Staff regarding Condition of Approval 1.B.
Motion: Delete Condition of Approval 1.B, as recommended by Staff, Moved by Gene Stille, Seconded
by Tom Cope. Motion carried unanimously.

The Chair asked the applicant if they have read through the amended Conditions of Approval and if they
are in agreement with those. Daniel Alonzo, 4051 E 115th Place, Thornton, Colorado said that they have
worked with staff and have no concerns and replied that they are in agreement.
Motion: Forward Case COZ20-0008 to the Board of County Commissioners along with the Conditions of
Approval and nots on the plat with the Planning Commission's recommendation of approval, Moved by
Tom Cope, Seconded by Sam Gluck.

AND GAS PROCESSING FACILITIES AND RELATED EQUIPMENT (PUMP
STATION) OUTSIDE OF SUBDIVISIONS AND TOWNSITES IN THE A
(AGRICULTURAL) ZONE DISTRICT.
LEGAL DESCRIPTION: LOT A RECX20-0068, BEING PART OF SECTION 13, T7N, R56W OF THE 6TH
P.M., WELD COUNTY, COLORADO
LOCATION: SOUTH OF AND ADJACENT TO CR 82; APPROXIMATELY 0.41 MILES WEST
OF CR 157.
Michael Hall, Planning Services, presented Case USR20-0031, reading the recommendation and
comments into the record. Mr. Hall stated that this pump station will support the transportation of natural
gas liquids in the Elk Creek Pipeline (ECP) which traverses under the subject property. The ECP is a 900 -
mile 20 -inch diameter NGL transportation pipeline and construction was completed in December of 2009.
This proposed pump station is one of ten proposed similar facilities along this 900 -mile pipeline.
Mr. Hall stated that in partnership with Morgan County Rural Electric Association an on -site substation will
also be constructed to support the power demand of the facility and is designed to receive a proposed 69kV
transmission line. Because the substation has an incoming power of 69kV or less, the substation is deemed
an accessory use to the pump station and not separate permitting is required for the substation.
Mr. Hall noted that no correspondence or phone calls were received from surrounding property owners.
The Department of Planning Services recommends approval of this application with the attached conditions
of approval and development standards.
Melissa King, Public Works, reported on the existing traffic, access to the site and drainage conditions for
the site. A second access point onto County Road 82 has been proposed for installation, decommissioning
and routine maintenance of the pump station, therefore the applicant shall obtain a separate access permit
for this location. Because Public Works is requesting a separate access permit, Ms. King requested to add
a new Condition of Approval 4.C to read "The approved access shall be permitted prior to onsite
construction."
Ben Frissell, Environmental Health, reviewed the public water and sanitary sewer requirements, on -site
dust control, and the Waste Handling Plan.
Cam Morse, Environmental Resources Management, 555 17th Street, Denver, Colorado and Jake
Rosenberg via phone. Mr. Morse stated that the pump station will support the transportation of natural gas
liquids in the Elk Creek Pipeline which traverses under the subject property. This pipeline originates at the
ONEOK terminal in Montana and travels through Wyoming and Colorado and terminates in the ONEOK
facility in Kansas.
The Chair asked if there was anyone in the audience who wished to speak for or against this application.

The Chair asked Staff if there are any changes to the Resolution. Ms. King stated that Public Works is
requesting the addition of Condition of Approval 4.C to read "The approved access shall be permitted prior
to onsite construction".
Motion: Add Condition of Approval 4.C as recommended by Staff, Moved by Tom Cope, Seconded by
Troy Mellon. Motion carried unanimously.
The Chair asked the applicant if they have read through the Development Standards and Conditions of
Approval and if they are in agreement with those. The applicant replied that they are in agreement.
Motion: Forward Case USR20-0031 to the Board of County Commissioners along with the Conditions of
Approval and Development Standards with the Planning Commission's recommendation of approval,
Moved by Butch White, Seconded by Lonnie Ford.
