APPLICATION The Colorado Department of Transportation, and Weld County hereinafter referred to as "APPLICANT", hereby submits this application to the Colorado Public Utilities Commission, hereinafter referred to as "PUC", for an order authorizing the removal of existing active warning signals and gates, and crossing surface, and removal of roadway approaches to close the existing County Road 44 crossing of Union Pacific Railroad, hereinafter referred to as "UPRR" or "Railroad" tracks for which CDOT has appropriated Federal Section 130 Funds in Weld County, State of Colorado. This application is for closure of County Road 44 after a new grade separated overpass crossing of the UPRR tracks is completed and open to the public, titled the Peckham Interchange, to be constructed in the vicinity of County Road 44, and for which CDOT will make application to the PUC under separate filing. Following are APPLICANTs responses to the specific requirements concerning highway - rail grade crossing applications, as prescribed in 4 Code of Colorado Regulations (CCR) 723-7- 7002(b)(I-IX), 4 CCR 723-7204(a)(I), and 4 CCR 723-7-7204(a)(II) - (XVIII) and 4 CCR 723-7- 7205 as required, including without limitation, acknowledgement that by signing the application, APPLICANT understands that the filing of the application does not by itself constitute approval of the application for the requested action. Consistent with Rule 7002(b), 4 CCR 723-7, the information below is provided within this application, or in an appropriately identified attachment to this application as indicated. Rule 7204(a)(I) - All crossing applications shall contain the following information: (A) The contact person name, mailing address and e-mail address to whom the Commission notice is to be sent: (i) If the application is filed by a road authority, provide the above information for each railroad, railroad corporation, rail fixed guideway, or transit agency that owns the tracks affected by an application. For FRA reported accident reports for this crossing, see attached Exhibit B. (E) A statement of the date that the required crossing safety diagnostic occurred, or a copy of written correspondence from Commission staff that a crossing safety diagnostic was not required. 4 The required crossing safety diagnostic occurred on September 7, 2017. (F) A statement of: (i) The existing number and character of trains (e.g., through movements, switching movements) passing through the crossing each day if the National Inventory Form has not been updated within three years from the date of the filing of the application, or the existing number, character, and timetable speed of trains as shown on the National Inventory Form if the form has been updated within three years from the date of the filing of the application; Total Day Thru Trains: 5 Total Night Thru Trains: 5 Total Switching Trains: 0 (ii) The five-year projection of increases or decreases of the number and character of trains using the crossing; and No anticipated increases or decreases in the number or character of trains is known at this time. (iii) The maximum timetable speed of trains using the crossing. Maximum Timetable Speed: 60 MPH (G) A detailed statement as to the nature of and need for the construction, alteration, abolition, installation, or modification for which approval is sought. The history of the US 85 Corridor is lengthy, and involves Union Pacific Railroad Company, Weld County and CDOT. In 1923, UPRR entered into a 50 -year lease with Weld County for the Highway 85 right-of-way. In 1931, UPRR and Weld County entered into a new year-to-year lease of Highway 85 and terminated the prior 50 -year lease. In 1957, UPRR and CDOT entered into a 50 - year lease of the Highway 85 right-of-way allowing CDOT to have highway facilities within the right-of-way. That lease terminated December 31, 2006. Since the termination, and for the subsequent twelve years, both CDOT and UPRR have been negotiating the resolution of the matter which culminated in a Purchase and Sale Agreement. UPRR, Weld County and CDOT have worked together strategically, to enable the closure of crossings that would allow trains to park or pass within railroad sidings that presently have at - grade highway- rail crossings, thus improving rail operations, and removing random crossing occupation by trains within the county to provide better vehicular circulation and more reliable access routes for emergency services. CDOT entered into the Purchase and Sale Agreement with UPRR in order for CDOT to obtain full fee ownership for those portions of the highway located within railroad right-of-way, while still providing UPRR rail capacity as a result of the purchase to ensure the functional integrity of both the CDOT and UPRR transportation systems and to improve the safety of the corridor by reducing potential vehicle/train conflicts. To mitigate capacity impairment from the land sale, the Purchase and Sale Agreement includes the closure of several roads intersecting the railroad and US 85, most of which are under the jurisdiction of Weld County. CDOT does not have authority to close county roads and has therefore coordinated with Weld County to satisfy this portion of the agreement. To this end, Weld County and CDOT hosted public meetings regarding the closures in Fort Lupton and Eaton on January 22 and 23, 2018, respectively. The Purchase and Sale Agreement identified the closure of twelve county roads. Weld County has been working with CDOT and UPRR on the locations for these road closures that will work best for meeting the goals of all the agencies involved. The agencies' goals are as follows: • CDOT Goal: Obtain full fee ownership from UPRR for the US 85 ROW. • UPRR Goal: Mitigate capacity impairments and close the Purchase and Sale Agreement. • Weld County Goal: Ensure the long-term stability of the US 85 corridor through partnering with CDOT and UPRR that improves the safety of the highway/rail corridor, improves the operational efficiencies to enhance economic development opportunities, and reduces conflicts for communities, while also ensuring reliable emergency response time. Consequences of not closing this crossing include the following: 1) First responders would continue to be required to assess whether this crossing is available or occupied by a train when determining their route for an emergency call. 2) The terms of the Purchase and Sale Agreement between CDOT and UPRR, after 12 years of valuation, assessment and negotiation, would need to be revised, requiring substantial additional time. 3) If CDOT and UPRR could not reach a new agreement, CDOT would need to re- evaluate the option of relocating approximately 37 miles of portions of US 85 off of UPRR right-of- way, which would necessitate the purchase of private lands, public lands (through affected communities) and could not guarantee reconnection of county roads no longer in the vicinity of the new US 85 alignment. 4) The inclusion of alternative county roads into the Purchase and Sale Agreement requires, but may not receive, approval from the Weld County Board of County Commissioners. 5) Weld County residents would not realize the benefit of having adjacent crossings clear of train occupation more consistently with the closure of CR 44. CDOT has appropriated Federal Section 130 Funds for removal of the existing active warning signals and gates, and crossing surface, and removal of the roadway approaches in accordance with the diagnostic team recommendations. (H) A statement of the scope of the project, including without limitation: (i) The highway design, pathway design, crossing warning devices, and necessary traffic signal interconnection and preemption; The project includes removal of active warning signals and gates, and crossing surface, removal of existing roadway approaches, and installation of permanent barricade east and west of the crossing. Signing along the county road and along US 85 that will no longer be valid will be removed. (ii) The detailed itemized estimated cost of the proposed construction, alteration, abolition, or highway -rail or pathway crossing warning device installation or modification; The detailed itemized estimated cost of the proposed work items is included in the attached Exhibit C. (iii) How the applicant proposes to provide for the cost, explaining the proposed apportionment between or among the parties in interest if applicable; and The cost for crossing removal will be funded through appropriation of Federal Section 130 Funds. (iv) If the funds necessary for the project are currently available and encumbered. The funds necessary for the project are currently available and encumbered. (I) A statement of the estimated month and year for: (i) The start date for the construction, alteration, abolition, or crossing warning device installation or modification; The estimated start date of construction is: January 1, 2023. Note this crossing will be closed, and access replaced with the proposed Peckham Interchange overpass crossing over UPRR tracks. Application to the Commission for the Peckham Interchange is occurring via separate filing. (ii) The completion date for the construction, alteration, abolition, or crossing warning device installation or modification; and The estimated completion date of construction is: July 1, 2023 (iii) The date for commencement of operations through the crossing for new crossings.
