HomeMy WebLinkAbout20211364.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MONDAY, MAY 24, 2021 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, May 24, 2021, at the hour of 9:03 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Steve Moreno, Chair Commissioner Scott K. James, Pro -Tern Commissioner Perry L. Buck Commissioner Mike Freeman Commissioner Lori Saine Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Chloe A. Rempel Controller, Barbara Connolly MINUTES: Commissioner James moved to approve the Minutes of the Board of County Commissioners meeting of May 19, 2021, as printed. Commissioner Saine seconded the motion, and it carried unanimously. • CERTIFICATION OF HEARINGS: Commissioner Freeman moved to approve the Certification of Hearings conducted on May 19, 2021, as follows: 1) COZ21-0002 — Gerrard Investments, LLC. Commissioner James seconded the motion, which carried unanimously. • PUBLIC INPUT: No public input was given. El AMENDMENTS TO AGENDA: There were no amendments to the agenda. • CONSENT AGENDA: Commissioner James moved to approve the Consent Agenda, as printed. Commissioner Freeman seconded the motion, and it carried unanimously. TA COMMISSIONER COORDINATOR REPORTS: Commissioner Buck stated it is an honor to serve the Department of Human Services and explained the department has on -site job fairs that will resume on June 7, 2021, the Business Services Unit is partnering with Larimer County to discuss generational diversity benefits of the age diverse workforce, 80 Weld Works for Youth participants completed orientation and will begin their temporary work placement on June 1, 2021, and in regards to emergency rental assistance, 1.5 million dollars in funding has been approved, 104 requests have been processed, and 662 households have been evaluated. She also offered the department will be receiving a p7iO&IDI Minutes, Monday, May 24, 2021 Page 1 2021-1364 BC0016 distinguished performance award from the Colorado Department of Human Services for being timely, safe, and accurate in their work, as well as for meeting the needs of individuals and families in the community and for having higher completion rates for applications and meeting time limits for safety assessments. Commissioner Buck also said she enjoyed the annual Fort Lupton Chamber event at The Wild Animal Sanctuary. Commissioner Saine discussed ongoing work at the capital to assist with bill drafting. Likewise, Commissioner James stated he will be testifying on Senate Bill 260 later this afternoon. Commissioner Freeman had nothing to report. Chair Moreno discussed the Greeley Downtown Development Authority (DDA) Board Meeting and expressed businesses are slowly starting to recover and the State is now providing an incentive to the workforce to gain employment. • WARRANTS: 1) GENERAL WARRANTS - MAY 21, 2021: Commissioner Freeman moved to approve the General Warrants, as printed. Commissioner Buck seconded the motion, and it carried unanimously. • 2) GREELEY-WELD COUNTY AIRPORT AUTHORITY WARRANTS - MAY 21, 2021: Commissioner James moved to approve the Greeley -Weld County Airport Authority Warrants, as printed, and Commissioner Freeman seconded the motion. Upon a roll call vote, the motion passed four to one, with Commissioner Saine being opposed. BIDS: 1) APPROVE BID #B2100095, GUARDRAIL, BRIDGE RAIL, AND CABLE REPAIR SERVICES WITH OPTIONS FOR 2022 AND 2023 - DEPARTMENT OF PUBLIC WORKS: Rob Turf, Purchasing Department, explained one (1) bid was received that meets all specifications and staff recommends awarding said bid to Ideal Fencing Corporation, LLC, for a total amount of $127,076.00. Commissioner Buck moved to approve said bid. The motion was seconded by Commissioner James and it carried unanimously. (Clerk's Note: the total awarded amount of Bid #82100095 is $127,075.00.) • NEW BUSINESS: 1) CONSIDER CONTRACT ID #4769 FOR EQUIFAX VERIFICATION SERVICES FOR USE OF THE WORK NUMBER AND AUTHORIZE CHAIR TO SIGN AND SUBMIT ELECTRONICALLY: Jamie Ulrich, Director of the Department of Human Services, stated the Colorado Department of Human Services has issued a new contract for access to the Equifax Verification Services (EVS) database to verify employment and income data resulting in more efficient eligibility determination, fraud prevention, and work activity participation. Commissioner Buck moved to approve said contract and authorize the Chair to sign and submit electronically. The motion was seconded by Commissioner James and it carried unanimously. • 2) CONSIDER CONTRACT ID #4766 MEMORANDUM OF UNDERSTANDING CONCERNING USE OF SOUTHWEST SERVICE CENTER POND AND AUTHORIZE CHAIR TO SIGN - NORTHERN COLORADO MODEL BOAT CLUB, NAMBA DISTRICT 20: Toby Taylor, Director of the Facilities Department, explained the Northern Colorado Model Boat Club, NAMBA District 20, has historically used the pond at the Southwest Service Center for model boat activity each summer and the memorandum of understanding authorizes use of the pond from 7:00 a.m. to 5:30 p.m. on the 2021 dates listed in the Resolution. Commissioner Freeman moved to approve said memorandum of understanding and authorize the Chair to sign. Seconded by Commissioner James, the motion carried unanimously. Ell 3) CONSIDER CONTRACT ID #4775 NON-EXCLUSIVE LICENSE AGREEMENT FOR WATER WELL WITHIN COUNTY ROAD 110 RIGHT-OF-WAY AND AUTHORIZE CHAIR TO SIGN — PAWNEE RANCH, LLC: Dawn Anderson, Department of Public Works, explained Pawnee Ranch, LLC, owns a Minutes, Monday, May 24, 2021 Page 2 2021-1364 BC0016 water well issued in 2011 by the Colorado Division of Water Resources (DWR) and the well is located within the non -maintained public road right-of-way of County Road 110. She said Pawnee Ranch, LLC, requested the County enter into the agreement to allow the well to remain in place and to provide the owner the ability to access, operate, repair, and otherwise use the well in the manner authorized by the DWR permit. Commissioner James moved to approve said agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner Buck, carried unanimously. 4) CONSIDER TEMPORARY CLOSURE OF CR 14 BETWEEN CRS 65 AND 67: Amy Mutchie, Department of Public Works, requested the temporary closure of County Road 14 for approximately four (4) days, effective June 8, 2021, to replace an irrigation culvert. She explained water will used for dust control along the detour route. Commissioner Freeman moved to approve said temporary road closure. gThe motion was seconded by Commissioner Buck and it carried unanimously. B 5) CONSIDER TEMPORARY CLOSURE OF CR 51 BETWEEN CRS 76 AND 80: Ms. Mutchie stated the temporary closure of County Road 51 will begin on June 7, 2021, for the duration of approximately six (6) weeks, to make improvements and re -deck Bridge 51/78A. She explained message boards will notify the public and magnesium chloride will be used for dust control along the gravel road detour route. Commissioner James moved to approve said temporary road closure. The motion was seconded by Commissioner Saine and it carried unanimously. 6) CONSIDER CANCELLATION OF BOARD OF COUNTY COMMISSIONERS MEETING SCHEDULED FOR WEDNESDAY, JUNE 9, 2021: Commissioner Buck moved to approve said Resolution and the motion was seconded by Commissioner Freeman, who explained the Board meeting needs to be cancelled because the Board will be attending the Colorado Counties, Inc. (CCI), conference. Upon no further discussion, the motion carried unanimously. IE PLANNING: 1) FINAL READING OF CODE ORDINANCE #2020-20, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 23 ZONING, OF THE WELD COUNTY CODE (SOLAR) - (RESCHEDULED FROM 3/15/2020): Commissioner James moved to read Code Ordinance #2020-20 by title only. Seconded by Commissioner Freeman, the motion carried unanimously. Bruce Barker, County Attorney, read the title for the record. Tom Parko, Director of the Department of Planning Services, stated no changes were made between Second and Third Readings. He also stated the ordinance addresses solar energy facilities that either require a Zoning Permit or Use by Special Review Permit and a separate ordinance will be presented for the 1041 Solar Energy Facilities (SEF), with First Reading scheduled for June 14, 2021. No public testimony was offered concerning this matter. Commissioner James moved to approve Code Ordinance #2020-20 on Final Reading. The motion was seconded by Commissioner Saine. Each of the Commissioners, in turn, thanked staff for their hard work and dedication in accomplishing completion of this ordinance. There being no further discussion, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Code Ordinance #2020-20 was approved on Final Reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
