RE: APPROVE PARTIAL VACATION OF TWO -LOT RECORDED EXEMPTION, RE -1955,
FOR REMOVAL OF LOT B - BECKER RANCH, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Department of Planning Services approved Two -Lot Recorded
Exemption, RE -1955, recorded February 10, 1997, at Reception No. 2532891, located on the
following described real estate, to wit:
Part of the S1/2 of Section 5, Township 3 North, Range 64
West of the 6th P.M., Weld County, Colorado
WHEREAS, the Board has received a request from the current property owner,
Becker Ranch, LLC, 25517 County Road 36, LaSalle, Colorado 80645, to vacate Lot B of
Recorded Exemption, RE -1955, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of the
Department of Planning Services staff and all of the exhibits and evidence presented in this matter
and, having been fully informed, deems it advisable to approve said partial vacation, and makes
the following findings:
1. No property resulting from the vacation will be left without access to a public road
right-of-way; and
2. No property resulting from the vacation will continue to use any access across any
other lots within the exemption plat; and
3. No easements are being included in this vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of Becker Ranch, LLC, for Partial Vacation of Two -Lot
Recorded Exemption, RE -1955, for removal of Lot B, be, and hereby is, approved, subject to the
following condition(s):
1. As described in Section 24-11-50(h) and (i), the applicant shall submit an exemption
vacation plat and deed to the Department of Planning Services within ninety (90) days.

R64W of the 6th P.M., Weld County, Colorado
North of and adjacent to CR 36 and approximately 2,000 feet west of CR 53
+/- 77 acres PARCEL NUMBER: 1215-05-00-0-006
A (Agricultural)
NARRATIVE: On September 23, 2021 the Department of Planning Services received the attached
vacation request application signed by Richard Lee Becker, Manager for Becker
Ranch LLC (the owner of Lot B of RE -1955) and William H Hughes as the
applicant/authorized agent on behalf of Becker Ranch, LLC. The letter is requesting
a partial vacation of the plat of Recorded Exemption RE -1955, recorded February 10,
1997, reception #2532891 to vacate Lot B, being the largest lot. No easements were
created by the plat of RECX19-0093 and therefore no other interests are affected by
the request. The resulting parcel will be larger than thirty-five (35) acres.
Lot A of RE -1955 is owned by Richard Lee Becker (Manager for Becker Ranch, LLC)
and Lillian Becker. This lot has access onto County Road 36. Notice to the owners of
Lot A was sent at least ten (10) days prior to the hearing by the Clerk to the Board.
A draft vacation plat is also attached and requires minor revisions prior to recording.
A metes and bounds description for the lot to be vacated has been included on the
draft vacation plat.
The Department of Planning Services staff has reviewed this request and recommends that this
request be approved.

I represent Becker Ranch, LLC, a Colorado limited liability company, with its principal place of
business located at 25517 WCR 36, LaSalle, Colorado 80645.
I am enclosing a completed application form; an Authorization Form signed by Richard Becker,
Manager of Becker Ranch, LLC, authorizing me to represent the company regarding these matters;
a copy of the Articles of Organization for Becker Ranch, LLC filed with the Colorado Secretary
of State on April 18, 2003; a copy of the Certificate of Fact of Good Standing of Becker Ranch,
LLC issued by the Colorado Secretary of State's office on September 16, 2021; and a copy of the
deed recorded on June 10, 2003 at Reception No. 3071375, Weld County records, by which Becker
Ranch, LLC acquired the property.
I am also enclosing a copy of the proposed Vacation Plat of Lot B, Recorded Exemption No. 1215-
05-3-RE1955, and Land Survey Plat prepared by Robert D. Thomas, Land Surveyor.
This plat vacation is being requested, as recently, the members of Becker Ranch, LLC entered into
an agreement to dissolve Becker Ranch, LLC, and to divide the company's real property,
improvements, and other assets between family members and their entities. As part of their
settlement agreement, the members have agreed to divide Parcel No. 121505000006, a 76.250
acreage, and other real property owned by the members of the company. As part of their
settlement, the members have agreed to a complete vacation of Lot B Recorded Exemption No.
1215-05-3-RE1955 which has a legal description of Part of the South 1/2 of Section 5, Township 3,
Range 64 West of the 6th P.M.

may be affected by this plat vacation.
