HomeMy WebLinkAbout20212429.tiffRESOLUTION RE: APPROVE SPECIAL EVENTS PERMIT AND AUTHORIZE CHAIR TO SIGN - BERTHOUD LOCAL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Berthoud Local presented to the Board of County Commissioners of Weld County, Colorado, an application for a Special Events Permit for the sale of malt, vinous and spirituous liquors for consumption by the drink on the premises only, subject to the rules and regulations found in Article 5, Title 44, C.R.S., and WHEREAS, said applicant has paid the sum of ONE HUNDRED DOLLARS ($100.00) to Weld County, Colorado, pursuant to the laws providing therefore in payment for a Special Events Permit, subject to the rules and regulations found in Article 5, Title 44, C.R.S., for an event scheduled for one day only on August 28, 2021, from 4:00 p.m. to 10:00 p.m., outside the corporate limits of any town or city in the County of Weld at the location described as follows: 19417 County Road 3, Berthoud, Colorado 80513; being further described as Lot A of Recorded Exemption, RE -1341; being part of the NE1/4 SE1/4 of Section 30, Township 4 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, said applicant has also paid the sum of TWENTY-FIVE DOLLARS ($25.00) to the Colorado Department of Revenue and has exhibited a State Special Events Permit Application for the sale of malt, vinous and spirituous liquors for consumption by the drink on the premises only, subject to the rules and regulations found in Article 5, Title 44, C.R.S. NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Weld County, Colorado, having examined said application and the other qualifications of the applicant, does hereby grant Special Events Permit Number 2021-14 to said applicant to sell malt, vinous and spirituous liquors for consumption by the drink on the premises only, at retail at said location; and the Board does hereby authorize and direct the issuance of said permit by the Chair of the Board of County Commissioners, attested to by the Clerk to the Board of Weld County, Colorado, which permit shall be effective on August 28, 2021, from 4:00 p.m. to 10:00 p.m., providing that said permitee operates in strict conformity to all of the laws of the State of Colorado and the rules and regulations relating thereto, per Article 5, Title 44, C.R.S., heretofore passed by the Board of County Commissioners of Weld County, Colorado, and any violations thereof shall be cause for revocation of the permit. We sponsor the Berthoud Local Farmers Market held every Saturday in Fickel Park late June through September. Berthoud Local also sponsors a Community Garden located in Pioneer Park in Berthoud. The Community Garden offers local area residents a place to experience growing their own food. A portion of the produce from this garden is donated to the House of Neighborly Services providing an additional source of healthy food to local residents who meet their guidelines for assistance. Berthoud Local has offered a variety of educational events on topics ranging from planting a garden, raising backyard chickens and grafting fruit trees. The term of this Agreement shall be for the duration of the project, event, or until such time as the Customer no longer has any need for equipment of the type supplied by GALLEGOS SANITATION (Company) at this service address or, if so indicated, for a specified period on the main side of this document PAYMENT TERMS and CHARGES. Payment is due in full prior to delivery of the equipment for all events in which service is to be furnished for a period of 10 days or less. All other payment terms require credit authorization prior to delivery. With credit approval, On Call services must be paid within 30 days of the invoice date or as specified in the Special Terms Section of this agreement . Returned checks will incur a $15.00 handling charge plus any fees added by the collection agency, as allowed by law. If payment is not made by the due date, Company may impose and Customer agrees to pay a late fee for ag past due payments not to exceed the maximum rate allowed by applicable laws. A $ 3.00 rebilling fee may be assessed per invoice or statement copy. Customer shall be liable for all taxes, fees or other charges applicable to this Agreement or Customer's use of the equipment. Customer will be responsible for payment for any additional waste volume collected including other accumulated items not placed within the containers provided. Customer stag pay charges for excess disposal and/or any fines if containers are improperly loaded, overloaded or overweight (20,000 lb legal limit). Roll -off container rates include up to seven (7) tons of standard waste. Volumes in EXCESS of this limit shall be billed at $18/ton (excluding recydables). Rental charges shall apply for equipment not serviced a minimum of once per calendar month, at the rate of $35 for small containers and $130.00 for rotbff containers, or as indicated in the Service Specifications and Charges section on the reverse side. No refunds shall be issued for partially completed service periods once the period has begun, for "monthly" billed services. CUSTOMER'S RESPONSIBILITIES. Customer shall inspect equipment and finds it to be in good condition and suitable for Customer's needs or will contact Company within 24 hours from delivery. Customer will permit the equipment to be used only for the proper sanitation purposes for which it was intended, and will make no alteration or attachments to the equipment without Company 's authorization. Customer shall warrant that at no time will any hazardous waste including, but not limited to wet paints, asbestos, chemicals, oil, gasoline, or similar materials ever be disposed of in Company 's equipment. Should such occur, Customer accepts full responsibility for the dean -up, removal, and proper disposal and all associated costs of such materials. In addition, Customer agrees to defend and hold harmless the Company in any situation relating to this section, should it arise. Customer has identified the location for installation of the equipment and accepts all responsibility in connection with that choice of location. Customer will give Company free access to the equipment at all times over a suitable driving surface sufficient to bear the weight of Company 's equipment, and will make the equipment available for servicing or maintenance at ground level without hazard (including snow removal) to Company's agents, employees or equipment. Company shall not be responsible for damage to Customer's pavement or other driving surfaces resulting from the ivetght of Company's equipment. Customer agrees to only fill containers to level full capacity (excluding shingles, concrete, dirt, or similar dense materials) and shall be responsible for off loading overfilled or overweight containers or additional fees applied for these services. Customer shall provide Company with precise placement instructions, a map or onsite personnel at the time of placement to ensure accuracy. If such is not provided, Customer acknowledges responsibility for charges arising due to extended driver time on site or relocat e fees assessed for improperly placed equipment. Customer ensures equipment will be in the same spot as when delivered. Customer will notify Company immediately and discontinue use of the equipment if the equipment becomes unsafe for use or in need of repai r. Customer will not permit the equipment to become subject to any lien, charge or encumbrance. Customer acknowledges that staking of the equipment and other protective measure may not prevent damage to the equipment or other property. Customer accepts responsibility for the safe use of the equipment by Customer and those it authorizes to place waste therein. MAINTENANCE. Company will recharge and/or service the equipment in accordance with the terms of this Agreement. Company's obligations to maintain the equipment in good working order under ordinary use is conditioned upon Customer's compliance with the use obligations set forth in the Customer's Responsibility Section above. CUSTOMER'S INDEMNITY. Customer will indemnify the Company, its employees and agents against any claim, liability or cost arising from this Agreement or the use of the equipment, including property damage and personal injuries arising out of Customer's use of the equipment, except to the extent that such claims, liabilities or costs are due to Company's sole negligence. Customer will promptly reimburse Company for any damage to or loss of the equipment, up to and including replacement cost for the lost equipment or equipment damaged beyond repair. EXCLUSIVE RIGHT TO PROVIDE SERVICE. Customer agrees not to contract with, or permit, any person or entity other than the Company to provide the same or similar services at the location as herein contracted for the duration of the period the equipment is needed at this site unless Company has no way to fulfill Customer needs. Violation of this provision shall constitute breach of this Agreement. ENFORCEMENT. If Customer fails to make any payment or to perform any obligation due hereunder, Company may pursue all remedies available at law or in equity, including termination of this Agreement without notice, repossession of the equipment without legal process, and recovery of all sums due hereunder including business lost. Such remedies shall be cumulative. Customer shall pay Company's costs of collection and enforcement, including court costs and attorney's fees. MISCELLANEOUS. (A) Without the prior written consent of Company, Customer will not assign this Agreement or any rights or obligations hereunder and will not transfer possession or control of the equipment. (B) The provisions of this contract can be waived or modified in writing signed by both parties. Failure of Company to enforce any provisions shall not constitute a waiver of the provision. Acceptance of the returned equipment shall not waive any claims by Company against Customer; (C) Company shall not be liable for any failure to perform caused by weather, strikes, shortages of material or other causes beyond its control (acts of God or government); (D) The invalidity, unenforceability or waiver of any of the provisions shall not affect the remaining provisions. This is a legally binding contract, and GALLEGOS SANITATION agrees to provide and Customer agrees to accept the services and equipment at the charges and frequency of collection indicated on the reverse side, subject to the terms and conditions specified above. Additionally, the Colorado Liquor Enforcement Division will want to know what your plan is to prevent the spread of COVID-19 at your event.
