Members Present: Mike McRoberts, Amy Mutchie, Mark Alessi, Robert Fleck, Denise Beltran, and Shelly Bergstrom. Members Absent: Michael Wailes, Jared Rauch, Jerry Adams, Jeremy Young, and Lucas McConnell. Also Present: Michael Hall and Kris Ranslem, Department of Planning Services and Michelle Wall, Secretary. Present Via Telephone: Troy Bottomfield, Applicant CASE NUMBER: APPLICANT: PLANNER: REQUEST: LEGAL DESCRIPTION: LOCATION: RES21-0006 PERKINS FAMILY TRUST OF CASPER WYOMING AND GORDON BOTTOMFIELD MICHAEL HALL RESUBDIVISION TO SPLIT LOT 7 OF BLACK HOLLOW ACRES FIRST FILING INTO THREE (3) LOTS. LOT 7 1ST BLACK HOLLOW ACRES; PART OF SECTION 33, T8N, R67W OF THE 6TH P.M., WELD COUNTY, COLORADO. WEST OF AND ADJACENT TO CR 19; APPROXIMATELY 0.38 MILES NORTH OF CR 86. Michael Hall, Planning Services, stated that the applicants are proposing a Resubdivision to divide Lot 7 of Black Hollow Acres First Filing, which is approximately sixty (60) acres in size, into three (3) lots, each being approximately twenty (20) acres. All lots will have at least thirty (30) feet of frontage onto County Road 19. The three (3) lots currently exist as separate parcels, under different ownership, created by an illegal division of land in 1994. This Resubdivision will correct the illegal land division which resulted in the three (3) lots by formally platting the existing lots. This Resubdivision will also slightly adjust the existing lot lines, in order to comply with Weld County Subdivision Design Standards, specifically, that each lot have at least thirty (30) feet of frontage onto a maintained road. The proposed lots will be referred to as Lots 7A, 7B and 7C, to continue the ascending numerical and alphabetical assignment of lot designations for resubdivisions within Black Hollow Acres. For reference, there is one (1) existing home and associated outbuildings on the southeastern parcel, being proposed Lot 7A. The Black Hollow Acres First Filing plat, recorded September 25, 1970 at reception #1555177, platted twelve (12) lots and is zoned A (Agricultural). Most lots are approximately twenty (20) acres in size. There are no covenants or Homeowners' Association. The Resubdivision request is consistent with the functional size and use of the other lots within the Subdivision and does not change the overall design, concept or nature thereof. This Resubdivision does not address other lots in the Subdivision. Select easements are recommended to be added to internal lot lines of the new lots, to be consistent with the existing easement design of the Subdivision. Section 24-9-40.D of the Weld County Code states: "In the event a utility easement is affected, the Department of Planning Services shall schedule the Resubdivision request on the first available Utilities Coordinating Advisory Committee meeting before receiving County approval." The original Black Hollow Acres Subdivision plat included the dedication of interior lot line easements of twenty (20) feet in width, apportioned equally, being ten (10) feet on either side of a joint lot line. Planning staff recommends the following for this resubdivision: Consistent with the original plat proposed easements shall be created along the new internal lots lines between Lots 7A, 7B and 7C and shall adhere to the width requirements as described in Section 24-3-60.B.2 of the Weld County Code, which states: "Twenty (20) feet minimum drainage and utility easements are Cfpnini iie +ions 2021-3252 required along internal lot lines and shall be apportioned equally on abutting properties, unless otherwise justified by the Utilities Coordinating Advisory Committee for technical purposes." These easements will be for the benefit of utilities and drainage as supported by Section 24-3-60.D of the Weld County Code which states: "Easements shall be designed to provide efficient installation of utilities and drainage swales." Consistent with the Black Hollow Acres Subdivision plat, no easements along the front lot lines, adjacent to County Road 19, are requested to be dedicated. Therefore, staff does not recommend that Section 24-3-60.A be required, being the creation of easements adjacent to public road rights -of -way. Additionally, the existing thirty (30) foot wide Utility, Drainage and Roadway easement located along the western boundary of proposed Lots 7B and 7C, being the exterior western boundary of the subdivision, is not modified or removed by this Resubdivision. Therefore, staff does not recommend that Section 24-3-60.C be required, being the creation of easements along exterior lot lines. The Weld County Department of Planning Services recommends that this request be approved. Mr. McRoberts asked the applicant if they had any comments. Mr. Bottomfield said he did not. Mr. Hall stated that the draft resubdivision map does not yet reflect the easements as proposed but those three lots exist somewhat as is now with the exclusion of the flagpole extensions that had to be accommodated as part of this resubdivision so that all lots could have direct frontage onto County Road 19. He said it will get pretty tight in the corridor with easements since we will be adding lot lines that require ten (10) feet drainage and utility easements that will overlap with existing easements. There is currently a twenty (20) foot easement that is created for access and utilities and that will remain. Mr. Hall said that access will also need to be worked out since there is a single access road off of County Road 19. He added that access easement may need to be updated so that all lots have direct access to that access easement. Mr. McRoberts recommended the map show the actual required twenty -foot -wide internal lot drainage and utility easements along all of the lot lines. He said he recommends the map show the ten (10) feet drainage and utility easements along the exterior lot lines. Mr. Alessi asked if the easements are dedicated. Mr. Hall said the original Black Hollow plat included the dedication. Mr. Fleck asked staff if any more easements were needed off of County Road 19. Mr. Hall explained that when doing a resubdivision, they try to match all the other lots in the subdivision. Mr. Fleck asked why County Road 19 is an eighty (80) foot right-of-way instead of sixty (60) feet. Staff explained there is fifty (50) foot of right-of-way on the west side, as shown on the Black Hollow original plat and thirty (30) foot on the east side of the section line. Mr. McRoberts asked if there were any more questions or comments. There were none. Mr. McRoberts asked if there was a motion to include the easement standards in Weld County Code, Section 24-3-60. The plat will need to show the required internal lot line utility and drainage easements. Motion: Approve the final plan for RES21-0006 including the required internal lot line utility and drainage easements per the Weld County Code, Moved by Robert Fleck, Seconded by Mark Alessi. Motion carried unanimously. Kris Ranslem, Planning Department, presented the proposed Amendments to the Utilities Coordinating Advisory Committee's Bylaws. She stated that there was a staff reorganization which included moving the Engineering representative from the Department of Public Works to the Department of Planning. Therefore, staff is requesting that the Bylaws reflect one representative from both the Department of Public Works and the Weld County Planning Department to serve on the Utilities Coordinating Advisory Committee. Motion: Accept the proposed amendments to the Utilities Coordinating Advisory Committee Bylaws and recommend approval to the Board of County Commissioners, Moved by Mark Alessi, Seconded by Robert Fleck.
