RE: APPROVE EQUIPMENT LOAN AND DAMAGE AGREEMENT FOR SIX (6) RUGGED
TERRAIN VEHICLES (RTV) FOR WELD COUNTY FAIR AND AUTHORIZE CHAIR TO
SIGN - WICKHAM TRACTOR COMPANY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Equipment Loan and Damage
Agreement for Six (6) Rugged Terrain Vehicles (RTV) for the Weld County Fair between the
County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld
County, on behalf of the CSU Extension Service of Weld County, and Wickham Tractor Company,
with further terms and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Equipment Loan and Damage Agreement for Six (6) Rugged
Terrain Vehicles (RTV) for the Weld County Fair between the County of Weld, State of Colorado,
by and through the Board of County Commissioners of Weld County, on behalf of the CSU
Extension Service of Weld County, and Wickham Tractor Company, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 21st day of June, A.D., 2021.

Brief description of the problem/issue:
Wickham Tractor Company will be doing an in -kind sponsorship of UTV's and Kubota's to use at the
Weld County Fair.
What options exist for the Board? (include consequences, impacts, costs, etc. of options):
Wickham Tractor Company has sent a Damage Agreement for using their equipment during the fair.
There will be no cost associated with receiving the equipment, but if the any of it is damaged under
our supervision we will have to pay for those damages.
Recommendation:
Weld County Fair recommends to accept agreement with Wickham Tractor Company. Agreement
has already been reviewed by legal and was OK with it.

Wickham Tractor Company agrees to loan the following equipment to Weld County Fair.
For this event: 2021 Weld County Fair for the following dates: June 23rd —August 3rd.
Equipment:
6 RTVs
You will ensure that each donated unit is used safely and only: (a) for its intended purpose(s); (b) within its rated
capacity; (c) at the event location; (d) by properly qualified, certified and/or licensed operators; (e) otherwise in
full compliance with the instructions as well as all applicable laws, rules and regulations, at all times. You will not,
nor will you permit anyone else to: abuse, misuse, overuse, remove, conceal, repair, modify, damage or destroy
any donated item. The use of alcohol, marijuana, and any drugs is strictly prohibited by anyone using the
equipment. Units should be turned off when idling or not in use.
You will protect each donated unit at all times, keep it safely and securely stored and locked when not in use,
and return it to WIC clean and otherwise in good order, condition and repair, and properly maintained. All units
and their conditions will be documented upon delivery/pick-up. Damages incurred to the unit while in your
possession will be documented. If damage occurs, you will be liable for all costs, both direct and indirect, that
are incurred to restore the equipment to its state at the time of initial drop off.
