Naibauer, Weld County Public Works 4 /0 • JA5-azi DATE: February 9, 2021 Brief description of the problem/issue: The original agreement for the Precast Concrete Product Contract can be extended from March 28, 2021 to March 27, 2022 as permitted by the contract. This extension would be in the second year of a possible three- year term limit. The contract also allows for yearly rate adjustments based upon the current Engineering New - Record (ENR) price for Reinforced Concrete Pipe, which was a 16,74% increase from January 2020 to January 2021. Old Castle Precast is requesting a cost increase of 10.97% for 2021. The 2021 bid summery will replace the 2020 bid schedule. The budget amount in 2021 for this contract is $571,000.00 in account 32300-6250 for Cost of Goods Sold. Precast Concrete Product purchases will remain within budget limits. Precast Concrete Products will be priced according to the 2021 bid schedule. Old Castle Precast was awarded this contract in 2020 as the low bid contractor and the department has been satisfied with their product. What options exist for the Board? (include consequences, Impacts, costs, etc. of options): The Board may either approve or deny the contract renewal/extension. WHEREAS the parties entered into an agreement (the "Original Agreement") identified by the Weld County Clerk to the Board of County Commissioners as document No. 62000081, approved on Marcie 2, 2020. WHEREAS the parties hereby agree to extend the term of the Original Agreement in accordance with the terms of the Original Agreement, which is incorporated by reference herein, as well as the terms provided herein. NOW THEREFORE, in consideration of the premises, the parties hereto covenant and agree as follows: • The current term of the Original Agreement will end on March 31, 2021. • The parties agree to extend the Original Agreement for an additional one year period, which will begin April 1, 2021, and will end on March 31, 2022. • The Renewal, together with the Original Agreement, constitutes the entire understanding between the parties. The following change is hereby made to the Contract Documents, which shall be effective upon the expiration of the current term of the Original Agreement: 1. Commencing on the first day of the extended term, the 2021 Bid Schedule, attached, replaces the 2020 Bid Schedule. All other terms and conditions of the Original Agreement remain unchanged.
