Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS GENERAL PROJECT INFORMATION/LOCATION Project description: A Site Specific Development Plan and Use by Special Review Permit for a Commercial Recreational Facility (Dock diving Facility for Dogs) in the A(Agricultural)Zone District This project is south of and adjacent to Highway 52 and is west of CR 1. Parcel number 146706100049. Access is from Highway 52. ACCESS Weld County Public Works has reviewed the application materials related to access Parcel has one existing access onto State Highway 52. The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to state highways. Please contact Tim Bilobran at the Greeley office (970-350-2163) to verify the access permit or for any additional requirements that may be needed. (State Highway 52) ROADS AND RIGHTS -OF -WAY State Highway 52 is under the jurisdiction of CDOT. Please contact CDOT to verify the right-of-way requirements, access permit requirements, and any additional requirements that may be needed. DRAINAGE REQUIREMENTS This area IS within an Urbanizing Drainage Area: Urbanizing Drainage Areas typically require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 5 -year storm falling on the undeveloped site for URBANIZING areas. Detention pond waived and a simple drainage narrative: The applicant has submitted an acceptable drainage narrative that states the site meets drainage exception 12. A parcel greater than 1 gross acre and less than, or equal to, 5 gross acres in size is allowed a onetime exception for a new 2,000 sq. ft. building or equivalent imperviousness. Located in Sec. 8-11-40. Drainage Policy. No additional drainage management information is not required. Historic Flows: The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from the property. GRADING PERMIT A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications are accepted after the planning process is complete (plan recorded). An Early Release Request Form may be entertained only after the applicant, Public Works and Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact an Engineering representative from the Public Works for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575. CONDITIONS OF APPROVAL The plan shall be amended to delineate the following 1. Show the approved Colorado Department of Transportation (CDOT) access on the site plan and label with the approved access permit number if applicable. (Department of Public Works) 2. State Highway 52 is under the jurisdiction of CDOT. Please contact CDOT to verify the right-of- way. Show and label the right-of-way. (Department of Public Works) 3. Show and label the drainage flow arrows. (Department of Public Works) 4. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around the property. (Department of Public Works) DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN) 1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Department of Public Works) 2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages and/or off -site tracking. (Department of Public Works) 3. There shall be no parking or staging of vehicles on public roads. On -site parking shall be utilized. (Department of Public Works) 4. (Department of Public Works) WELD COUNTY DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT 1555 North 17th Avenue, Greeley, CO 80631 www.weldhealth,org MEMORANDUM TO: Chris Gathman, Planning Services FROM: Lauren Light, Environmental Health Services DATE: January 22, 2021 SUBJECT: USR21-0002 Cassidy Environmental Health Services has reviewed this proposal for a Site -Specific Development Plan and Use by Special Review Permit for a Commercial Recreational Facility (Dock Diving Facility for Dogs) in the A(Agricultural) Zone District. The existing house is served by Left Hand Water District and an on -site wastewater treatment system (OWTS) permitted for 3 bedrooms. (G19910258) The applicant is proposing to use portable toilets. Portable toilets are acceptable for facilities that are utilized 6 months or less per year in accordance with EH policy. If the use exceeds 6 months, then a permanent water source and an OWTS must be installed. A noise report, conducted by Alles Taylor and Duke LLC, was submitted which indicates the residential noise limit can be met. The noise report concluded: "if a PA system is used, care should be taken to ensure that it does not direct sound to the adjoining properties, it should be pointed towards the principle structure on the property." Noise will be restricted to the residential limit and is measured 25 feet from the property line. The waste handling plan indicates there will be a pet waste area and all waste will be bagged and disposed of in a dumpster which will be emptied on a weekly basis. Nuisance abatement and dust abatement plans were submitted and adherence to those plans is required. The saltwater pool has a water capture system so splash water is pumped back into the pool. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with Chapter 14, Article 1 of the Weld County Code, and the accepted waste handling plan and nuisance abatement plan. 4. Fugitive dust shall attempt to be confined on the property. Uses on the property should comply with the Colorado Air Quality Commission's air quality regulations and the accepted dust abatement plan. 5. Adequate drinking, hand washing, and toilet facilities shall be provided for employees and patrons of the facility, at all times. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 6. Temporary uses that are utilized for a time period of six months or less, portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County, contain hand sanitizers and be screened from public view. 7. Any On -site Wastewater Treatment System located on the property must comply with all provisions of the Weld County Code, pertaining to On -site Wastewater Treatment Systems. 8. The facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone as delineated in 25-12-103 C.R.S. The facility shall operate in accordance with the accepted noise report. 9. The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. The applicant will need to obtain a new access permit for the increase in traffic volume proposed by the new use. They will also be made aware that the SH 52 Access Control Plan currently being completed will show a change in their access at some point in the future.
