MEMORANDUM
TO: Chris Gathman, Planning Services
FROM: Lauren Light, Environmental Health Services
DATE: January 22, 2021
SUBJECT: USR21-0002 Cassidy
Environmental Health Services has reviewed this proposal for a Site -Specific
Development Plan and Use by Special Review Permit for a Commercial Recreational
Facility (Dock Diving Facility for Dogs) in the A(Agricultural) Zone District.
The existing house is served by Left Hand Water District and an on -site wastewater
treatment system (OWTS) permitted for 3 bedrooms. (G19910258)
The applicant is proposing to use portable toilets. Portable toilets are acceptable for
facilities that are utilized 6 months or less per year in accordance with EH policy. If the
use exceeds 6 months, then a permanent water source and an OWTS must be
installed.
A noise report, conducted by Alles Taylor and Duke LLC, was submitted which indicates
the residential noise limit can be met. The noise report concluded: "if a PA system is
used, care should be taken to ensure that it does not direct sound to the adjoining
properties, it should be pointed towards the principle structure on the property." Noise
will be restricted to the residential limit and is measured 25 feet from the property line.
The waste handling plan indicates there will be a pet waste area and all waste will be
bagged and disposed of in a dumpster which will be emptied on a weekly basis.
Nuisance abatement and dust abatement plans were submitted and adherence to those
plans is required. The saltwater pool has a water capture system so splash water is
pumped back into the pool.

Thank you Cassidy, based on the additional information provided below the existing residential water meter
classification is appropriate for this home business. A change to commercial classification is not warranted at this time
and we are withdrawing our request for a new tap availability review on the property as part of USR 21-0002. Please
share this with Weld County as appropriate for their file.

RE: Weld County referral: USR21-0002
The Town of
Erie
has
reviewed the
referral materials provided for Weld County Case Number
USR21-0002
and
has
the following
comments:
• The Town of Erie Comprehensive Plan identifies the subject property as being located in
our LDR-Low Density Residential land use category. The LDR land use category does
not include business uses. The Town of Erie does not support the request for a
business on the property as it conflicts with our Comprehensive Plan.
• The property immediately adjacent to this site is located within the Town of Erie
municipal boundary and is zoned for residential uses (LDR- Low Density Residential).
The Town is in the platting process for residential development of this property.
o Within the Town of Erie, a dog based business with outdoor facilities must be
located a minimum of 300 feet from any residentially zoned property. If Weld
County approves the application, the Town requests that the outdoor dog
facilities be located a minimum of 300 feet from the Town's residentially zoned
property.
• The current and proposed access drive into the property is located on Highway 52.
o CDOT should review the current access permit to evaluate if a permit
modification is required due to the increased traffic associated with the business
and events.
o CDOT should review the proposed sign in the right of way.

Chris,
I'm sorry about the confusion. Well, I guess I was the only one confused.
The applicant will need to obtain a new access permit for the increase in traffic volume proposed by
the new use. They will also be made aware that the SH 52 Access Control Plan currently being
completed will show a change in their access at some point in the future.
Please have the applicant contact Ally Mattson at CDOT for instructions on the access permit process.
