WHEREAS, said Board is authorized by the statutes of the State
of Colorado to regulate the speed of vehicles, and
WHEREAS, said Board, pursuant to such complaints, has deter-
mined upon the basis of engineering, traffic investigations and a special
speed survey, that any speed in excess of 35 miles per hour o , along
or over said portion of said road or highway and at all interse tions of
other roads therewith is excessive and is greater than is reas nable, -
safe or prudent under the conditions which exist.
• NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners of Weld County, Colorado, that no motor vehicle shall
be driven on, over or along any portion of said road or highwa , or at .

WHEREAS, the lowest and best bid submitted was by the 4
Lawrence Construction Company in the amount of $326,972.$L , and

. WHEREAS, the Office of Emergency Preparedness (OEP) has
authorized a Federal Fund expenditure of $125,418.00 toward the :,.,

RESOLUTION
RE: AMENDED ARTICLES OF ASSOCIATION OF LARIMER-WELD
REGIONAL AREA COUNCIL OF GOVERNMENTS.
WHEREAS, heretofore and on May 10, 1973, pursuant to law, the
Board of County Commissioners, Weld County, Colorado, by Resolution
did adopt the Larimer-Weld Area Council of Governments, and
WHEREAS, certain differences had arisen as to the formation
and operation of said organization, and
WHEREAS, all such differences now have been amicably resolved
to the mutual satisfaction of all members thereof by certain amendments
and deletions.
NOW, TIIEREFORE, BE IT RESOLVED, by the Board of County

ARTICLES OF ASSOCIATION
OF
LARIMER-WELD REGIONAL AREA COUNCIL OF GOVERNMENTS
ARTICLE I
uiieral ,
\lembership 1. These Articles of Association shall regulate and govern the
affairs of the association known as the Larimer-Weld Regional
Area Council of Governments, hereinafter known as the "Council",
and is organized pursuant to Article XIV, Section 18 (2) of the
Colorado Constitution and C. R. S. , Chapter 88, Article 2, 1963
as amended. The Council is comprised of the Counties of
Larimer and Weld and the municipal corporations located therein
which ratify this agreement in writing.
Council of 2. The total membership of the Council shall meet at least once
the Whole
a year in plenary session to make general recommendations and
discuss matters of policy and general interest to the Council of
Governments as a whole.
Governing 3. There shall be a Governing Board of the Council to conduct the
Board
business of the Council between general meetings. The Governing
Board shall consist of Larimer and Weld Counties and the muni-
cipal corporations located therein which shall be entitled to voting
representatives as set forth in these Articles. The fourteen (14)
voting representatives shall be comprised as follows:
, Three (3) County Commissioners from Larimer County.
Three (3) County Commissioners from Weld County,
One (1) representative from each of the four (4) largest
participating member municipalities in each County, for 4
a total of eight (8) municipal representatives.

The voting representatives of the municipal corporations enumerated
immediate above shall be, either,
a. an elected member of a municipal corporation or board
serving during his term of office; or
b, an elected mayor of a municipal corporation.

Each municipal corporation voting representative shall be
selected in such manner as may be agreed upon by majorit y vote
of participating member municipal corporations within each county.
If a municipal corporation which is entitled to a voting repre-
sentative under the terms of these Articles shall fail to select its
representative within sixty (60) days from notice of adoption of
these Articles by the I3oard of County Commissioners of each County,
or from notice of a vacancy which may occur from time to time, then
the position of such municipality shall be deemed vacant, and the
next largest municipality by population shall have the option to select
a representative to fill such vacancy on the Governing Board.
Term 4. The voting representatives from each county or municipal cor-
poration as set forth in paragraph 2. shall serve as such repre-
sentative on the Governing Board for a minimum period of one (1)
year so long as qualified as an elected official from and after approval
of these Articles or as may otherwise be provided by law. Vacancies
occurring on the Governing Board from time to time shall be filled in
the same manner as is provided for in the original designation.
Vote 5., Each member of the Governing Board, or, in his absence, his
designated alternate as provided in paragraph 6, of these Articles
shall have one (1) vote to be cast in person and there shall be no vot-
ing by proxy.

In the first instance, the alternate shall be selected at the same time

fications of the voting representative as set forth in Article I, para-
graph 3.
ARTICLE II
Purpose 1. The Council shall promote regional cooperation and coordinat i-t
among local governments and between levels of government for the
geographic area comprised of the Counties of Larimer and Weld
hereinafter referred to as the "Region".
The need for a council of Governments is based on the recognition
that people 111 the Region form a single community and are bound to-
gether not only physically, but economically and socially. It is the
purpose of the Council through its Governing Board, participating
membership, staff, and programs, to provide local public officials
with the means of responding more effectively to the local and regional
problems of this Regional Community.
In order to assure the orderly and harmonious development
of the Region, and to provide for the needs of future generations,
it is necessary for the Council to serve as an advisory coordi-
nating agency as well as the body politic specifically empowered
as designated herein, to harmonize the activitesof federal, state,
county and municipal agencies within the Region, and to render
assistance and service and create public interest and participation
for the benefit of the Region.
Functions 2. The Council may promote regional coordination and cooperation
through activities designed to:
a. Strengthen local governments and their individual capa-
cities to deal with local problems;
b. Serve as a forum to identify, study, and resolve area-
wide problems;

c. Develop and formalize policies involving regional problems;
d. Promote intergovernmental cooperation through such acti-
vities as reciprocal furnishing of services, mutual aid, and eoordi-
nated•action as a means to resolve local, as well as regional problems;
e. Provide the organizational framework to insure effective
communication and coordination among governmental bodies;
f. Serve as a vehicle for the collection and exchange of in-
formation of regional interest;
g. Develop regional comprehensive plans for the Region;
h. Serve as a spokesman for local governments on matters
of regional and mutual concern;
i. Encourage action and implementation of regional plans and
policies by local, state, and federal agencies;
j. Provide, if requested, mediation in resolving conflicts
between members and between members and other parties; and
k. Provide technical and general assistance to members with
its staff and financial capabilities. These services are inclusive
of, but not limited to, services designed to:
(1) Identify issues and needs which are regional and
beyond the realistic scope of any one local government;
(2) Compile and prepare, through staff and from mem-
bers, the necessary information concerning the issues and
needs for Council discussion and decision;
(3) Debate and concur in a cooperative way and coordinate
regional action to meet the need or issue;
(4) Implement the details of the cooperative action
among affected member governments, using such devices as t
interlocal contracts and agreements, parallel ordinances or
codes, joint performance of services, transfers or consoli-
dations of functions, or special subordinate operating agencies;

(5) and, in general -
- arrange contracts among officials on an intergovernmental
basis;
- publish reports on functional problems;
- publish current information of regional interest;
- provide advice and assistance on physical land use planning
and other functional programs;
- sponsor regional training programs;
- negotiate cooperative agreements.
Powers 3. The Council shall, for the purpose of fulfilling its purposes and
functions, be a body politic and corporate, and, as such an entity,
be subject to all rights, duties and obligations as such may affect
the members of such Council whereby its activities are of a regional,
areawide, or multi-governmental nature and, further, shall con-
stitute the entity to perform those regional or areawide functions
which may be authorized by Federal or State Statute. To effectuate
:such powers, the Governing Board of the Council shall:
a. Be the approving, contracting, and reviewing agent for
all Federal and State Regional Grants, as required;
b. Provide for regional transportation;
c. Provide for regional land use planning;
d. Provide for comprehensive areawide regional health
planning;
e. Be the governmental entity for the purpose of receiving
State or Federal assistance to areawide or regional governmental
entities.
To further effectuate such powers, the Governing Board of the
Council may exercise all powers set forth in C. R. S. Chapter 88,
Article 2, 1963 as amended, upon agreement of all interested
member jurisdictions.

ARTICLE III
Officers 1. The Governing Board of the Council shall elect three (3) officers,
which officers shall be voting representatives on the Board and shall
consist of a Chairman, Vice-Chairman, and Secretary-Treasurer.
Each Officer shall be elected from the voting representatives com-
prising the Board as enumerated in Article I, paragraph 2, of these '
Articles.
a. Chairman. The Chairman shall preside at all meetings of
the Council and shall be the chief Officer of the Council.
b. Vice-Chairman. The Vice-Chairman shall exercise the
functions of the Chairman in the Chairman's absence or incapacity.
c. Secretary-Treasurer. The Secretary-Treasurer shall
exercise the functions of the Vice-Chairman in the absence or in-
capacity of the Vice-Chairman and shall perform such other duties
as may be consistent with his office or as may be required by the
Chairman.
Staff 2. The Governing Board of the Council may employ a director and
a staff and may contract for expert services as the Council, in its
discretion, may determine.
ARTICLE IV
Meetings of the
Governing 1. The Governing Board of the Council shall meet at least once each
Board
month and at such other times as the Chairman may direct. All such
meetings shall be open to the public.

Council of the 2. The Council of the Whole shall meet in plenary session at least

annually at the direction of the Chairman. All such meetings shall
be open to the public.
Quorum 3. A quorum of the Governing Beard shall consist of not less than
eight (8) voting representatives.
Majority Vote 4. Once a quorum has been established, a majority of the full Board

and mot merely those present, that is, a vote of eight (8), shall be
required to adopt any matter before the Governing Board except as
otherwise provided in Article V, paragraph 5, as requiring a special
vote. Each vote shall be cast in person by the duly designated voting
representative of a political subdivision or jurisdiction as set forth
in Article I of these Articles.
Special Vote 5. Action of the Governing Hoard shall be by majority vote except

b. Adoption of the budget and funding of the Council, in which
case action shall be taken by an affirmative vote of ten (10), pro-
vided that, however, there shall be present at least six (6) of the
representatives of municipalities plus at least two (2) of the three
(3) County Commissioners from each county.
ARTICLE V
Committees The Board may provide for technical and advisory committees as
are necessary, and shall provide for the appointment of the member-
ship of said committees. These appointments, where necessary,
shall be in accordance with State and/or Federal requirements.
ARTICLE VI
budget 1. Each year at the regular August meeting the Chairman shall sub-
mit to the Board an estimate of the budget required for the operation
of the Council during the ensuing calendar year. Upon approval of
such budget as approved pursuant to Article IV, Section 4, of these
Articles, the funds required by the Council shall be apportioned
equally between the counties.
Funding 2. The Board is specifically empowered to contract or otherwise

participate in and to accept grants, funds, gifts, or services
from any federal, state, or local government or its agencies
or instrumentalities thereof, and from private and civic sources,
and to upend funds received therefrom, under provisions as may
be required and agreed to by the Board, in connection with any
program or purpose for which the Council exists. +
ludit 3. The Board shall arrange for a systematic and continuous re-
cordation of the Council's financial affairs and transactions and
shall obtain an annual audit of its financial transactions and ex-
penditures, or as otherwise required by law.
ARTICLE VII
Adoption and
Ratification 1. These Amended Articles shall become effective upon their
adoption by Resolution of the respective Boards of County
Commissioners of Larimer and Weld Counties, and upon the
adoption and ratification in writing of the eight (8) municipa-
lities whose representation is provided for in Article I, Para-
graph 3, of these Articles.
Notice 2. These Articles maybe amended at any regular meeting
of the Boardby vote as set forth in Article IV, section 4, of
these Articles, provided that at least thirty (30) days' notice
in writing be given to all members setting forth the amendment
to be considered.

RESOLUTION
WHEREAS, it has come to the attention of the Board of County
Commissioners, Weld Countys Colorado, that there is a need for a
subsidence study of mined-out areas in Weld County, and
WHEREAS, the Colorado State Geologist has recommended to
the Board that a geological survey should be made in Weld County of
mined-out areas and requested a contribution of Five Thousand Dollars
($5, 000. 00) from the County for this purpose, and
WHEREAS, there are no funds available for such study other
than those funds reposing in the regional budge of the Weld County
Planning Commission, and
WHEREAS, certain funds have been set aside in the 1973 Planning
Commission budget for a flood plain study on the Big Thompson River,
and
WHEREAS, it appears that no progress nor commitment has
been made relative to such flood plain study in 1973, and
WHEREAS, the Board has determined that it would be in the best
interests of the County to make available Five Thousand Dollars
($5, 000. 00) for a subsidence study of mined-out area in the County from
the funds heretofore earmarked for a flood plain study in the County.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, and it hereby authorizes and
orders Five Thousand Dollars ($5, 000. 00) of funds, heretofore earmarked
for a flood plain study, to be used to pay for a subsidence study of
mined-out areas in Weld County.

UNDER FEDERAL LEASING ACT;
WHEREAS, under Colorado Revised Statutes , 1963
Chapter 100 , Article 8 (100-8- 2a) , the Board of County
II Commissioners shall apportion such royalties received
under the Federal Leasing Act to public schools and public
roads , provided that not more than seventy-five percent
of said money shall be apportioned to either of said purposes
during any one year; and
WHEREAS , having received $6 , 795. 57 the Board
believes it to be in the best interest of the County to
apportion Fifty percent (500) to the Road & Bridge Fund
and Fifty percent (50%) to the School Fund ;

RESOLUTION OF THE WELD COUNTY
BOARD OF RETIREMENT
AMENDING THE WELD COUNTY RETIREMENT PLAN
WHEREAS, the Weld County Retirement Plan has hertofore been
created by resolution of the Weld County Board of Retirement, and
WHEREAS, the consulting actuaries for said plan have recom-
mended amendments which are believed to be in the best interests of th,,
present and future members of the plan, such amendments to take effect
on January 1 , 1973, and
WHEREAS, all of said amendments are believed to be non-dis-
criminatory and in conformance with Section 401 (a) and other applicable
provisions of the Internal Revenue Code of 1954, as amended.
NOW, THEREFORE, BE IT RESOLVED that the Weld County Retirowm t
Plan be and hereby is amended as follows:
1 . Amend Section 2.1 (m) in its entirety to read as follows:
" (m) 'Accumulated Contributions ' shall mean the sum of
the Member's contributions to this Plan, together with
the interest thereon at the rate of 3'2% per annum com-
pounded annually, or at such other rate as may be deem-
ed reasonable and proper by the Retirement Board in the
light of the actual earnings of the Fund. "
2. Amend Section 2. 1 by addiltle following new sub-section (v) :
" (v) 'Final Average Annual Compensation' means a Mem-
ber's average compensation during the five consecutive
calendar years of Credited Service out of his last
ten years of Credited Service, which will produce
the highest average annual compensation. If a Mem-
ber has less than five complete calendar years of
Credited Service, his Final Average Annual Compen-
sation shall be his average annual compensation
during all full calendar years of Credited Service. "
3. Amend Section 5.3 in its entirety to read as follows:
"5.3 Application of Forfeitures. Any amount Forfeited
because of termination of emp;oyment of a Member prior
to his having acquired a fully vested right to Retire-
ment Benefits, because of death of any Member, or for
any other reason, shall not be applied to increase the
benefits provided by the Plan unless such benefits are
increased by appropriate amendments, as provided in
Section 14.2 hereof."
4. Amend Section 7.1 in its entirety to read as follows :
"7.1 Normal or Delayed Retirement Benefit. Upon re-
tirement at or after his Normal Retirement Date, each
Retired Member shall receive a monthly Retirement Ben-
efit for ten years certain and life thereafter, equal
to one-twelfth of the following: 1% of the Member' s
Final Average Annual Compensation plus 3/4 of 1% of
such Final Average Annual Compensation in excess of
$4800. , multiplied by the total number of years of
Credited Service. The minimum monthly Retirement Ben-
efit determined above shall not be less than $5.00
per year of Credited Service. "

5. Amend Section 7.2 in its entirety to read as follows:
"7.2 Early Retirement Benefit. A Member retiring
prior to his Normal Retirement Date shall be entitled
to a reduced Retirement Benefit which shall be the
vested portion of his Normal Retirement Benefit which
is based on his Credited Service prior to his actual
retirement and which would have been payable to him
at Normal Retirement Date. but reduced by one-fifteenth
for each of the first five years and one-thirtieth for
each additional year by which the Early Retirement
Date precedes his Normal Retirement Date. "
6. Amend Section 7 by adding the following new Sub-Section 7.3:
"7.3 Increased Benefits for Retired Members. All re-
tired Members who retired prior to January 1 , 1973
shall receive as of the effective date of this amendment
the increased benefits set forth in this Section. !
A. The normal form of monthly retire-
ment benefit computed under the Plan
in effect as of the member' s actual
retirement date shall not be less
than $5.00 per year of Credited
Service.
B. The monthly benefit, after the appli-
cation of the minimum set forth in A
above shall be increased as follows:
(i ) five percent for each year the
Member has been retired, plus
(ii ) three percent for each year of
Credited Service at the time of
retirement."
7. Amend Section 9. 1 in its entirety to read as follows :
"9.1 Death of a Member before Normal Retirement Date.
In the event that a Member of the Plan dies prior to
his Normal Retirement Date, the following death bene-
fits shall be payable:
(a) In the event a Member dies prior to being eli-
gible for Early Retirement, there shall be paid
to the Beneficiary designated by him, if said
Beneficiary be living, otherwise to his estate,
the amount of his Accumulated Contributions as
of the date of death.
(b) In the event that a Member of the Plan dies
while eligible for Early Retirement but prior
to his Normal Retirement Date, a monthly bene-
fit shall be paid to his surviving spouse, if
any, in an amount equal to one-half of the
monthly Retirement Benefit earned by the Mem-
ber prior to his date o= death, based on his
Credited Service and Final Average Annual Com-
pensation prior to such date. If said Member
does not have a surviving spouse, there shall
be paid to the Beneficiary designated by him,
if said Beneficiary be living, otherwise to his
estate, the amount of his Accumulated Contribu-
tions as of the date of death. "
8. Amend Section 16 by adding the followi_ng new Sub-section 16.2.
"16.2 If the Plan is amended to increase benefits which
would increase substantially the extent of possible dis-

crimination as to contributions and as to benefits
upon termination of the Plan, the restrictions set
forth in Section 16.1 shall be applied to the Plan
as if it were a new plan established on the dace of
such change. "
All of said amendments to take effect on January 1 , 1973, provided , i'1 ;l-
ever, that said amendments are contingent upon approval by the Internll
Revenue Service, and in the event any of said amendments would serve to
disqualify this Plan, then the amendments shall not be in force and el"c ct
and the Plan shall remain as it was prior to amendment.

WHEREAS, by authority granted under Public Law 91-606 a •
Special Road and Bridge Fund was created for monies allocated to
Weld County, Colorado, for the 1973 South Platte River Flood, and
WHEREAS, the Office of Emergency Prepardness has
inspected and approved numerous sites damaged by the 1973 South
Platte River Flood and has committed Federal funds to pay the
same, and ,

WHEREAS, Mr. Barton Buss, Chief Accounting Officer for
Weld County, Colorado, has varified to the Board of County Commissioners
various payment in the amount of $183,940.65, as per copy attached
Ihereto and made a part of this resolution.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners of Weld County, Colorado, that they do hereby
authorize and direct the Weld County Treasurer to transfer
$183,940.65 from the 1973 Special Road and Bridge Account to
the Road and Bridge Fund Account for payment of the attached
claims.

RESOLUTION
WHEREAS, heretofore and on July 18, 1973, by Resolution, the
Board of County Commissioners, Weld County, Colorado, did adopt
a Uniform Fee Schedule, marked Exhibit A, for utility installations
in County road rights of way, and
WIIEREAS, it has come to the attention of the Board that said fee
schedule is misleading and/or ambiguous in certain respects, and
WHEREAS, the Board has re-assessed the County's position
relative to such fee schedule, and has determined that it would be in
the hest interest of the County to revise same.
NOW, THEREFORE, FEE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, and it hereby directs that
the aforementioned Uniform Fee Schedule, marked Exhibit A, be
cancelled and held for naught, and that Amended Uniform Fee Schedule,
marked Exhibit A, is hereby adopted and shall be in effect as of
12:00 o'clock noon, September 26, 1173, and shall continue to be in
effect until further order of the Board.

AMENDED UNIFORM FEE SCHEDULE FOR THE
USE OF COUNTY ROAD RIGHTS OF WAY FOR
UTILITY INSTALLATIONS IN WELD COUNTY, COLORADO
For all utilities, regardless of installation, permit fee shall be based
upon trench width as follows:
Trench Width Permit Fee
Up to 6" . 015 per lineal foot
7" thru 12" $0. 03 per lineal foot
13" thru 24" $0. 06 per lineal foot
25" thru 36" $0. 09 per lineal foot
37" and above $0. 12 per lineal foot
Minimum permit fee will be $5. 00.
For all non ferrous pipelines installed in road rights of way a suitable
facility shall be installed with the pipeline to facilitate future pipeline
location.
Service taps (residential) included on line expansion permit shall not
be included in fee.
Service taps on existing facilities shall be considered at the minimum
fee.
Encasement where facility parallels right of way line and encasement
is suspended from or attached to a bridge or drainage structure shall not
be included in total.
Where boring and encasement is required across a county road from
private rights of way to private rights of way all charges shall be based
upon $0. 01 per inside diameter inch of the encasement pipe per lineal foot
installed across county road right of way.
The Board of County Commissioners may at their discretion wave
permit fees where any facility is being moved and reinstalled at the county's
request or any repairs on an emergency basis or any other reason in the
opinion of the Board warrants their action.
The above fee schedule and conditions do not relieve any utility company,
its agents, contractors, or personnel of any conditions outlined, or duties
required as specified in the utility permit required. `

RESOLUTION
WHEREAS, pursuant to law, the Board of County Commissioners,
Weld County, Colorado, is vested with the responsibility of administering
the affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board that there is a need
for certain equipment and supplies for the road and bridge department
of Weld County for 1974 delivery, all as shown on Exhibit A attached
hereto and made a part hereof, and '
WHEREAS, the Board is desirous to purchase said equipment and
supplies this year due to slow delivery schedules, and
WHEREAS, the Board believes it to be in the best interest of the
County to seek bids for the Board's approval relative to the purchase of
the aforementioned equipment and supplies, all as shown on Exhibit A
attached hereto.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that Mr, Barton Buss, Chief
Accounting Officer for Weld County, advertise for bids to purchase the
aforementioned equipment and supplies for the road and bridge depart-
ment for delivery in 1974.
BE IT FURTHER RESOLVED, that the Board be, and it hereby is
authorized to execute agreements with any and all successful bidders
for the purchase of the aforementioned equipment and supplies for the
road and bridge department of Weld County and to make the same effective
forthwith.

RE: AMENDED ARTICLES OF ASSOCIATION OF LARIMER-WELD C
REGIONAL COUNCIL OF GOVERNMENTS. K
WHEREAS, heretofore and on September 19, 1973, pursuant to law,
the Board of County Commissioners, Weld County, Colorado, by Resolution
did adopt the Larimer-Weld Regional Area Council of Governments, and

WHEREAS, certain differences had arisen as to the formation and
operation of said organization, and
WHEREAS, all such differences now have been amicably resolved
to the mutual satisfaction of all members thereof by certain amendments
and deletions.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that the Amended Articles of
Association of Larimer-Weld Regional Council of Governments, copy of
which is attached hereto and made a part hereof by reference, be, and
they hereby are approved.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 3rd day of October, A. D.

ARTICLES OF ASSOCIATION
OF
LARIMER-WELD REGIONAL COUNCIL OF GOVERNMENTS
ARTICLE I
General
r
Membership 1, These Articles of Association shall regulate and govern the
affairs of the association known as the Larimer-Weld Regional
COUnCil of Governments, hereinafter known as the "Council", and
is organized pursuant to Article XIV, Section 18 (2) of the Colorado
Constitution and C. R. S. , Chapter 88, Article 2, 1963 as amended.
The Council is comprised of the Counties of Larimer and Weld and
the municipal corporations located therein which ratify this agree-
ment in writing.
Council of 2. The total membership of the Council shall meet at least once
the Whole
a year in plenary session to make general recommendations and
discuss matters of policy and general interest to the Council of
Governments as a whole.
Governing 3. There shall be a Governing Board of the Council to conduct the
Board
business of the Council between general meetings. The Governing
Board shall consist of Larimer and Weld Counties and the muni-
cipal corporations located therein which shall be entitled to voting
representatives as set forth in these Articles. The fourteen (14)
voting representatives shall be comprised as follows:
Three (3) County Commissioners from Larimer County.
Three (3) County Commissioners from Weld County.
One (1) representative from each of the four (4) largest
participating member municipalities in each County, for
a total of eight (8) municipal representatives.

The voting representatives of the municipal corporations enumerated
immediate above shall be, either,
a. an elected member of a municipal corporation or board
serving during his term of office; or
b, an elected mayor of a municipal corporation.
Each municipal corporation voting representative shall be selected
in such manner as may be agreed upon by majority vote of participating
member municipal corporations within each county.
If a municipal corporation which is entitled to a voting repre-
sentative under the terms of these Articles shall fail to select its
representative within sixty (60) days from notice of adoption of
these Articles by the Board of County Commissioners of each County,
or from notice of a vacancy which may occur from time to time, then
the position of such municipality shall be deemed vacant, and the
next largest municipality by population shall have the option to select
a representative to fill such vacancy on the Governing Board.
Term 4, The voting representatives from each county or municipal cor-
poration as set forth in paragraph 2, shall serve as such repre-
sentative on the Governing Board for a minimum period of one (1)
year so long as qualified as an elected official from and after approval
of these Articles or as may otherwise be provided by law. Vacancies
occurring on the Governing Board from time to time shall be filled in
the same manner as is provided for in the original designation.
Vote 5, Each member of the Governing Board, or, in his absence, his
designated alternate as provided in paragraph 6, of these Articles
shall have one (1) vote to be cast in person and there shall be no
voting by proxy.

fications of the voting representative as set forth in Article I, para-

ARTICLE II
Purpose 1. The Council shall promote regional cooperation and coordination
among local governments and between levels of government for the
geographic area comprised of the Counties of Larimer and Weld
hereinafter referred to as the "Region".
The need for a council of Governments is based on the recognition
that people in the Region form a single community and are bound to-
gether not only physically, but economically and socially. It is the
purpose of the Council through its Governing Board, participating
membership, staff, and programs, to provide local public officials
with the means of responding more effectively to the local and regional
problems of this Regional Community.
In order to assure the orderly and harmonious development
of the Region, and to provide for the needs of future generations,
it is necessary for the Council to serve as an advisory coordinating
agency as well as the body politic specifically empowered as desig-
nated herein, to harmonize the activities of federal, state, county
and municipal agencies within the Region, and to render assistance
and service and create public interest and participation for the benefit
of the Region.
Viinctions 2. The Council may promote regional coordination and cooperation
through activities designed to:
a. Strengthen local governments and their individual capa-
cities to deal with local problems;
b. Serve as a forum to identify, study, and resolve area-wide
problems;

c. Develop and formalize policies involving regional problems;

d. Promote intergovernmental cooperation through such acti-

vities as reciprocal furnishing of services, mutual aid, and coordi-
nated action as a means to resolve local, as well as regional problems;
e. Provide the organizational framework to insure effective
communication and coordination among governmental bodies;
f. Serve as a vehicle for the collection and exchange of infor-
mation of regional interest;
g. Develop regional comprehensive plans for the Region;
h. Serve as a spokesman for local governments on matters
of regional and mutual concern;
i. Encourage action and implementation of regional plans and
policies by local, state, and federal agencies;
j. Provide, if requested, mediation in resolving conflicts
between members and between members and other parties; and
k. Provide technical and general assistance to members with
its staff and financial capabilities. These services are inclusive
of, but not limited to, services designed to:
(1) Identify issues and needs which are regional and
beyond the realistic scope of any one local government;
(2) Compile and prepare, through staff and from mem-
bers, the necessary information concerning the issues and
needs for Council discussion and decision;
(3) Debate and concur in a cooperative way and coordinate
regional action to meet the need or issue;
(4) Implement the details of the cooperative action
among affected member governments, using such devices as

interlocal contracts and agreements, parallel ordinances or
codes, joint performance of services, transfers or consoli-
dations of functions, or special subordinate operating agencies;

(5) and, in general -
- arrange contracts among officials on an intergovernmental
basis;
- publish reports on functional problems;
- publish current information of regional interest;
- provide advice and assistance on physical land use
planning and other functional programs.

Powers 3. The Council shall, for the purpose of fulfilling its purposes and
functions, be a body politic and corporate, and, as such an entity,
be subject to all rights, duties and obligations as such may affect
the members of such Council whereby its activities are of a regional,
areawide, or multi-governmental nature, and, further, shall con-
stitute the entity to perform those regional or areawide functions
which may be authorized by Federal or State Statute. To effectuate
such powers, the Governing Board of the Council shall:
a. Be the approving, contracting, and reviewing agent for
all Federal and State Regional Grants, as required;
b. Provide for regional transportation;
e. Provide for regional land use planning;
d. Provide for comprehensive areawide regional health
planning;
e. Re the governmental entity for the purpose of receiving
State or Federal assistance to areawide or regional governmental
entities.
Fo further effectuate such powers, the Governing Board of the
Council may exercise all powers set forth in C. R. S. Chapter 88,
Article 2, 1963 as amended, upon agreement of all interested
member jurisdictions.
