Billings Board of County Commissioners Weld County Court House Post Office Box 758 Greeley, CO 80631 Dear Sir: We inspected the Boxelder Sheep Company parcel of land located in the Sh of . 19, T. 8N, R. 65W, Weld County, Colorado on March 20, 1974 to determine if the holding ponds endanger Lone Tree Creek. The Weill County Health Department approved the said parcel of land for a livestock feeding operation provided: (1) The retention ponds be located 1000 feet frail the Lone Tree Creek (2) A permanent system shall be installed to pump the liquid waste fra:1 the retention ponds to the spray irrigation system. Installation of system to be at time of construction of livestock confinement area. • In September 1972, the Weld County Planning Commission recommended approval to the Board of County Commissioners, provided a sealed lagoon, as recommended by SCS and increasing the size to a total of 9.7 acre feet. The lagoon to be located at bank 400 feet fium the West bank of the Lone Tree Creek and a line installed to pump the waste up to the walking sprinkler as required by the Health Department. On November 29, 1972 the Board of Commissioners passed a Resolution that the application of Boxelder Sheep Company for a location for a cattle feedlot on the premise stated above, be granted under the conditions following: Petitioner shall construct a sealed lagoon as proposed and increase the size of same to hold at least 9.7 acre of water, and to be located at least 400 feet fLan west bank of Lone Tree Creek or also build a dike between said lagoon and Lone Tree Creek. Billings Page 2 March 22, 1974 After staff inspection of the site on March 20, we are still of the opinion that ponds would present less hazard to Lone Tree Creek if built as we recommended to the Weld County Planning Commission, 1000 feet fran the West bank. Since the feedlot construction is not euivlete at this time, it would seam timely to consider this matter further. Mr. Paul and I would be glad to confer with the members of the Board or we would be glad also to confer with the planning Ctroi.ssion if that is the desire of the Commissioners.
