As Director of the Oil & Gas Energy Department (OGED) and Director of Environmental Health Services (EH), we wanted to respond jointly to some of the points in your email. First, along with the BOCC, we have been working with the Town of Erie as well as Occidental Petroleum (Oxy) on various questions or concerns that have been brought to our attention over the last two months. We want to assure you that we listen, investigate and respond accordingly to questions or concerns we are made aware of. The Oxy Mae J location was approved prior to the new oil & gas rules you mention. Both Weld County and the COGCC reviewed and approved the permit under the rules in place at the time of submittal. The permits were submitted in February 2019 - prior to SB 181 being introduced and subsequently signed into law. In addition, the Town of Erie was a referral agency for both the county and state review process, in order to ensure the proximate local government had the opportunity to provide input on the permit submittals. Regarding your concerns related to air quality. It is important to note that sources of air pollution can be dynamic and that there are a variety of factors and conditions that can impact air quality and we will take your complaint under advisement. The air quality site that you were referencing in your submittal (Purple Air) uses limited data points to provide an Air Quality Index (AQI). Note that those types of sites are a good tool to use to help determine what personal decisions may be necessary based on personal health, outdoor activity, etc. However, the tool cannot be used as a direct correlation to any particular source as air currents, other local activity (continuing construction at the i subdivision for example), meteorological factors, etc., can affect the measurements of the monitor. It should also be noted that the air contaminate of concern with oil and gas operations is not typically particulates (PM10 and PM2.5- one of the data points AQI uses). In reference to air quality monitoring being conducted by Occidental. That information is tied to the Colorado Department of Public Health and Environment- Air Pollution Control Division (CPDHE-APCD) permitting process and request for information can be submitted directly to the company (but no requirement for release) or can be submitted to CDPHE-APCD (CORA request). I was not able to attend in person today as I am currently in the middle of an IVIG infusion at my home for my primary immunodeficiency . It would have been wonderful to have had an opportunity to speak virtually . My husband and I are Erie residents and Weld County taxpayers . We live less than a half mile from the Mae J mega well site that is conveniently situated in unincorporated Weld County, just 900 feet from my neighbors ' homes in Colliers Hill . For the past 6 week, since the sound walls went up around Mae J , concerned residents and I have been begging for real - time, continuous air quality monitoring . I am writing to voice my frustration regarding Weld County for allowing these mega pads just 900ft from my neighborhood AFTER SB- 181 went into effect on January 15 . Weld County and Erie are both to blame for allowing this harmful activity to take place despite the new 2000ft setback rules that Erie has . Our requests for adequate air quality monitoring have fallen on deaf ears . Allegedly, Occidental , the operator of Mae J , Papa Jo , and Yellowhammer have air quality monitoring, but refuse to show us the data . We have asked for reimbursement for air purifiers for our homes, and have only received canned responses from Occidental . Science has shown the negative health impacts on residents who live within a 1/2 mile of active wells . Just the other night, I saw a startling map showing the cancer and respiratory risk throughout Colorado, and Weld County is one of 13 counties with increased cancer and respiratory risks . A resident directly across from Mae J has a particulates monitor, and on February 28th , his system registered a particulates value over 600-- literally off the EPA chart . Yesterday and today the levels have been above 151, which is unsafe for all people according to the EPA ' s rating scale , not just sensitive individuals like me . The air toxics risk in Weld County, in terms of cancer and respiratory risks are unbelievably high . We are at extreme risk for cancer and respiratory problems .
