1. Describe the purpose of the proposed Change of Zone.
Response:
The rezoning is necessary to continue the use for vehicles, trucks, and farm equipment sale
(by virtual auctions).
2. Describe the current and previous use of the land.
Response:
The property has been used as an auction site — it is undeveloped. The property was
previously an agricultural farm.
3. Describe the proximity of the proposed use to residences.
Response:
Aristocrat Ranchettes lies more than 2 miles (12,000 ft) South along Hwy 85 and 2 miles
(10,528 ft) East along County Road 18.
4. Explain how the proposed rezoning will correct what the applicant perceives as faulty
zoning, or how the proposed rezoning will fit with what the applicant perceives as the
changing conditions in the area.
Response:
Rezoning this parcel will make the prior and current auction uses consistent with Weld
County zoning definitions. Properties to the north are already zoned as Commercial and the
Future Land Use and Comprehensive Plans determined this area as Commercial/ Industrial.
5. Explain how the uses allowed by the proposed rezoning will be compatible with the
surrounding land uses. Include a description of existing land uses for all properties adjacent
to the subject property.
Response:
The proposed zone allows Farm Equipment Sales as a Site Plan Review.
The proposed zone is compatible with the surrounding areas, developed commercial lots lie
north of the property (Parcel 130907400033 and Parcel 130907100006). Agricultural land
on the West side, Highway 85 runs along the East side of property and to the south
agricultural land and rural residence.
6. Does the soil report indicate the existence of moderate or severe soil limitations? If so, detail
the methods to be employed to mitigate the limitations for the uses proposed.
Response:
According to the USDA- NRCS Soils Report there are no soil conditions that limit the
proposed use (attached Soils Report). A pavement design and soils investigation is
enclosed to satisfy on site emergency access (Fire District).
7 Explain how this proposal is consistent with the Weld County Comprehensive Plan per
Chapter 22 of the Weld County Code.
Response:
According to the Weld County Comprehensive Plan Map Fig. 1, the site is within an
`Annexation" area. The applicant has indicated they do not desire to annex to the City of
Fort Lupton at this time.
The proposed zoning is consistent with the Highway 85 corridor between Greeley and
Brighton — commercial and industrial properties fronting the Highway 85 right of way.

8. Explain how this proposal will be compatible with future development of the surrounding
area or adopted master plans of affected municipalities.
Response:
Parcel 130907100006 recently annexed to the City of Fort Lupton is currently zoned C-2
(Heavy Commercial) in Figure 2 below.

9 Explain how this proposal impacts the protection of the health, safety and welfare of the
inhabitants of the neighborhood and the County.
Response:
The type of activities to be performed will be mostly virtual (auctions). The vehicles and Farm
equipment will be parked in the property that will be screened from the agricultural properties
to the west and south. Previously live in person auctions occurred 14 times /year that will
now occur almost exclusively online — thus traffic impacts will be reduced from those
occurring for the last 17 years.
10. Explain how this proposal complies with Article V and Article XI of Chapter 23 if the proposal
is located within any Overlay Zoning District (Airport, Geologic Hazard. or Historic Townsites
Overlay Districts) or a Special Flood Hazard Area identified by maps officially adopted by the
County.
Response:
The property in not located within any Overlay District (I-25 Overlay District is approximately
8 miles away and Greeley Airport Overlay District is approximately 12 miles from the
property).

Weld County staff has reviewed the COZ application submittal and has the following comments.
Please submit all items listed below to the Planning Department.
PLANNING COMMENTS: WEC RESPONSES 1/20/21
1. Clarify on the COZ draft plat map of what "Parcel #2" refers to? Is there a Parcel#1?
Before 2003 the parcel to the North was referred to as Parcel 1 and the current property
was Parcel 2. The current property owners purchased Parcel 2 and Parcel 1 was sold to
different owners and has been since been divided. Based on the current certificate of
conveyances/title binder the Parcel 2 callout has been removed.
2. Submit the signed Surrounding Property Owners Buffer Report. Each page of the buffer
report needs to be signed. The version submitted in the application materials only had
one of the three pages signed. Surrounding Property Owners Buffer Report is attached
with all pages signed.
3. Submit a Chain of Title or Certificate of Conveyances. The document shall not be more
than 30 days old. The title binder and Certificate of Conveyances are attached.
4. A Change of zone allows for a large potential host of land uses, structures and activities.
Approval of a COZ is not just for the proposed and associated Site Plan Review request.
Assuming that any use in the 1-3 zone may locate on this property, how will adequate
(including permanent) water and sewage disposal services be provided to this property?

COMPLETENESS REVIEW
A water well permit has been submitted to the State of Colorado Division of Water
Resources for the property and per the attached geotechnical report "Preliminary
Subsurface Exploration Report" by Earth Engineering Consultants, the on site soils are
satisfactory for an OWTS (final design to occur in the future) .
5. Submit the completed Fort Lupton Notice of Inquiry (NOI) form or equivalent
documentation. Submit the names and addresses of any owner, operator, or user of any
irrigation ditch, lateral, or pipeline that traverses the property, if applicable. The Fort
Lupton NOI was sent 10/16/20 and inquired again on 1/19/21. WEC has been in contact
with the Weld County Planner and Fort Lupton Planning Director and the NOI should be
received directly from Fort Lupton, if it has not been received already.
6. Submit a copy of an agreement with the owner of any ditch located on or adjacent to the
site, or written evidence that an adequate attempt has been made to mitigate the
concerns of the ditch owners. The agreement shall stipulate that ditch activities have
adequately been incorporated into the design of the site. If such agreement cannot be
reached, the applicant shall present evidence that an adequate attempt to reach such
agreement has been made, if applicable. i _ he owner has stated no current agreement
exists. The Farmers Reservoir and Irrigation Company has been contacted and a
response has not yet been received (see attached).
7. Submit a copy of an agreement with the mineral owners associated with the subject
property, if applicable. Such agreement shall stipulate that the oil and gas activities on
the subject property have been adequately incorporated into the design of the site, or
shall provide written evidence that an adequate attempt has been made to mitigate the
concerns of the mineral owners on the subject property, if applicable. See attached
documents "List of Mineral Owners and Mineral Lessees for Notification" by Zeren Land
Services, for all mineral owner agreements.
8. Submit the $8,000 COZ application fee. Checks can be addressed to "WELD COUNTY
PLANNING DEPARTMENT" or "WCPD". Please arrange to pickup the original check
that was submitted for $5,500 (check #29186) Noted.

1. Discuss the existing and proposed potable water source. If utilizing a drinking water well,
include either the well permit or well permit application that was submitted to the State Division
of Water Resources. If utilizing a public water tap, include a will serve letter from the Water
District, a tap or meter number, or a copy of the water bill.

Attached is the Application for a Water Well Permit and fees receipt.
2. Discuss the existing and proposed sewage disposal system is on the property. If utilizing
an existing on -site wastewater treatment system (OWTS), provide the OWTS permit number. If
there is no permit due to the age of the existing system, apply for a permit through the
Department of Public Health and Environment prior to submitting this application. If a new
OWTS system will be installed, please state "a new on -site wastewater treatment system is
proposed." Only propose portable toilets if the use is consistent with the Department of Public
Health and Environment's portable toilet policy.

See Project Geotechnical Report Titled PRELIMINARY SUBSURFACE EXPLORATION
REPORT dated January 19th, 2021, "Preliminary Soil Percolation Characteristics" on page 8
provides an acceptable percolation range of 5 to 15 minutes per inch which are satisfactory to an
OWTS to be designed in the future with future planned uses.

North access is 130 ft. from center of the intersection of HWY 85 and WCR 22.5. The main use
is for the oil and gas facility in the property and proposed use will be Commercial/Industrial.
Northwest access is 205 ft from the intersection of WCR 22.5 and WCR 25.5.
Southwest access is 996 ft from the intersection of WCR 22.5 and WCR 25.5
2. Describe any anticipated change(s) to an existing access, if applicable.
Response:
No Changes are proposed for the existing access.
3. Describe in detail any existing or proposed access gate including its location.
Response:
Existing 15 ft chainlink security gate is located approximately 820 feet from the centerline on
WCR 22.5, on the existing dirt road.
4. Describe the location of all existing accesses on adjacent parcels and on parcels located
on the opposite side of the road. Include the approximate distance each access is from an
intersecting county road.
Response:
Property to the North (on opposite side of WCR 22.5) - the access is 440 ft from the intersection
of HWY 85 and WCR 22.5, and 335 ft from the intersection of WCR 22.5 and WCR 25.5
Property to the Northwest (on opposite side of WCR 25.5) — the access is 205 ft from the
intersection of WCR 22.5 and WCR 25.5.
Property to the West (on opposite side of WCR 25.5) — the North access is 386 ft from the

RE: Trip Generation Estimate for the Troyer Property in Weld County
Dear Chad,
Based on your request, I have prepared this trip generation estimate for the Troyer Property. The
site is located on the southwest corner of US 85 / WCR 22.5. It is proposed for on-line auctions of
vehicles and farm equipment. A vicinity map is contained in Figure 1 and a site plan is contained
in Figure 2. Currently, the site can be accessed from US 85 through a full movement intersection
at WCR 22.5 and a right -in / right -out intersection at WCR 25.5. However, CDOT and Weld County
are proposing to close the WCR 22.5 intersection in the future. The site access is planned from
WCR 25.5.
A trip generation estimate was prepared based on information provided by the owner because this
land use is not contained in the Institute of Transportation Engineers (ITE) Trip Generation'
manual. The site has capacity for 50 to 100 vehicles. An average of 1.5 auctions are planned per
month which equates to approximately 18 auctions per year and an average of 14 weekdays
between each auction. Vehicles are expected to arrive on weekdays prior to each auction with 10
to 20 vehicles to be delivered prior to each auction. If the reserve bid is not met, the vehicle will
not be sold and will be held for the next auction. Two trip generation scenarios were developed
including a worst case scenario and an average scenario. The following assumptions were used in
the scenarios.
Worst Case Scenario (Assume 100 vehicles delivered between auctions)
• 7.1 vehicles will be delivered each weekday. Three trips are assumed with each delivery
including two inbound trips and one outbound trip.
• Two employees will be on -site to receive deliveries. Assume four trips with two inbound
trips and two outbound trips.
Average Scenario (Assume 20 vehicles delivered between auctions)
• 1.4 vehicles will be delivered each weekday. Three trips are assumed with each delivery
including two inbound trips and one outbound trip.

Good Afternoon Mr. Miller,
Thank you for your time today. As I understand per our phone call —the existing concrete irrigation lateral is a private lateral
that is fed from the Platteville Irrigation and Milling Company Ditch east of Highway 85 and flows west along the north boundary
of the Troyer property across WCR 25.5 and onto Miller Family Farms. Miller Family Farms owns and uses this private lateral
(no other owners).
For reference we have attached the overall site plan to be submitted on behalf of Mr. Troyer as part of his rezoning and Site Plan
Review for virtual auctions on the property.
Mr. Troyer's use of his property will not impact or encroach within 15 feet of the existing private concrete ditch lateral. Also as
we discussed, the County has requested we limit access from WCR 22.5 onto Mr. Troyer's property to be strictly oil and gas and
all other access to the Troyer property (for auction or owner purposes) will occur from WCR 25.5 as shown (2 existing access
points off WCR 25.5).

door. Patricia and I had this property rezoned in 2005 to hold hay
auctions and farm equipment consignment auctions. We, along with
many of you have been impacted by the Corona Virus and we are trying
