RE: APPROVE QUIT CLAIM DEED TO TRANSFER PROPERTY FROM WELD COUNTY TO
JAMES AND ALICE SMITH AS PART OF THE COUNTY ROAD 49 CORRIDOR
PROJECT AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Quit Claim Deed to transfer property
from Weld County to James and Alice Smith as part of the County Road 49 Corridor Project and
in accordance with certain agreements associated with said Project, and
WHEREAS, after review, the Board deems it advisable to approve said Quit Claim Deed,
a copy of which is attached hereto and incorporated herein by reference, and to authorize the
Chair's signature thereon.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Quit Claim Deed to transfer property from Weld County to James
and Alice Smith as part of the County Road 49 Corridor Project and in accordance with certain
agreements associated with said Project, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said Quit Claim Deed.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 24th day of November, A.D., 2021.

SUBJECT: Quit Claim Deed — Weld County to James R. and
Allison B. Smith
Back in 2018, just after the Weld County Highway project was completed, Weld County started
a land swap process with Mr. James Smith and his wife Alice Smith. Their property is located in
the southwest corner of the intersection of WCR 49 and WCR 50. This land swap was one of
the last pieces to be completed as part of the punch list for the highway contractor. The Weld
County Board of County Commissioners at the time agreed to the land swap in order to allow
the contractor to complete the necessary drainage improvements in that area and complete the
overall project. All of the steps necessary to completing this land swap have occurred except
for the last one. Those steps were:
1. James and Alice Smith granted possession in use of the necessary small slivers of ROW
needed along the south side of WCR 50 to complete the drainage improvements in that
area. (Complete)
2. Relocated the existing water service on the Weld County owned lot to an area that will
not be part of the swap. (Complete)
3. James and Alice Smith granted the property needed along the south side of WCR 50 to
Weld County. (Complete)
4. Clean up of all construction debris and re -vegetation of disturbed areas. (Complete)
5. Weld County to transfer ownership of a portion of Parcel 105501000047 to offset the two
small portions of land transferred by James and Alice Smith to Weld County.

QUIT CLAIM DEED
THIS DEED is made thiso74'day of ( mvember, 2021, from Weld County, a political
subdivision of the State of Colorado, by and through the Board of County Commissioners of the
County of Weld, whose address is 1150 O Street, P.O. Box 758, Greeley, CO 80632
("Grantor"), and James R. and Alice B. Smith, whose address is 23798 CR 50, LaSalle, CO
80645, hereinafter referred to as "Grantee".
WITNESSETH, that the Grantor, for sufficient consideration, the receipt whereof is
hereby confessed and acknowledged, has remised, released, sold, conveyed and QUIT
CLAIMED, and by these presents does remise, release, sell, convey and QUIT CLAIM unto the
Grantee, its heirs, successors and assigns, forever, all the right, title, interest, claim and demand
which the Grantor has in and to the parcel of land situate, lying and being in the County of Weld
and State of Colorado, to wit:

RESERVING unto Grantor the mineral estate under the Property, including but not limited
to all oil, gas, shale, coal and other minerals and mineral rights and any and all water and water
rights, including any and all right, title, and interest in and to dry -up credits currently attached to
or associated with the Property, except as required to sustain the integrity of the surface estate
granted herein.
TO HAVE AND TO HOLD the same, together with all the appurtenances and privileges
thereunto belonging or in anywise thereunto appertaining, and all the estate, right, title, interest
and claim whatsoever, of the Grantor, either in law or equity, to the only proper use, benefit and
behoof of the Grantee, heirs and assigns forever.
IN WITNESS WHEREOF, the Grantor has executed this deed on the date set forth above.
