Home My WebLink About730650.tiff 'W - .J/y% RESOLUTION WHEREAS, a public hearing was held on June 25, 1973, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Ronald Pappenheim, Route 1, Box 197, Eaton, Colorado, requesting permission to locate a cattle feed lot operation on the following described property, to-wit: Southwest Quarter of the Southwest Quarter of the South- west Quarter (SWISW4SW4) of Section Twenty-three (23), Township Seven (7) North, Range Sixty-five (65) West of the 6th P. M. , Weld County, Colorado, con- taining 10 acres, more or less, and, WHEREAS, the petitioner was present, and WHEREAS, there was some opposition to the request of petitioner for the location of said cattle feed lot operation, and WHEREAS, the said requested cattle feed lot operation is located in an Agricultural Zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution of Weld County, said cattle feeding operation or any expansion thereof may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner, and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Ronald Pappenheim, Route 1, Box 197, Eaton, Colorado, for location of a cattle feed lot operation on the premises indicated above be, and it hereby is granted under the con- ditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to construct said cattle feed lot operation and shall have up to one year from date hereof to begin such construction. 3. Location of pens in the Southeat Corner of said cattle feed lot operation shall be no nearer than 660 feet from residents on County Road No. 78. 4. That said feed lot operation shall have a minimum set back of 50 feet from the right of way on County Road No. 45. PL0750 730650 r 5. That when said cattle feed lot operation is completed same shall be limited to pen size as indicated on plans as submitted. 6. All applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the zoning resolutions of Weld County, Colorado. Dated this // day of July, A. D. 11 May 1973 Re: Dianna French TO WHOM IT MAY CONCERN: Dianna French, a 10 year old girl, has hayfever from March to November requiring fairly continuous medica- tion which barely controls her symptoms. She was evaluated for allergies and was found to have marked reactions on skin testing. It would be highly undesirable for this child to have to live near a feed lot which in addition to the animals has a great deal of mold with the spores carried over fair distances and causing difficulty for people allergic to them. The closer the person is to the source, the greate5 of course, would be his exposure. In addition to the allergic factor, allergic people also over-react to such non-specific stimuli as odors which certainly would be present in a feed lot. I therefore feel it would be better for this child if she did not have close exposure to this type of environmental pol- lution. Lorenson stated that the recommendations were based on the location that is on the map and both on the basis of the Soil Conservation Service information and the Health Department . A study shows that some 1705 recreational vehicles a day pass this location a day during the tourist season . They have a curb cut off the service road instead of Highway 7 to eliminate any possibility of congestion as a result of the expansion of Highway 7 . There will be no permanent facilities for mobile homes . Have the well permit for the campground . The roads will not be black topped . They are planning to use peneprine surfaced streets . (This was not mentioned in the application . ) The State had no objections to this . Mr . Paul (Weld Co . Health Dept . ) asked if they had a chemical analysis of the water . The Planning staff recommends this for approval because it agrees with the Land Use Policy in providing services to the traveling public ; and it is compatible with uses and zoning on south ( KOA Campground ) and west . If approved , should be subject to : The Health Department ' s request for a chemical analysis of the well . 1 ) Putting the P . U . D . in final form considering the following changes : a ) Access on west service road with no access shown on State Highway 7 ; b ) Lable drainage retention pond and show on P . U . D . ; c ) Change store location to west entrance as shown on drainage plans ; d ) Change water and sewer plan to show service to new store location ; e ) Change electrical system plan to reflect the above entrance change , etc . ; and 2 ) Changing the utility plan as requested by the Utility Board as follows : "Showing of easements for utilities , natural gas plus power of 20 ' , and label as such and show lines of 6" with hydrant facilities with a licensed operator in accordance with the size of the facility . " (Health Department stated that they would not approve it unless they had a licensed operator and also a contractor to maintain them . ) (Mr . Evans submitted a con- tract with Charles Tregay , City of Boulder Sewage Plant for this . ) "Also subject to the drainage retention pond , which has now been added to the drainage plans . The Brighton Fire Department indicated that they prefer 6" lines and hydrants . They also indicated the exact type of hydrants that they would request for fire protection . SUBJECT : Field Checks by Specific Board Members DISCUSSION : It was felt that a better understanding of the cases could be had if the Board members could field check those concerned in their areas . If a regular Board member could not make the field check for various reasons , the alternate could make it from the floor . 890 SUBJECT : Fees 1 Special Use Permits DISCUSSION : It was proposed to place a $50 . uu fee on all Special Use Permits in order to cover the cost of advertising the legal description . If the Planning Office goes ahead and pays for the advertising out of a set fee , then the Office would be able to iniate the advertisement and the Planning Commission could hear it one week and the County Commissioners could hear it the next week , thus speeding up the process procedure quite a bit . SUBJECT : Tom Clark - Zone Change (Washington Mines ) DISCUSSION : Mr . Clark had a zone change from A to C that was on a conditional basis for 12 months . The 12 months have gone by and the fences are still not available . Therefore , does the Commission want to take any action against the installation or recommend to the Board of County Commissioners any action concerning the installation of the fence around the site .
