The primary use on this property is a Christian Church called Faith Lutheran Church which has operated a preschool on the property continuously since 1981. The Church has contracted with In the Beginning Infant and Toddler Center to operate a preschool on the property. 2. The mission of the Evangelical Lutheran Church of America, of which Faith Lutheran is a member, is: "Together in Jesus Christ we are freed by grace to live faithfully, witness boldly and serve joyfully." One of the ways we serve our community is by providing space for a preschool where parents can bring their children for safe and nurturing care. There has been a waiting list for the preschool attendance, and we expect this to continue to grow as the community grows. 3. The church has been in operation on this site since 1965 and the preschool has been in operation since 1981. The previous use was ag. 4. When the church was built, the nearest residence was approximately 500 feet to the south. Today there is a residence approximately 150 feet to the west across WCR 37. Another residence was built approximately 170 feet to the south. 5. The property to the south is residential. The property to the north is commercial. The property to the east and west is irrigated ag. The church has been in operation for over 50 years with no issues and is very compatible with the area. The only changes being considered are to remodel the interior and change the use of the former parsonage from two residential rental units to a preschool and increase the preschool capacity from 28 students to 45 students. 6. Sunday 9:00 a.m. - 7:30 p.m. ; Monday, Tuesday, Wednesday, Thursday and Friday, 7:00 a.m. — 5:30 p.m. 7. There will be 5 staff at the preschool to start and 7 or 8 when at full capacity. The church has one full- time pastor. There will be no shift work at this site. 8. During the week there would be approximately 40 parents, 45 students, plus 8 to 10 staff and volunteers between the church and the preschool. Sunday services for 40 to 70 people are expected when they resume after the pandemic. The church sanctuary can accommodate 210 people. 9. No animals are kept on site. 10. General office equipment only. 11. All structures are existing. The church building is a one-story brick structure with vaulted ceilings in the sanctuary and fellowship hall. It is used for worship, fellowship, classrooms and office space. The former parsonage is a one-story brick building with a full basement that will be used for preschool rooms. The parsonage basement was used for Sunday School classrooms in the past. 12. None 13. One small dumpster trash pickup per week. 14. No new construction — interior remodel only to be completed by November 1, 2020. 15. Existing paved parking spaces — 80 regular spaces plus 3 handicap -accessible spaces 17. There is existing 3' high barbed wire fence along the U. S. Highway 85 ROW and south property line. The lawn area east of the Preschool (former parsonage) and the playground east of the yard are fenced with 48" chain link fencing. There is no outdoor storage on site. 18. Landscaping with irrigated sod, native grass, mature trees, shrubs and flowers covers more than half of the property. 19. There will be no reclamation necessary for the existing improvements on the site. 20. An automatic fire sprinkler system has been installed for the entire preschool building. There is an existing fire hydrant located at the NW corner of Cheyenne Ave. (WCR 37) and 7th Street, which is 500' from the church property. Fire and smoke alarms are located throughout the church buildings along with fire extinguishers. 21. The existing church and preschool are compatible with and support current land uses in the area and will promote the spiritual, physical and economic well-being of current and future residents of Weld County. This proposal will allow the church and preschool to meet the growing need for these services as the community grows. 22. Faith Lutheran Church and In the Beginning Infant and Toddler Center serve many farm families and the families of businesses that support the agricultural community. No agricultural land will be taken out of production by the approval of this application. 23. This application is simply to allow the preschool operated on the Church's property to expand its maximum capacity from 28 children to 45 children. There are no expansions or exterior physical changes proposed for the existing buildings, parking lot or any associated facilities, other than adding a handicap access ramp to the former parsonage building. The Church and preschool that have existed at this site for 55 years and 39 years, respectively, have had no issues with any neighboring property or community. The fact that there has been a waiting list for parents wanting their children to attend this preschool is a sure sign that there is a need for this expansion in our community. 24. The expansion of the capacity for the preschool will help meet a current need for more child care facilities in our community that are safe and convenient. Having adequate classrooms to serve children from infants to six years of age means parents can enroll all of their children in one facility which saves them time and mileage while reducing congestion on our streets. 25. The church property is a parcel that was created when U. S. Highway 85 split it from the main farm to the east. The owners of the farm transferred this small corner of the farm, that was physically separated from the main farm, to the church in 1964. A small domestic well is used to irrigate the landscaping. 26. Parts of the northern and eastern areas of the church property are located withing the 100 -year floodplain but outside of any floodway. All buildings and parking lot improvements are located above and outside of the floodplain. 27. A license from the State of Colorado Department of Human Services, Office of Early Childhood, Division of Early Care and Learning, is required for In the Beginning iTC to operate a child care facility at 36980 CR 37, Eaton, CO, and a copy is attached. This same office requires ongoing training for directors of child care centers and a transcript for Maria Kieler is attached. Copies of passing inspection reports are attached for the Weld County Department of Public Health & Environment and the Eaton Fire Protection District. Inspections have been scheduled for the remodeled parsonage and will be obtained prior to moving the child care center to this facility. "in the Beginning" Preschool Infant & Toddler Center (at Faith Lutheran Church) 36980 Weld County Road 37 Eaton, Colorado Use By Special Review (USR) October 11, 2020 Public Works Questionnaire 1. The Church/preschool property is bordered by Weld County Road (WCR) 37 to the west (also known as Cheyenne Avenue in Eaton); WCR 76 to the north; U.S. Highway 85 right-of-way to the east and a private residential lot to the south. Access to the Church/preschool is off WCR 37, which is a paved, two-lane roadway (60' wide right-of- way). The existing access is approximately 235 feet wide (which includes 18 existing parking spaces). The north end of this access is located about 480 feet to the south of WCR 76. No new access is proposed with this USR. 2. There are no changes proposed to the existing access. 3. There are no existing or proposed access gates for the Church property. 4. An existing private residence access is located on the west side of WCR 37 approximately 665 feet south of WCR 76. 5. There are no sight distance issues with the current Church/preschool property access. 6. WCR 37 is a straight (north/side) roadway adjacent to the Church property. 7. The existing WCR 37 roadway, adjacent to the Church/preschool access, slopes to the north at an estimated 1.3 percent. ENVIRONMENTAL HEALTH QUESTIONNAIRE 1. Potable water for this property is served by the North Weld County Water District, Account # 1435000. 2. Sanitary sewer service is provided by the Town of Eaton, Account # 1607510-01 3. No storage or warehousing on this site. 4. No wastes, chemicals or petroleum stored on site. 5. No fuel stored on site. 6. No washing of vehicles or equipment done on site. 7. Only floor drains will be domestic bathroom and kitchen drains that are connected to sewer. 8. No painting or other emissions from this site. 9. No composting, landfills or other activity requiring an operations plan. 10. No feeding of animals or other need for management plan. DRAINAGE NARRATIVE The subject property is located in the NW % of Section 31, T7N, R65W, in Weld County, Colorado. It lies between U. S. Highway 85 and CR 37, south of and abutting CR 76. The southern boundary of the property abuts the Eaton Town Limits. The southern property line is also at the approximate high point of CR 37 where the drainage basin splits between draining to the north or to the south. The following narrative addresses why this property, and the Church's application for a USR, qualify for an exception per the Weld County Code. 1. This property is the home of Faith Lutheran Church which has existed on this site since 1965 and has included a preschool since 1981. The demands for the preschool have grown and this USR application is a request to increase the maximum number of children served from the current cap of 28 to a capacity of 45 children. We are in the process of remodeling the parsonage building to allow it to be used for a preschool. In the recent past the parsonage was used as a rental for two families, and prior to that served as the home for our pastors as well as for Sunday school rooms in the basement. There will be no change to any building footprint or other improvements on the property. The Church has adequate paved parking and all other facilities required to serve the increased number of preschool children using existing improvements. 2. The church qualifies for an exception to the requirements for stormwater detention under two of the uses listed in Weld County Code, Article XI, Division 1, Sec. 8-11-40. -Drainage Policy, paragraph I. These uses would be: number 8. Development of sites where the change of use does not increase the imperviousness of the site.; and number 11. An individual parcel with an unobstructed flow path and no other parcels) between the Federal Emergency Management Administration (FEMA) regulatory floodplain channel and the project. 3. No water flows onto the property from an off -site source. CR 37 is the property's western boundary and any runoff from the single house and small irrigated field to the west flow to the north along the west side of CR 37 to CR 76 and then east. The southern boundary of the property sits at the high point of CR 37 and property to the south and east. The vacant property directly south drains to the east from CR 37 to the U. S. Highway 85 right-of-way and then north within that ROW. Any runoff from the U. S. Highway 85 ROW to the east is collected within the ROW and flows north to CR 76. CR 76 and property to the south of CR 76 drains to the south and east into the Eaton Draw. 4. Runoff from the Church property sheet flows across the open space along the east and north parts of the property and is directed north across CR 76 and east across U. S. Highway 85 into the Eaton Draw. 5. The property slopes gently to the north and east with runoff from the buildings and parking lot directed onto the open space/native grass at the northern end of the property. 6. There have been no drainage problems with this property. 7. There are no irrigation facilities on or adjacent to the property. 8. A small percentage of the property along the U. S. Highway 85 ROW and at the north end of the property along CR 76 lie within the Federal Emergency Management Administration (FEMA) 100 -year floodplain. The floodplain elevation is well below the elevation of any building or any part of the parking lot surrounding the buildings. In summary, there will be no increase in impervious areas or runoff since all buildings and parking areas are existing, and there have been no drainage issues experienced with this property. Therefor, no stormwater detention will be required for this site. Preliminary Traffic Impact Analysis — Traffic Narrative: Since this USR doesn't include a proposed development on a Commercial or Industrial zoned property or a residential subdivision greater than nine (9) lots, a Traffic Impact Study (TIS) is not anticipated to be necessary. The existing preschool currently has a staff of 4 (for up to 28 children) and will increase to 7 or 8 at full capacity (45 children). The Church has a full-time Pastor. During the week, there would be approximately 40 parents plus 8 to 12 staff and volunteers between the Church and the preschool. Sunday Church service attracts from 40 to 70 people, on the average. 1. The estimated daily traffic for the Church/preschool is shown below: Preschool: Passenger cars/pickups — 48 roundtrips per weekday Church service — 35 roundtrips (one service on Sunday morning) Trash pickup (one 3'x 5' dumpster for the entire facility) — one garbage truck roundtrip per week 2. Traffic enters the site off WCR 37 (a paved, two lane roadway that borders the Church property on the west side) with most traffic coming and going from the south on Cheyenne Avenue (WCR 37) in Eaton. The north side of the Church property is bordered by WCR 76. There is a Stop sign for north bound traffic on WCR 37 at the intersection with WCR 76. A traffic signal exists at the intersection of WCR 76 and U.S. Highway 85. 3. We estimate that 65% of the traffic will come from the south along Cheyenne Avenue; 10% of the traffic will come from the west on WCR 76, 20% will come from the east on WCR 76, 5% would come from the north on U.S. Hwy 85 to WCR 76. 4. The highest traffic volumes will be as shown below: a. Preschool (weekdays) — 6:45 to 7:00 am drop-off; 3:30 to 5:30 pm pick-up b. The Planning Department previously approved the former Child Care Center at this location as detailed in a letter dated October 14, 2014. At that time, the operation was permitted to have up to twenty- six (26) children. This limit was reaffirmed in a letter dated June 4, 2019. Recently, Planning staff discovered an additional letter written by staff, dated May 11, 2015, which noted that up to twenty-eight (28) children may be at the Child Care Facility. Given this finding, Planning staff will allow up to twenty-eight (28) children in order to preserve the historic parameters of this operation. Child Care Centers currently require a Use by Special Review (USR) Permit per Section 23-3-40.T of the Weld County Code. However, as the October 2014 and May 2015 letters stated, it was determined that a Child Care Center was in operation at this location at least as far back as June of 1981. This was prior to the County Code requirement that a USR is required for a Child Care Center. Therefore, no County land use permits are required at this time. Essentially, this means the use is grandfathered; however, if there are any deviations to the facility or operations, a USR is required. This letter shall serve as Planning and Zoning approval of your request and shall replace the letter dated June 4, 2019. As a result, I will run them through the USR process for both the church and child care center. This is the first pre -app under the new LEAN process.
