HomeMy WebLinkAbout20211259.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MONDAY, MAY 10, 2021 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, May 10, 2021, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Steve Moreno, Chair Commissioner Scott K. James, Pro -Tern Commissioner Perry L. Buck Commissioner Mike Freeman Commissioner Lori Saine - EXCUSED Also present: County Attorney, Bruce Barker Clerk tO the Board, Esther Gesick Controller, Barbara Connolly • MINUTES: Commissioner James moved to approve the Minutes of the Board of County Commissioners meeting of May 5, 2021, as printed. Commissioner Buck seconded the motion, and it carried unanimously. le CERTIFICATION OF HEARINGS: Commissioner Freeman moved to approve the Certification of Hearings conducted on May 5, 2021, as follows: 1) USR18-0130 — City of Thornton. Commissioner James seconded the motion, which carried unanimously. El PUBLIC INPUT: No public input was given. • AMENDMENTS TO AGENDA: There were no amendments to the agenda. • CONSENT AGENDA: Commissioner James moved to approve the Consent Agenda, as printed. Commissioner Buck seconded the motion, and it carried unanimously. COMMISSIONER COORDINATOR REPORTS: Commissioner Buck reported the Department of Human Services has issued approximately $1,120,000.00 in Emergency Rental Assistance funds, processed 793 requests, and evaluated 529 households. She stated the Area Agency on Aging will be recognizing May as Older Americans Month, and the Family Support and Visitation Center has been diligent in providing virtual and in -person services to Weld families. Commissioner James stated former Severance Mayor, Don McCloud, has resigned as Chair of the North Front Range Metropolitan Planning Organization (NFRMPO), thus, Berthoud Mayor, Will Karspeck, was appointed as the new Chair, with Minutes, Monday, May 10, 2021 05/arsraoaI Page 1 2021-1259 BC0016 Larimer County Commissioner Kristin Stevens appointed to represent the NFRMPO at the Regional Air Quality Control Council, and Commissioner James is serving as the Vice Chair. Lastly, he stated he will be testifying at the capital today in opposition to Senate Bill 260 (Sustainability of the Transportation System). • PRESENTATIONS: 1) RECOGNITION OF SERVICES, JUVENILE COMMUNITY REVIEW BOARD - SARAH MOLINAR: Chair Moreno read the certificate recognizing Ms. Molinar for her four (4) years of voluntary service. PROCLAMATIONS: 1) NATIONAL POLICE WEEK - MAY 9-15, 2021; NATIONAL PEACE OFFICERS MEMORIAL DAY - MAY 15, 2021; AND WELD COUNTY FALLEN OFFICER MEMORIAL TRIBUTE CEREMONY- MAY 13, 2021: Chair Moreno called for a moment of silence, followed by a reading of the certificate proclaiming each of the dates in honor of Police and Law Enforcement Services and Memorials. Sheriff Steve Reams stated a ceremony will be held at the Fallen Officers Memorial in Bittersweet Park, Greeley, on Thursday, May 13, 2021. The Commissioners, in turn, honored those who have fallen in the line of duty, and committed to uphold, support and respect law enforcement agencies who are sworn to protect the public. (Clerk's Note: The group gathered for a photo opportunity.) • WARRANTS: 1) GENERAL WARRANTS - MAY 5, AND 7, 2021: Commissioner James moved to approve the General Warrants, as printed. Commissioner Freeman seconded the motion, and it carried unanimously. • BIDS: 1) PRESENT BID #B2100095, GUARDRAIL, BRIDGE RAIL, AND CABLE REPAIR SERVICES WITH OPTIONS FOR 2022 AND 2023 - DEPARTMENT OF PUBLIC WORKS: Barbara Connolly, Controller, noted 31 suppliers downloaded the specifications, presented the sole bid received and stated staff will make a recommendation on May 24, 2021. • NEW BUSINESS: 1) CONSIDER APPOINTMENTS TO AREA AGENCY ON AGING ADVISORY BOARD: Commissioner James moved to approve said appointments. Commissioner Buck seconded the motion, and it carried unanimously. 2) CONSIDER APPOINTMENT TO CHILD PROTECTION CITIZEN REVIEW PANEL: Commissioner Freeman moved to approve said appointment. Commissioner James seconded the motion, and it carried unanimously. • 3) CONSIDER APPOINTMENT TO EXTENSION ADVISORY COUNCIL: Commissioner James moved to approve said appointment. Commissioner Freeman seconded the motion, and it carried unanimously. 4) CONSIDER REASSIGNMENT ON JUVENILE COMMUNITY REVIEW BOARD: Commissioner Freeman moved to approve said reassignment. Commissioner Buck seconded the motion, and it carried unanimously. Minutes, Monday, May 10, 2021 Page 2 2021-1259 BC0016 e 5) CONSIDER APPOINTMENT TO JUVENILE COMMUNITY REVIEW BOARD: Commissioner James moved to approve said appointment. Commissioner Buck seconded the motion, and it carried unanimously. PLANNING: 1) CONSIDER APPLICATION FOR SMALL BUSINESS INCENTIVE PROGRAM AND AUTHORIZE RELEASE OF ECONOMIC DEVELOPMENT TRUST FUNDS (TIER I) - THE DOG BARN, LLC, 0/O BRIAN AND SARAH CARR: Tom Parko, Director of the Department of Planning Services, stated the Use by Special Review (USR) permit was approved in 2018, the applicants recently completed a Minor Amendment and they are successfully growing their business. He requested an update to release $14,904.70, which includes the $2,500.00 USR application fee. Commissioner James endorsed the value of the program and moved to approve said application and authorize the release of funds. The motion was seconded by Commissioner Buck, and it carried unanimously. la 2) CONSIDER REQUEST FOR EXTENSION OF SUBMITTAL OF SITE SPECIFIC DEVELOPMENT PLAN AND PLANNED UNIT DEVELOPMENT (PUD) FINAL PLAN IN REFERENCE TO CHANGE OF ZONE, Z-570 - OLSON BROS., LP: Chris Gathman, Department of Planning Services, stated the applicant has submitted a request for a two-year extension of the deadline for submittal of the PUD Final Plan. He reviewed the case history timeline, reported there are new Coordinated Planning Agreements and revised Comprehensive Plan maps that are now in place, and detailed the revised layout reducing the number of E (Estate) lots from eight (8) down to four (4), with a large agricultural lot containing a pivot irrigation system. Based on the amount of time that has lapsed and the proposed changes, staff recommends the applicant submit a Sketch Plan and then apply for a PUD Final Plan to be reviewed by the Board of Commissioners, since the layout differs from the Change of Zone (COZ) originally approved in 2002. Additionally, the applicant will be instructed to contact the Town of Johnstown to address the possibility for public water and sewer. Matt LeCerf, Town of Johnstown Manager, stated they have no objection to the revised application, due to the reduced number of lots and decreased density. IR Kelsey Bruxvoort, AGPROfessionals, LLC, represented the applicant and confirmed the project has not been abandoned and the applicant possesses the willingness and ability to complete and record the plat. She displayed a PowerPoint presentation, confirmed the Town of Johnstown is negotiating to install a 16 -inch watermain across the property affording residential, and detailed the new site design, water taps and fire hydrants. Ms. Bruxvoort provided a brief overview of the project history, summarized recent developments in the area and referral requirements, and detailed their plan for completion. a In response to Commissioner Freeman, Ms. Bruxvoort stated the applicant is agreeable to an 18 -months extension as recommended by Planning Services. Responding to Commissioner James, Mr. Gathman confirmed, based on the response from the Town of Johnstown, there would be the ability to obtain residential water taps. Commissioner James moved to approve said request, with said PUD Final Plan application to be submitted no later than Monday, November 14, 2022, at 9:00 a.m. Commissioner Freeman seconded the motion, and it carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved.
