RESOLUTION RE: ACCEPT PETITION AND AUTHORIZE VACATION OF PUBLIC ROAD RIGHT-OF-WAY LYING WITHIN LOT D OF RECORDED EXEMPTION, RECX13-0122 - RONALD AND TRINA ERBES WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Petition for Vacation of Right -of -Way from Ronald and Trina Erbes, 43680 County Road 37, Pierce, Colorado 80650, a copy of said petition and a list of the adjoining property owners marked Exhibit A, being attached hereto and included by reference, requesting vacation of a portion of public road right-of-way lying within Lot D of Recorded Exemption, RECX13-0122, being more fully described as follows: The public road right-of-way described in Road Viewers Report dated May 16, 1902, and recorded on July 16, 1902, in Book 83, Page 285, Reception Number 86027; lying within Lot D of Recorded Exemption, RECX13-0122; being part of Section 30, Township 8 North, Range 65 West of the 6th P.M., Weld County, Colorado, as further described in Exhibit B WHEREAS, the Department of Public Works has recommended approval of said request since that portion of right-of-way is not needed for the safety and welfare of the traveling public, and WHEREAS, any persons owning dedicated and recorded easements and rights -of -way for the use of the right-of-way to be vacated, if any, may continue such use after formal vacation by Weld County, and WHEREAS, the Board of County Commissioners heard testimony and reviewed all other evidence presented therein by staff and the public, and WHEREAS, the evidence showed that the vacation of that portion of right-of-way which is described above will not leave any land adjoining the roadway without an established public road or private access easement connecting the land with another established public road, and WHEREAS, the Board of County Commissioners deems it advisable to vacate said portion of right-of-way, with said vacation to become effective upon recording as required below. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Petition for Vacation of Right -of -Way from Ronald and Trina Erbes, be, and hereby is, accepted. BACKGROUND Public Works has received a request to vacate unbuilt historical ROW for County Road 90 between Weld County Road 37 and Weld County Road 39. The Petitioners are requesting to vacate a portion of the Public Road Right of Way (ROW) described in Road Viewers Report dated May 16, 1902 and recorded on July 16, 1902 in Book 83, Page 285, Reception Number 86027. Specifically, the request is to vacate that portion of ROW lying within Lot D of Recorded Exemption RECX13-1022. The Petitioners own the property directly adjacent to the ROW on both sides however, the most recent Recorded Exemption did not show the presence of the historical ROW. No other parcels will be landlocked if the ROW within Lot D is vacated. The ROW to be vacated follows the section line lying between Section 19, Township 8 North, Range 65 West of the 6t1i Principal Meridian on the north: and Section 30, Township 8 North, Range 65 West of the 6t1i Principal Meridian on the South. There is no roadway within the ROW as physical County Road 90 lies north of the historical petition and is bound on both sides by platted lots; RE -1256 to the north and RECX13-0122 to the south. The land within the road petition is cultivated ag land and does not appear to be encumbered by any obvious public utility. HISTORICAL ROAD RIGHT OF WAY The road file identifies the historical ROW as road #452 however, the public roadway is now known as County Road 90. Review of the road file suggests the alignment may not have be centered on the section line as evident in a Quit Claim conveying the road ROW to the County nearly 40 years later. The Quit Claim includes language that the ROW was to connect with the "present established public highways at the east and west ends respectively to the strip of land". The Quit Claim for deed for the road ROW was conveyed on January 5, 1942 to Weld County on January 5, 1942 recorded at reception number 889382. This deed describes the location of County Road 90 as it exists today. County Road 90 is currently a county -maintained roadway and is identified on the Classification Map as a Collector roadway. Included with the referral is the complete Road File. PROPERTY INFORMATION The subject property is zoned Agricultural and is currently being used as cultivated farmland. The has been subdivided through the Recorded Exemption process multiple times however, the right of way was not shown on any of the plats. The following Recorded Exemptions have been done on the property: • RE 775 reception number 2020776 in 1985 • RE 1751 reception number 2455371 in 1995 • RECX13-0122 reception number 4011671 in 2014 The public ROW traverses through property creating a triangular silver that impacts the building envelope as the Weld County Code requires setbacks to be measure from public right of way or future ROW. This creates a unique situation on this parcel as a setback would be required from the physical CR 90 as well as the historical ROW which minimizes the landowners best use of the property. EXISTING UTITLTIES Based on the application material and review of aerial imagery available the existing public utilities in the area appear to be located within the deeded ROW adjacent to CR 90 as currently constructed. ADJACENT MUNICIPALIES No part of the ROW to be vacated is located within no other the municipal boundaries. The right of way is approximately 1.5 miles east of the Town of Pierce and 2 miles north of the Town of Ault. Based on the IGA Boundary shown on the Weld County Property Portal approximately 900 feet of the ROW to be vacated lies within the Town of Ault IGA. Public Works recommends approving the vacation of right of way as requested. BACKGROUND Public Works has received a request to vacate unbuilt historical ROW for County Road 90 between Weld County Road 37 and Weld County Road 39. The Petitioners are requesting to vacate a portion of the Public Road Right of Way (ROW) described in Road Viewers Report dated May 16, 1902 and recorded on July 16, 1902 in Book 83, Page 285, Reception Number 86027. Specifically, the request is to vacate that portion of ROW lying within Lot D of Recorded Exemption RECX 13-1022. The Petitioners own the property directly adjacent to the ROW on both sides however, the most recent Recorded Exemption did not show the presence of the historical ROW. No other parcels will be landlocked if the ROW within Lot D is vacated. The ROW to be vacated follows the section line lying between Section 19, Township 8 North, Range 65 West of the 6th Principal Meridian on the north: and Section 30, Township 8 North, Range 65 West of the 6th Principal Meridian on the South. There is no roadway within the ROW as physical County Road 90 lies north of the historical petition and is bound on both sides by platted lots; RE -1256 to the north and RECX13-0122 to the south. The land within the road petition is cultivated ag land and does not appear to be encumbered by any obvious public utility. HISTORICAL ROAD RIGHT OF WAY The road file identifies the historical ROW as road #452 however, the public roadway is now known as County Road 90. Review of the road file suggests the alignment may not have be centered on the section line as evident in a Quit Claim conveying the road ROW to the County nearly 40 years later. The Quit Claim includes language that the ROW was to connect with the "present established public highways at the east and west ends respectively to the strip of land". The Quit Claim for deed for the road ROW was conveyed on January 5, 1942 to Weld County on January 5, 1942 recorded at reception number 889382. This deed describes the location of County Road 90 as it exists today. County Road 90 is currently a county -maintained roadway and is identified on the Classification Map as a Collector roadway. Included with the referral is the complete Road File. PROPERTY INFORMATION The subject property is zoned Agricultural and is currently being used as cultivated farmland. The has been subdivided through the Recorded Exemption process multiple times however, the right of way was not shown on any of the plats. The following Recorded Exemptions have been done on the property: • RE 775 reception number 2020776 in 1985 • RE 1751 reception number 2455371 in 1995 • RECX 13-0122 reception number 4011671 in 2014 elea9 Ec≥oo1d1 The public ROW traverses through property creating a triangular silver that impacts the building envelope as the Weld County Code requires setbacks to be measure from public right of way or future ROW. This creates a unique situation on this parcel as a setback would be required from the physical CR 90 as well as the historical ROW which minimizes the landowners best use of the property. EXISTING UTITLTIES Based on the application material and review of aerial imagery available the existing public utilities in the area appear to be located within the deeded ROW adjacent to CR 90 as currently constructed. ADJACENT MUNICIPALIES No part of the ROW to be vacated is located within no other the municipal boundaries. The right of way is approximately 1.5 miles east of the Town of Pierce and 2 miles north of the Town of Ault. Based on the IGA Boundary shown on the Weld County Property Portal approximately 900 feet of the ROW to be vacated lies within the Town of Ault IGA. MEMORANDUM TO: Tiffane Johnson, Public Works Department DATE: December 1, 2021 FROM: Kim Ogle, Planning Services SUBJECT: Petition to Vacate County Road 90 Right -of -Way The applicant's Louie Fabrizius and Stanley Heinze applied for a Recorded Exemption on a parcel of land described as Lot B of Recorded Exemption No. 0551-30-2 RE -1751. Their request was to create four (4) separate parcels from the 166 acre tract of land. The Department of Planning Services conditionally approved RECX13-0122 fora four (4) Lot Recorded Exemption on December 11, 2013. The RECX13-0122 plat was recorded on April 24, 2014 via Reception No. 4011671. On March 3, 2020 Stanley Heinze, Louis and Gina Fabrizius conveyed to Ronald and Trina Erbes by General Warranty Deed lands described as Lot D of Recorded Exemption RECX13-0122. The Department of Planning Services accepted a Plat Vacation Application on September 27, 2021 for Lot D of Recorded Exemption No. RECX13-0122. The applicant's narrative states "the purpose of this vacation request is to combine parcels 055130200011 and 055119300012 and separate Lot D from Lots A, B and C in Recorded Exemption RECX13-0122 for the purpose of splitting the property into >35 acre parcels. The only improvements on this land are metal, open air structures for cattle operations." The Board of County Commissioners approved the request to partially vacate the Four -Lot Recorded Exemption RECX13-0122 for removal of Lot D on behalf of Ronald and Trina Erbes on October 25, 2021. (Resolution doc. 2021-3018). This action vacated Lot D only and did not address the County Road 90 alignment and rights -of -way. A petition for vacation of road right-of-way was received by the Department of Public Works requesting to vacate the existing sixty (60) feet of ROW per 1889 Petition being thirty (30) feet each side of the Section Line on the partially vacated Recorded Exemption Lot owned by Erbes. There is no roadway within the right-of-way as physical County Road 90 lies north of the historical petition and is bound on both sides by platted lots; RE -1256 to the north and RECX13-0122 to the south. There are no land use permits of record for this property and there are no violations identified by the Building, Development Review and Planning Departments per the Weld County Code. Given the physical location of County Road 90 and the intent of the partial vacation of Lot D RECX13- 0122 was to create one parcel of land to be subdivided into 35 acre tracts of land, Planning Services finds no conflict with the request and recommends to the Department of Public Works to accept the petition and approve the request.
