RESOLUTION '1
WHEREAS, a public hearing was held on March 11, 1974 in the
chambers of the Board of County Commissioners, Weld County, Colorado,
for the purpose of hearing a petition of Mountain Bell, c/o Charles
Campbell, Denver, Colorado, requesting a change of zone from "A"
Agricultural District to "C" Commercial District, Planned Unit Develop-
ment, and
WHEREAS, the petitioner was present and represented by Charles
Campbell, and
WHEREAS, there was no opposition to the change of zone, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied the
request of petitioner and studied the recommendations of the Weld County
Planning Commission as submitted, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the petition of Mountain Bell, c/o Charles Campbell,
Denver, Colorado, for change of zone from "A" Agricultural District to
"C" Commercial District, Planned Unit Development, said area being
more particularly described as follows:
A tract of land located in the North Half of Section 18,
Township 5 North, Range 66 West of the 6th P. M. ,
Weld County, Colorado, being more particularly des-
cribed as follows:
Beginning at the North Quarter Corner of said Section
18 and considering the North line of said Section 18 to
bear North 89° 59' 50" East with all other bearings con-

is hereby granted under the conditions following:
1. That any water and sanitation facilities to be installed shall
be approved by the State Health Department.
2, All applicable subdivision regulations and zoning regulations
shall be followed and complied with in accordance with the zoning
resolutions of Weld County, Colorado.
3. That said change of zone herein granted is conditional only
for a period of twelve months from date hereof, on condition that
developer proceed with due diligence to begin development of the area
rezoned and submit plans for such development for the approval of the
Weld County Planning Commission and subsequent recording of said
plans in the office of the County Clerk and Recorder of Weld County,
Colorado; and that major construction shall commence thereon within
said twelve month period; otherwise, the County may take action to
rezone the property to its present classification.

" In order to promote the agricultural economy and to -enhance and
maintain the quality of life and environment in Weld County , de—
velopments that utiliz-e nonproductive rural land and water surpluses
will be encouraged , particularly where productive irrigated farm-
land can be _preserved as agricultur-al greenbelts and open space . "
"Class III Soils have severe limitations that reduce the choice
of plants , require special conservation practices or both .
Class IV Soils have very sov-ere limitations that restrict the
choice of plants , require very careful management or both . " ;

Dear Burman:
We have reviewed the re-zoning application Case No.2-233:73:23
from Charles Campbell (Mountain Bell). We do not have any objection
to the proposed re-zoning. However, when final plans of this devel-
opment are submitted, we will request that they be forwarded to this
office for further review.
The preliminary plans submitted with the present application
for re-zoning do not indicate how the 1-and will be contoured for
drainage. However, we do note that there will be a detention pond
in the angle between County Road No.58 and U.S.34. The preliminary
plans do not indicate where the drainage from this detention pond
will go. Also, we would like to see what provision will be made for
the access of the county road onto U.S.34 as we can forsee that a
future paved extension of County Road No.58 could be confusing since
County Road No.58 follows the semi tangent of the curve on U.S.34.
