RE: APPROVE INTERGOVERNMENTAL AGREEMENT FOR FUNDING OF CERTAIN
ASSETS AND PUBLIC SAFETY DISPATCH SERVICES AND AUTHORIZE CHAIR TO
SIGN - 911 EMERGENCY TELEPHONE SERVICE AUTHORITY BOARD
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Intergovernmental Agreement for
Funding and Public Safety Dispatch Services between the County of Weld, State of Colorado, by
and through the Board of County Commissioners of Weld County, on behalf of the Department of
Public Safety Communications, and the 911 Emergency Telephone Service Authority Board,
commencing January 1, 2021, and ending December 31, 2021, with further terms and conditions
being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Intergovernmental Agreement for Funding of certain assets and
Public Safety Dispatch Services between the County of Weld, State of Colorado, by and through
the Board of County Commissioners of Weld County, on behalf of the Department of Public Safety
Communications, and the 911 Emergency Telephone Service Authority Board, be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 24th day of March, A.D., 2021.

INTERGOVERNMENTAL AGREEMENT
THIS AGREEMENT, made and entered into on this, the d`'Iday of March_, 2021, by
and between Weld County, hereinafter referred to as "Weld" and Weld 911 Emergency Telephone
Service Authority, hereinafter referred to as "Authority", the parties agree as follows:
WHEREAS, the Board of the Authority desires to transfer certain Authority assets to Weld
in order to place all the communications equipment and capital infrastructure to support the Weld
County Regional Communications Center (WCRCC) under common ownership rather than being
split between the county's and the E911 Authority's balance sheets, and
WHEREAS, the Board of the Authority desires that the Authority no longer directly
purchase capital assets with Authority funds nor carry the assets on the Authority balance sheet,
and
WHEREAS, the Board of the Authority desires to change the Authority's policies regarding
funding and budgeting for E911 services in Weld County, and
WHEREAS, the parties hereto are desirous of formalizing an agreement for the express
purpose of funding and providing E911 public safety dispatch services to Weld County residents
pursuant to the terms hereof, and
NOW, THEREFORE, in consideration of the premises stated herein, the parties hereto
agree as follows:
1. PROVISION OF SERVICES BY THE COUNTY:
The County, through the WCRCC and Weld Public Safety Information Technology Department,
shall provide the following public safety dispatch services:
a. Emergency 911 call answering;
b. Police, fire and EMS CAD/radio dispatching;
c. NCIC/CCIC channel clearances;
d. After -hour notifications for police, animal control involving concerns for public safety, fire,
EMS, water and sewer, risk management, and public works.
e. The public safety dispatch services listed in "a" through "d" above shall be provided to the
WCRCC users 24 hours per day, seven days a week.
f. Information services support of the computer aid dispatch (CAD) system for the WCCRC
to support items "a" through "e" as outlined above.
2. FUNDING AND BUDGETING FOR PROVISION OF SERVICES:
a. Weld will assume the funding responsibility of communications assets to support
the WCRCC and assume the responsibility of developing and funding the Ten -Year
Capital Plan for E911 required assets in part based upon a contribution from Authority.
The funding of the Ten -Year Capital Plan for E911 required assets will be in the Weld
County Capital Expenditure Fund in an earmarked budget unit and separately identified
reserve. Assets purchased with Authority funding transferred to Weld will be identified on
the county books.

b. The Authority shall transfer to Weld the assets identified on Exhibit A hereto.
c. Any equipment acquired from funds covered by this Agreement or transferred
pursuant to this Agreement shall constitute the property of Weld and Weld shall have
full use of the equipment for so long as Weld continues to operate the WCRCC in Weld
County, Colorado. In the event Weld discontinues to operate the WCRCC the assets
transferred to Weld from Authority and any assets purchased by the Authority's capital
contributions shall revert back to the Authority. Weld shall notify the Authority in writing
at least thirty (30) days before disposing or transferring any equipment subject to the
provisions of this Section.
e. Weld shall only use funds received from the Authority for the uses authorized by
C.R.S.§29-11-104, as amended from time to time, including:
i. Costs associated with the lease or purchase, installation, engineering,
programing, maintenance, monitoring, security, planning, and oversight of
equipment, facilities, hardware, software, and databases used to receive and
dispatch 911 calls.
ii. Charges of basic emergency service providers for the provision of basis
emergency service;
Costs related to the provision of the emergency notification service and
emergency telephone service, including costs associated with total
implementation of both services by emergency service providers, including cost
for programming, emergency medical services provided by telephone, radio
equipment with the public service answering point ("PSAP"), and training for
PSAP personnel.
iv. Costs associated with the operation of emergency telephone service and
emergency notification service, including recordkeeping, administrative, and
facilities costs, whether the facilities are leased or owned;
v. Membership fees for state or national industry organizations supporting
911; and
vi. Other costs directly related to the continued operation of the emergency
telephone service and the emergency notification service.
f. Any amounts paid by the Authority to Weld County pursuant to this Agreement
shall be approved and appropriated each year by the Authority Board in the preparation
and approval of the Authority's annual budget. The amount paid in any year shall not
exceed the appropriated amount approved by the Authority Board.
3. TERM:
The term of this IGA shall be from January 1, 2021, to and until December 31, 2021, and shall
continue for successive one-year periods thereafter, unless terminated sooner by either party by
giving to the other notice of termination at least 180 days prior to the date of termination of the
then current term.
4. ENTIRE AGREEMENT: This writing constitutes the entire agreement between the parties
hereto with respect to the subject matter herein, and shall be binding upon said parties, their
officers, employees, agents and assigns.
5. NON -ASSIGNMENT: This agreement is exclusive to the parties and non -transferable.
6. NO WAIVER OF IMMUNITY: No portion of this IGA shall be deemed to constitute a waiver
of any immunities the parties or their officers, employees, or agents may possess, nor shall any
portion of this IGA be deemed to have created a duty of care which did not previously exist with
respect to any person not a party to this IGA.
7. NON -APPROPRIATION: Financial obligations of the parties imposed under this IGA and
payable after the current fiscal year are contingent upon funds for that purpose being
appropriated, budgeted and otherwise made available. By execution of this IGA, the parties do
not warrant that funds will be available to fund this IGA beyond the current fiscal year and no
portion of this IGA shall be deemed to create an obligation on the part of the Authority to expend
funds not otherwise appropriated in each succeeding year.
8. NO THIRD -PARTY BENEFICIARY ENFORCEMENT. It is expressly understood and
agreed that the enforcement of the terms and conditions of this IGA, and all rights of action relating
to such enforcement, shall be strictly reserved to the undersigned parties and nothing in this IGA
shall give or allow any claim or right of action whatsoever by any other person not included in this
IGA. It is the express intention of the undersigned parties that any entity other than the
undersigned parties receiving services or benefits under this IGA shall be an incidental beneficiary
only.
IN WITNESS WHEREOF, the parties above named have executed this agreement on the

A RESOLUTION IN THE MATTER OF FUNDING AND BUDGETING FOR WELD 911
EMERGENCY TELEPHONE SERVICE AUTHORITY SERVICES
WHEREAS, the Board of the Weld 911 Emergency Telephone Service Authority
(Authority) is vested with the authority of administering the affairs of the Authority, and
WHEREAS, the Board of the Authority desires to change the policies regarding funding
and budgeting for E911 services in Weld County, and
WHEREAS, the Board of the Authority desires instead of E911 funding specific
operational line items and expenses in its annual budget, it wishes through an
intergovernmental agreement (IGA) between Weld County and Authority for the Weld County
Regional Communications Center (WCRCC) to provide E911 dispatch services to Weld County
citizens and Weld County Information Technology to provide public safety information services.
There would only be three line items in the Authority budget. One for professional services to
provide E911 dispatch services, one for public safety information services (together with the
E911 dispatch services, the "Services"), and one for a contribution of funds to support the
countywide communications equipment and infrastructure for the WCRCC. The contribution
amount would be the amount required annually to fund the Ten -Year Capital Plan for E911
required assets (currently $1,850,000), and
WHEREAS, per the attached intergovernmental agreement (IGA) between the Authority
and the Board of Weld County Commissioners, Weld County will assume the responsibility of
developing and funding the Ten -Year Capital Plan for E911 required assets from a contribution
from Authority. The funding of the Ten -Year Capital Plan for E911 required assets will be in the
Weld County Capital Expenditure Fund in an earmarked budget unit and separately identified
reserve. Assets purchased with Authority funding transferred to the county will be identified on
the county books, and
WHEREAS per the attached intergovernmental agreement (IGA) between the Authority
and the Board of Weld County Commissioners the amount paid for the Services and
contribution annually of funds for capital needs of the WCRCC in total would be the anticipated
revenue from the E911 telephone surcharge and interest income, and any fund balance carry
over from the prior year less the $500,000 fund balance reserve in accordance with the April 15,
2014 fund balance policy adopted by the Board of the Authority. As a part of the annual budget
process the County shall provide the Authority a detailed list of expenses and equipment
covered in the annual budget for review and approval by the Authority. Any amount budgeted
by the Authority shall be used only for those items authorized by C.R.S. §29-11-104 and
pursuant to the terms of the 1GA.
NOW, THEREFORE, BE IT RESOLVED, by the Board of the Authority that instead of
Authority funding specific operational line itemt and expenses in its annual budget it wishes
through the 1GA to fund E911 dispatch services to Weld County citizens and Weld County
Information Technology to provide public safety information services. There will only be three line
items in the Authority budget: One for professional services to provide E911 dispatch services;
one to provide public safety information services; and one for a contribution of funds to support
the countywide communications equipment and infrastructure for the WCRCC (the
"Contribution"). The Contribution amount would be the amount required annually to fund the Ten -

BE IT FURTHER RESOLVED by the Board of the Authority that pursuant to the IGA ,
Weld County will assume the funding responsibility of communications assets to support the

E911 required assets subsidized in part by the Contribution. The funding of the Ten -Year Capital
Plan for E911 required assets will be in the Weld County Capital Expenditure Fund in an
earmarked budget unit and separately identified reserve. Assets purchased with the Contribution
will be identified on the county books is hereby approved.
BE IT FURTHER RESOLVED by the Board of the Authority that the amount approved by
the Authority for the Services and Contribution would be the anticipated revenue from the E911
telephone surcharge and interest income and, any fund balance carry over from the prior year
less the $500,000 fund balance reserve in accordance with the April 15, 2014 fund balance policy
adopted by the Board of the Authority is hereby approved.
BE IT FURTHER RESOLVED by the Board of the Authority that the attached
intergovernmental agreement (IGA) between the Authority and the Board of Weld County
Commissioners is hereby approved.
BE IT FURTHER RESOLVED by the Board of the Authority, if any section, subsection,
paragraph, sentence, clause, or phrase of this resolution is for any reason held or decided to be
unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The
Board hereby declares that it would have enacted this resolution in each and every section,
subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one
or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared to
be unconstitutional or invalid.

RESOLUTION
A RESOLUTION IN THE MATTER OF A SUPPLEMENTAL APPROPRIATION FOR THE YEAR
2021 FOR THE WELD 911 EMERGENCY TELEPHONE SERVICE AUTHORITY
WHEREAS, the Board of the Weld 911 Emergency Telephone Service Authority is vested
with the authority of administering the affairs of the Authority, and
WHEREAS, Section 29-1-111, C.R.S., provides that if during the fiscal year the governing
body or any spending agency received unanticipated revenue or revenues not assured at the time
of the adoption of the budget from any source other than the local government's property tax mill
levy, or from unanticipated fund balances the governing board of the local government may
authorize the expenditure of these unanticipated or unassured funds by enacting a supplementary
budget and appropriation, and
WHEREAS, the Board of the Weld 911 Emergency Telephone Service Authority has been
advised that supplemental appropriations in accordance with the above, need to be made in fiscal
year 2021 to accommodate the restructuring of the budget to be consistent with change in policy
regarding the funding of capital equipment and operational costs as delineated in the attached
Exhibit A, and
WHEREAS, this is an emergency caused by a contingency which would not have been
reasonably foreseen at the time of the adoption of the 2021 Budget, and
WHEREAS, by Section 29-3-112, C.R.S., the governing board does, in an emergency
situation, have authority for the expenditure of funds in excess of said budget, by a resolution duly
adopted by two-thirds of the vote of the governing body.
NOW, THEREFORE, BE IT RESOLVED, by the Board of the Weld 911 Emergency
Telephone Service Authority that the supplemental appropriations as delineated on the attached
Exhibit A for fiscal year 2021 which were made necessary by an emergency caused by a
contingency which could not have been reasonably foreseen at the time of the adoption of the
2021 Budget be, and hereby are, approved.
BE IT FURTHER RESOLVED by the Board of the Weld 911 Emergency Telephone
Service Authority, if any section, subsection, paragraph, sentence, clause, or phrase of this
resolution is for any reason held or decided to be unconstitutional, such decision shall not affect

2021 BUDGET HEARING
NOTICE IS HEREBY GIVEN that a supplemental appropriation resolution and exhibit has been
submitted to the Weld County E911 Authority Board for the budget year of 2021. A copy of the
supplemental appropriation resolution and exhibit has been filed in the Weld County Office of the
Clerk to the Board, located at 1150 O Street, Greeley, Colorado, where same is open for public
inspection. The supplemental appropriation resolution and exhibit for the 2021 budget will be
considered at a regular meeting of the Board to be held at 1104 H Street Greeley, CO 80631 —
Training Center, on February 16, 2021, at 12:00 p.m. Any interested citizen within such Weld
County E911 Authority, which includes all of Weld County, may inspect the proposed
supplemental appropriation resolution and exhibit for the 2021 budget and file or register any
objections thereto at any time prior to the final adoption of the 2021 supplemental appropriation
resolution and exhibit for the 2021 budget.
