HomeMy WebLinkAbout20211390.tiffHEARING CERTIFICATION DOCKET NO. 2021-38 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR21-0006, FOR A CHURCH (ADDITION OF A FELLOWSHIP HALL) AND ASSOCIATED SIGNAGE EXCEEDING THE WELD COUNTY SIGN CODE STANDARDS IN THE A (AGRICULTURAL) ZONE DISTRICT - ASSEMBLY OF GOD STONEHAM A public hearing was conducted on June 2, 2021, at 10:00 a.m., with the following present: Commissioner Steve Moreno, Chair — EXCUSED Commissioner Scott K. James, Pro-Tem Commissioner Perry L. Buck Commissioner Mike Freeman Commissioner Lori Saine Also present: Acting Clerk to the Board, Jan Warwick Assistant County Attorney, Karin McDougal Planning Services Department representative, Maxwell Nader Public Works Department representative, Zackery Roberson Health Department representative, Lauren Light The following business was transacted: El I hereby certify that pursuant to a notice dated April 30, 2021, and duly published May 2, 2021, in the Greeley Tribune, a public hearing was conducted to consider the request of Assembly of God Stoneham, for a Site Specific Development Plan and Use by Special Review Permit, USR21-0006, for a Church (addition of a fellowship hall) and associated signage exceeding the Weld County sign code standards in the A (Agricultural) Zone District. Karin McDougal, Assistant County Attorney, made this a matter of record. Chair Pro-Tem James, reviewed for the applicant and the public, the procedures to follow should this case result in a tie vote due to four (4) Commissioners being present and Chair Moreno being excused. e Maxwell Nader, Department of Planning Services, presented the proposal, described the addition of a fellowship hall, including its proposed size and uses, explained the number of employees will be two (2), with an average number of visitors being between 50 to 60 on a weekly basis. He described the parking, the Weld County sign code requirements and explained no fencing or landscaping is required. He stated no correspondence has been received from surrounding property owners (SPOs), described the USRs in the area, entered the favorable recommendation of the Planning Commission into the record as written and displayed images of the site and surrounding views. Zackery Roberson, Department of Public Works, stated access is off of Marble Avenue, which is permitted under AP21-0059, and the applicant has requested no changes of access points. Mr. Roberson relayed a Final Drainage Report and Certification of Compliance, signed and stamped by a professional engineer, will be required, and a Grading Permit is required if more than one (1) acre of land is disturbed. El Lauren Light, Department of Public Health and Environment (EH), stated water is provided by a well for residential uses and sewer is provided by a septic system sized for 50 people. She relayed Condition of Approval (COA) #1.A requires an appropriately permitted well, stating the Division of Water Resources indicated a commercial exempt well may be available, but they had not been able to determine if the existing well is adequate. Ms. Light relayed staff has requested five (5) Development Standards (DS) that address EH items related to dust, waste and sanitation. Mr. Yarrington requested approval from the Commissioners in granting the application. IE No public testimony was offered concerning this matter. In response to Chair Pro-Tem James, Mr. Yarrington indicated they have reviewed the COA and DS, and have no requested changes. In response to Commissioner Freeman, Mr. Roberson relayed this area is known for drainage complaints when there are big rainfalls; therefore, PW requests a detention pond for the addition. Mr. Roberson explained a meeting was held with the applicant and their engineer and staff is trying to work with applicant to help reduce the financial burden. The Board made no changes to the COA or DS. In response to Chair Pro-Tem James, Mr. Yarrington indicated they have reviewed, and agree to abide by, the COA and DS as presented. Commissioner Freeman moved to approve the request of Assembly of God Stoneham for a Site Specific Development Plan and Use by Special Review Permit, USR21-0006, for a Church (addition of a fellowship hall) and associated signage exceeding the Weld County sign code standards in the A (Agricultural) Zone District, based on the recommendations of Planning Staff and the Planning Commission, with the Conditions of Approval and Development Standards, as presented. The motion was seconded by Commissioner Saine, and it carried unanimously.
