is RESOLUTION A
WHEREAS, a public hearing was held on April 8, 1974 in the
chambers of the Board of County Commissioners, Weld County,
Colorado, for the purpose of hearing a petition of Dabco, Inc. ,
(__) P. O. Box 608, LaSalle, Colorado, requesting a change of zone
from "A" Agricultural District to "I" Industrial District, and
WHEREAS, the petitioner was present and represented by
Mr. Dave Freemeyer, and
ca
WHEREAS, there was no opposition to the change of zone, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied
the request of petitioner and studied the recommendations of the
'=' Weld County Planning Commission as submitted, and having been
fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the petition of Dabco, Inc. , P. O. Box 608,
LaSalle, Colorado, for change of zone from "A" Agricultural District
to "I" Industrial District, said area being more particularly described
as follows:
A parcel of land located in the Northwest Quarter (NW 4)
of Section 6, Township 4 North, Range 65 West of the
6th P. M. , Weld County, Colorado, and being more
particularly described as follows:
Commencing at the West Quarter Corner (W1Cor) of
said Section 6, and considering the West Section line
of said Section 6 to bear North 00° 00' 00" West and
with all other bearings described herein relative thereto,
and also said Quarter Corner being the True Point of
Beginning:
Thence North 00° 00' 00" West along the West Section
line of said Section 6, 385. 00 feet;
Thence North 90° 00' 00" East 1431. 83 feet;
Thence South 28° 12' 00" West 111. 38 feet;
Thence South 32° 58' 00" West 301. 04 feet;
Thence South 28° 12' 00" West 38. 88 feet to a point on
the middle Quarter line of said Section 6;
Thence South 90° 00' 00" West along said Middle Quarter
line of said Section 6, 1197. 03 feet to the True Point
of Beginning.
Said parcel of land contains 11. 640 acres more or less,
is hereby granted under the conditions following:

1. That any water and sanitation facilities to be installed
shall be approved by the State Health Department.
2. All applicable subdivision regulations and zoning regula-
tions shall be followed and complied with in accordance with the

AGREEMENT
THIS AGREEMENT, Trade and entered into this /, '/' day of
February, 1974, by and between DABCO, INC„ a Colorado Corporation,
and the TOWN OF LASALLE, a:Municipal Corporation, in the State of
Colorado.
WITNESSETH :
WHEREAS, Dabco is the owner of a 58. 59 acre tract of Land located
adjacent to the boundaries of the Town of LaSalle, said tract of land being
more specifically described as follows:
A parcel of land Located in the Northwest Quarter
(NW-i) of Section Six (6), Township Four (4) North, Range
Sixty-five (65) West of the Sixth P.M. , Weld County, Colo-
rado and being more particularly described as follows:
Commencing at the West Quarter Corner of said Section 6,
and considering the West Section Line of said Section 6 to
bear North 00° 001 00" West and with all other bearings
described herein relative thereto, and also said Quarter
Corner being the True Point of Beginning: Thence North
00° 00' 00" West, 1313. 68 feet; thence North 77° 12' 00"
East, 2252. 23 feet; thence South 28° 121 00" West, 1, 726. 18
feet; thence South 32° 58' 00" West, 301. 04 feet; thence
South 28° 12' 00" West, 38. 88 feet, to a point on the Middle

Sixty-five (65) West of the Sixth P.M. , Weld County, Colo-
rado, and being more particularly described as follows:
Commencing at the West Quarter Corner (W 4 Cor. ) of said
Section 6, and considering the West Section line of said
Section 6 to bear North 00° 001 00" West and with all other
bearings described herein relative thereto, and also said
Quarter Corner being the True Point of Beginning: Thence
North 00° 00' 00" West along the West Section line of said
Section 6, 385. 00 feet; thence North 90° 00' 00" East 1431. 83
feet; thence South 28° 121 00" West 111. 38 feet; thence South
32° 581 00" West 301. 04 feet; thence South 28° 121 00'" West
38. 88 feet, to a point on the Middle Quarter line of said Sec-
tion 6; thence South 90° 00' 00" West along said Middle Quar-

Beginning; and
WHEREAS, Dabco has requested the Planning Commission and the
Board of County Commissioners of Weld County to rezone the 11. 640 acre
tract from Agricultural to Industrial zoning, and the Planning Commission
of Weld County has referred the zoning request to the Board of Trustees of
the Town of LaSalle for their recommendation; and
WHEREAS, the Board of Trustees of the Town of LaSalle and Dabco
have made certain agreements regarding the development of the Larger tract
of land and wish to document the same by this agreement.
NOW, THEREFORE, in consideration of the Board of Trustees of the
Town of LaSalle recommending to the Weld County Planning Commission
that the rezoning request of Dabco, Inc. be approved, because of the close
proximity of the property to the Town of LaSalle boundary, and because the
Town of LaSalle is vitally interested in the development of the property and
Dabco is willing to abide by the following plan or procedure to be followed
after the Petition for rezoning is acted upon favorably by the Planning Com-
mission of Weld County and the Board of County Commissioners, said agree-
ments of Dabco being as follows:
(a) Dabco agrees to not object to annexation of the whole
tract by the Town of LaSalle at any time that the Town of LaSalle
desires annexation.
(b) Dabco agrees that during the interim period between
the present and the time that the Town of LaSalle requests
annexation, Dabco will use the water available from the pump
Located on the property for its source of domestic water or, in
the alte-rnative, will, with the consent of the Town of LaSalle,
connect to the Town1s domestic water distribution system.
(c) That Dabco will install its own disposal system to
be used by its facilities which shall comply with the Weld County
requirements and all other governing agencies.
(d) That Dabco proposes to diligently and closely coor-
dinate its development plans with the Town of LaSalle in order
to insur_e well planned development of the whole 58. 59 acre tract.
(e) Dabco will not construct facilities or use the eleven
acre tract for purposes other than those needed for Dabcots own
operations prior to the time of annexation, or without the consent
of the Town of -LaSalle.
(f) Upon annexation by the Town of LaSalle, Dabco
agrees to abide by all municipal ordinances and regulations.

(g) Dabco agrees to comply with reasonable develop-
ment requests of the Town of LaSalle in the development of the
property.

Gentlemen:
The Union Ditch Company, one of the parties to whom the
above matter was submitted for comment , has these observations
to make relative to the granting or denial of the zoning change.
Initially, the Union Ditch Company desires to cooperate
with and to facilitate the development of all areas, whether adjacent
to the _ditch or otherwise, and the suggestions contained herein are
not to be considered as though -the Ditch Company were taking a
negative attitude or approach.
Although the area to be rezoned is not directly adjacent
and next to the ditch of the Union Ditch Company, the area is
sufficiently close so that if there were a heavy rainfall and the
zoned area were placed into either an industrial factory or build-
ing with a paved parking lot , the rain runoff would be accelerated
and at a much more rapid rate than if the land were in its present
natural state or were in agricultural use. The lay of the ground
in this area is such that the only place -for water to escape in
case of a storm is to the north and east-, e.long the highway, where
it would enter the Union Ditch on the west side of the highway and
would then flow down the Union Ditch through the easterly portions
of the town of LaSalle . The Union Ditch is not engineeringly de-
signed nor does it have the capacity to act as a storm -sewer for
the area involved, and that this together - with other increased flows
from rainfalls will cause serious problems to the Union Ditch Company
and will naturally result in additional flooding of the town of
LaSalle and the farmers on down the ditch-.

1f Dabco would design a _culvert or -some other facility to
take the storm water which arises from this proposed newly zoned
area across the d-itch so that -it would not run into the Union
Ditch Company canal, there would be no _objection by the Union
Ditch Company to this change of zoning. •
We hope these suggestions will be helpful to the Planning
Commission in its consideration of this application for zoning
change.

Dear Burman:
We have -reviewed the Rezoning Application (Case No. 23574:1).
As you are aware, the Division of Highways has no jurisdiction in the
determination of zoning and, therefore, have no comments in regard to the
rezoning.
However, inasmuch as the proposed development is adjacent to a State
Highway, we would like -to make -the following comments.
1. The plat of the development, as submitted, does not indicate
what the access onto the development will be. At present,
there is a trail adjacent to U.S. 85 that serves as access to
this area and on to the south. However, this trail woul-d be
entirely inadequate to serve any volume of traffic such as
might be generated by the type of development proposed. The
Division of Highways has no plans or funds available at the
present time to upgrade this trail. Provisions, therefore,
should be provided by the developer either to construct.a
frontage road system on his own property or provide for up-
grading of the present trail to meet the demands of the
anticipated traffic generated by -the development. Our present
right of way width meets the minimum requirements -for a system
without frontage roads, therefore, it world be our xecom-
mendation that consideration be given to provisions for the
development of -a frontage road system out-side the present
highway right of -way.
