RE: RETURN FEDERAL CONGESTION MITIGATION AND AIR QUALITY (CMAQ) GRANT
FUNDING FROM THE WELD COUNTY COMPRESSED NATURAL GAS (CNG)
VEHICLES PROJECT BACK TO THE NORTH FRONT RANGE METROPOLITAN
PLANNING ORGANIZATION (NFRMPO) CMAQ POOL
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Weld County was awarded $2,200,000.00 in Fiscal Year (FY) 2020 for the
Weld County CNG Vehicles project ("the Project"), with STIP ID SST7007.014, and
WHEREAS, due to Buy America waivers, the project went through the first North Range
Range Metropolitan Planning Organization (NFRMPO) Transportation Improvement Program
(TIP) delay in FY 2021, and
WHEREAS, the project is still unable to proceed due to the indefinite suspension of the
Buy America waiver process and, therefore, Weld County does not want to pursue a second TIP
delay process for FY 2022, and
WHEREAS, the Board of County Commissioners deems it advisable to return
$2,200,000.00 of federal CMAQ funding from the Project to the NFRMPO for use on other CMAQ
projects, and
WHEREAS, the Clerk to the Board shall send a copy of this Resolution to the NFRMPO.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Board will return $2,200,000.00 of federal CMAQ funding from the
Project to the NFRMPO for use on other CMAQ projects.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board shall send a copy
of this Resolution to the NFRMPO.

The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 3rd day of November, A.D., 2021.
