O. Box 758 Greeley, CO 80631 Dear Mr. Moreno: SEP O 1 2021 IN REPLY REFER TO: WELD COUNTY Case No.: 21-08-009cpMMISSI0NERS Follows Conditional Case No.: 19-08-0969R Community Name: Weld County, CO Community No.: 080266 FIRM Panel Affected: 08123C 1503E, 08123C1504E 116 In a Letter of Map Revision (LOMR) dated April 14, 2021, you were notified of proposed flood hazard determinations affecting the Flood Insurance Rate Map (FIRM) and Flood Insurance Study (FIS) report for Weld County, CO. These determinations were for John Law Ditch - WCR 23 Flow Path - from the confluence with John Law Ditch - GWD Flow Path to the divergence from John Law Ditch - Kodak L Path. The 90 -day appeal period that was initiated on April 30, 2021, when the Department of Homeland Security's Federal Emergency Management Agency (FEMA) published a notice of proposed Flood Hazard Determinations in The Greeley Tribune has elapsed. FNMA received no valid requests for changes to the modified flood hazard information. Therefore, the modified flood hazard information for your community that became effective on August 30, 2021, remains valid and revises the FIRM and FIS report that were in effect prior to that date. The modifications are pursuant to Section 206 of the Flood Disaster Protection Act of 1973 (Public Law 93-234) and are in accordance with the National Flood Insurance Act of 1968, as amended (Title XIII of the Housing and Urban Development Act of 1968, Public Law 90-448), 42 U.S.C. 4001-4128, and 44 CFR Part 65. The community number(s) and suffix code(s) are unaffected by this revision. The community number and appropriate suffix code as shown above will be used by the National Flood Insurance Program (NFIP) for all flood insurance policies and renewals issued for your community. FEMA has developed criteria for floodplain management as required under the above -mentioned Acts of 1968 and 1973. To continue participation in the NFIP, your community must use the modified flood hazard information to carry out the floodplain management regulations for the NFIP. The modified flood hazard information will also be used to calculate the appropriate flood insurance premium rates for all new buildings and their contents and for the second layer of insurance on existing buildings and their contents. If you have any questions regarding the necessary floodplain management measures for your community or the NFIP in general, please contact the Mitigation Division Director, FEMA Region VIII, in Denver, Colorado, either by telephone at (303) 235-4830, or in writing at Denver Federal Center, Building 710, Box 25267, Denver, Colorado, 80225. Pursuant to Section 1361 of the National Flood Insurance Act of 1968, as amended, communities participating in the NFIP are required to adopt and enforce floodplain management regulations that meet or exceed NFIP criteria. These criteria, including adoption of the FIS report and FIRM, and the modifications made by this LOMB, are the minimum requirements for continued NFIP participation and do not supersede more stringent State/Commonwealth or local requirements to which the regulations apply. NFIP regulations Subparagraph 60.3(b)(7) requires communities to ensure that the flood -carrying capacity within the altered or relocated portion of any watercourse is maintained. This provision is incorporated into your community's existing floodplain management ordinances; therefore, responsibility for maintenance of the altered or relocated watercourse, including any related appurtenances such as bridges, culverts, and other drainage structures, rests with your community. We may request that your community submit a description and schedule of maintenance activities necessary to ensure this requirement. COMMUNITY REMINDERS We based this determination on the 1 -percent -annual -chance flood discharges computed in the FIS for your community without considering subsequent changes in watershed characteristics that could increase flood discharges. Future development of projects upstream could cause increased flood discharges, which could cause increased flood hazards. A comprehensive restudy of your community's flood hazards would consider the cumulative effects of development on flood discharges subsequent to the publication of the FIS report for your community and could, therefore, establish greater flood hazards in this area. Your community must regulate all proposed floodplain development and ensure that permits required by Federal and/or State/Commonwealth law have been obtained. State/Commonwealth or community officials, based on knowledge of local conditions and in the interest of safety, may set higher standards for construction or may limit development in floodplain areas. If your State/Commonwealth or community has adopted more restrictive or comprehensive floodplain management criteria, those criteria take precedence over the minimum NFIP requirements. We will not print and distribute this LOMR to primary users, such as local insurance agents or mortgage lenders; instead, the community will serve as a repository for the new data. We encourage you to disseminate the information in this LOMR by preparing a news release for publication in your community's newspaper that describes the revision and explains how your community will provide the data and help interpret the NFIP maps. In that way, interested persons, such as property owners, insurance agents, and mortgage lenders, can benefit from the information. This determination is based on the flood data presently available. This document is not a final determination; it only provides our comment on the proposed project in relation to the flood hazard information shown on the effective National Flood Insurance Program (NFIP) map. We reviewed the submitted data and the data used to prepare the effective flood hazard information for your community and determined that the proposed project meets the minimum floodplain management criteria of the NFIP. Your community is responsible for approving all floodplain development and for ensuring that all permits required by Federal or State/Commonwealth law have been received. State/Commonwealth, county, and community officials, based an their knowledge of local conditions and in the interest of safety, may set higher standards for construction in the Special Flood Hazard Area (SFHA), the area subject to inundation by the base flood). If the State/Commonwealth, county, or community has adopted more restrictive or comprehensive floodplain management criteria, these criteria take precedence over the minimum NFIP criteria. This comment is based toll free at 1-877-336-2627 Additional Information on the flood data presently available. If you have any questions (1-877-FEMA MAP) or by letter addressed to the LOMC Clearinghouse, about the NFIP is available on the FEMA website at https://www.fema.gov/national-flood-insurance-program. about this document, please contact the FEMA Map Information eXchange (FMIX) 3601 Eisenhower Avenue, Suite 500, Alexandria, VA 22304-6426. CONDITIONAL LETTER OF MAP REVISION COMMENT DOCUMENT (CONTINUED) COMMUNITY INFORMATION To determine the changes in flood hazards that will be caused by the proposed project, we compared the hydraulic modeling reflecting the proposed project (referred to as the proposed conditions model) to the hydraulic modeling used to prepare the Flood Insurance Study (FIS) (referred to as the effective model). If the effective model does not provide enough detail to evaluate the effects of the proposed project, an existing conditions model must be developed to provide this detail. This existing conditions model is then compared to the effective model and the proposed conditions model to differentiate the increases or decreases in flood hazards caused by more detailed modeling from the increases or decreases in flood hazards that will be caused by the proposed project. The table below shows the changes in the BFEs: BFE Comparison Table Flooding Source: John Law Ditch - WCR 23 Flow Path BFE Change (feet) Location of maximum change Existing vs. Effective Maximum increase None N/A Maximum decrease 1.2 Just downstream of the divergence from John Law Ditch - Kodak L Path Proposed vs. Existing Maximum increase None N/A Maximum decrease 0.8 Just downstream of the divergence from John Law Ditch - Kodak L Path Proposed vs. Effective Maximum increase None N/A Maximum decrease 2.0 Just downstream of the divergence from John Law Ditch - Kodak L Path NFIP regulations Subparagraph 60.3(b)(7) requires communities to ensure that the flood -carrying capacity within the altered or relocated portion of any watercourse is maintained. This comment is based on the flood data presently available. CONDITIONAL LETTER OF MAP REVISION COMMENT DOCUMENT (CONTINUED) COMMUNITY INFORMATION (CONTINUED) DATA REQUIRED FOR FOLLOW-UP LOMR (continued) • FEMA's fee schedule for reviewing and processing requests for conditional and final modifications to published flood information and maps may be accessed at https://www.fema.gov/forms-documents-and-software/flood-map-related-fees. The fee at the time of the map revision submittal must be received before we can begin processing the request. Payment of this fee can be made through a check or money order, made payable in U.S. funds to the National Flood Insurance Program, or by credit card (Visa or MasterCard only). Please either forward the payment, along with the revision application, to the following address: LOMC Clearinghouse Attention: LOMR Manager 3601 Eisenhower Avenue, Suite 500 Alexandria, Virginia 22304-6426 or submit the LOMR using the Online LOMC portal at: https://hazards.fema.gov/femaportal/onlinelomc/signin After receiving appropriate documentation to show that the project has been completed, FEMA will initiate a revision to the FIRM and FIS report. Because the flood hazard information (i.e., base flood elevations, base flood depths, SFHAs, zone designations, and/or regulatory floodways) will change as a result of the project, a 90 -day appeal period will be initiated for the revision, during which community officials and interested persons may appeal the revised flood hazard information based on scientific or technical data.
