RE: ACCEPT REQUEST TO WITHDRAW APPLICATION FOR A SITE SPECIFIC
DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR20-0023, FOR
USES SIMILAR TO THE USES LISTED, AS PERMITTED OUTSIDE OF SUBDIVISIONS
AND HISTORIC TOWNSITES, AS LONG AS THE USE COMPLIES WITH THE
GENERAL INTENT OF THE A (AGRICULTURAL) ZONE DISTRICT (PROPANE
STORAGE FACILITY FOR USE BY RESIDENTIAL, COMMERCIAL AND
AGRICULTURAL USES) IN THE A (AGRICULTURAL) ZONE DISTRICT - DOUGLAS
AND DEBORAH DUGGAN, C/O AMERIGAS PROPANE, LP
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 3rd day of
February, 2021, at the hour of 10:00 a.m., in the Chambers of the Board, for the purpose of
hearing the application of Douglas and Deborah Duggan, 616 Chatoga Avenue, Grover, Colorado
80729, c/o Amerigas Propane, LP, 460 North Gulph Road, King of Prussia, Pennsylvania 19406,
for a Site Specific Development Plan and Use by Special Review Permit, USR20-0023, for Uses
similar to the Uses listed, as permitted outside of subdivisions and historic townsites, as long as
the Use complies with the general intent of the A (Agricultural) Zone District (propane storage
facility for use by residential, commercial and agricultural uses) in the A (Agricultural) Zone District
on the following described real estate, to -wit, and:
Lot A of Recorded Exemption, RECX11-0035; being
part of the NW1/4 of Section 4, Township 10 North,
Range 61 West of the 6th P.M., Weld County,
Colorado
WHEREAS, at said hearing, the Board was presented with an email from the applicants,
dated January 19, 2021, requesting withdrawal of the application (Exhibit A), stating Amerigas
Propane, LP, had decided to not proceed with this application and intended to remove the tank
by March 10, 2021, and the applicants' request was accepted by the Planning Commission as
reflected in the Minutes (Exhibit B), copies of which are attached hereto and incorporated herein
by reference, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicants, action taken by the Planning
Commission, and all of the exhibits and evidence presented in this matter and, having been fully
informed, deems it advisable to grant the applicants' request and thereby accept the withdrawal
of the application.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of Douglas and Deborah Duggan, c/o Amerigas Propane, LP,
to withdraw the application for a Site Specific Development Plan and Use by Special Review
Permit, USR20-0023, for Uses similar to the Uses listed, as permitted outside of subdivisions and
historic townsites, as long as the Use complies with the general intent of the A (Agricultural) Zone
District (propane storage facility for use by residential, commercial and agricultural uses) in the
A (Agricultural) Zone District, on the parcel of land described above be, and hereby is, accepted
and the matter is dismissed.

The above and foregoing Resolution was, on motion duly made and seconded, adopted
