RE: Change of Zone, Case # COZ2o-009 Date: 2/5/21
Dear Board of County Commissioners,
I am submitting this letter in response to a postcard I received announcing the change of
zoning to the property adj scent to our residence. My wife and I reside at 30598 County Road 29,
Greeley. Our property is adjacent to and directly south of Duran Excavation who is seeping the
re -zoning classification.
While I am not against reasonable expansion, we desire to maintain the aesthetic value as
well as the property value of our residence. My wife and I have invested a great deal of time and
money acquiring this property and creating a residence that creates the lifestyle we desire. We
purchased land here specifically because it was zoned agricultural and not industrial. With
industrial zoning, even "medium industrial zoning" such as comes with being re -zoned to I-2
uses, may have a significant impact on thequality of life we now enjoy.
Our house was built near the property line that runs between Duran Excavation and our
property. This was done to beep the house out of the flood zone. Our house is off the property
line about 70 feet. I have shown this in the picture below. Please draw your attention to the lower
right -Band corner of the picture. An aqua arrow points to a red line that identifies the distance
between our house to the property line. With development in a medium industrial zone comes
noise, dust and visual disturbances that are not associated with property zoned for agriculture thus
my concerns,
Despite our concerns about re -zoning of the Duran property, we are not against reasonable
development there. Our biggest concern, with or without re -zoning, is providing a barrier along
the property line that prevents, dust, noise, and visual disturbances. It seems building a sizable
berm along the property line may be an easy solution to this situation ;liven that they arc in the
excavation business. They appear to have plenty of equipment to get the job done as well as the
material to do so. See pies below taken from my driveway on 2/5/21 for the benefit of this letter
we currently have no complaints with the management of their property. When the wind has
blown trash over, they have came and offered to clean it up. When the lights were too bright, they
adjusted to reduce the light pollution we experienced on our property. The light can still be an
issue but is better than it was. While these past issues have been rectified, it does demonstrate that
they happen. The frequency in which they happen will be increased with medium industrial
zoning.
It seems that since they arc an excavation company, and they have the material on hand it would
be an easy solution to build a sizable berm (15-20 feet high) along the property line that would
tape care of most issues that may come with 1-2 zoning. Would this be feasible'
I have not researched 1-2 zoning and am not against future development on the Dur property
with appropriate conditions being put in place to prevent noise, dust, and visual disturbances. Is
there anything else I should be aware of? Does the Department of Planning and Zoning
permitting process notify me of those things or do my wife and I need to seek legal advice? I do
not believe legal advice is required at this time but could certainly get that if needed to establish
reasonable conditions.
