HomeMy WebLinkAbout20210662.tiffHEARING CERTIFICATION DOCKET NO. 2021-15 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR21-0001, FOR ACCESSORY BUILDINGS WITH GROSS FLOOR AREA LARGER THAN FOUR PERCENT (4%) OF THE TOTAL LOT AREA IN THE A (AGRICULTURAL) ZONE DISTRICT — ZACHARY FRANK AND BRANDI MCCLEARY A public hearing was conducted on March 10, 2021, at 10:00 a.m., with the following present: Commissioner Steve Moreno, Chair Commissioner Scott K. James, Pro-Tem Commissioner Perry L. Buck Commissioner Mike Freeman Commissioner Lori Saine Also present: Acting Clerk to the Board, Jan Warwick Assistant County Attorney, Bob Choate Planning Services Department representative, Maxwell Nader Public Works Department representative, Melissa King Health Department representative, Lauren Light The following business was transacted: IE I hereby certify that pursuant to a notice dated January 22, 2021, and duly published January 24, 2021, in the Greeley Tribune, a public hearing was conducted to consider the request of Zachary Frank and Brandi McCleary, for a Site Specific Development Plan and Use by Special Review Permit, USR21-0001, for Accessory Buildings with gross floor area larger than four percent (4%) of the total lot area in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. el Maxwell Nader, Department of Planning Services, presented a brief summary of the proposal, explained the lot is approximately one (1) acre, thus the combined accessory size is restricted to 1,834 square feet, which may be exceeded if approved, per Section 23-3-68 of the Weld County Code. Mr. Nader stated a house and a 440 -square -foot attached garage are currently onsite; therefore, the applicant is currently allowed 1,394 square feet for an accessory building structure and they desire to build an accessory structure pole barn that is approximately 2,400 square feet in size, which exceeds the 4% requirement by approximately 1,000 square feet or is approximately 6% of the total lot area. Mr. Nader relayed no correspondence has been received from the surrounding property owners (SPOs), and the site is located within the three (3) mile referral area and the Coordinated Planning Agreement (CPA) of the City of Fort Lupton, who did not return a referral. Mr. Nader entered the favorable recommendation of the Planning Commission into the record as written and displayed images of the site and surrounding views. Melissa King, Department of Public Works, provided a brief overview of the transportation plans and requirements, explained the parcel has an existing unpermitted access onto Patrick cc: PLCMn/TP), PwcrnK/O,4O, EH(LL) O`'I /3O (el 2021-0662 PL2791 HEARING CERTIFICATION - ZACHARY FRANK AND BRANDI MCCLEARY (USR21-0001) PAGE 2 Street via Casler Avenue; therefore, the applicant will be required to obtain an access permit. She relayed Patrick Street is a gravel road and is designated on the Weld County Functional Classification Map as a local road, no traffic counts are available, no additional traffic will be generated for the project, and the Drainage Narrative submitted states the site meets the drainage exception. In response to Commissioner Freeman, Ms. King confirmed the access was already in place; however, the permit will need to be approved. e Lauren Light, Department of Public Health and Environment, stated the existing residence is served by an individual well and septic system that is permitted for four (4) bedrooms. She noted no Development Standards are required, and staff ensured the applicant meets the ten (10) -foot setback requirements from the leach field. Ms. Light confirmed staff has no concerns with this request. e Zack Frank, applicant, stated he wants the garage for storing personal cars. IE No public testimony was offered concerning this matter. • In response to Chair Moreno, Mr. Frank relayed he had no questions concerning the Conditions of Approval or Development Standards. IR The Board agreed there are no changes or corrections to the Conditions of Approval or Development Standards. El Commissioner Saine moved to approve the request of Zachary Frank and Brandi McCleary for a Site Specific Development Plan and Use by Special Review Permit, USR21-0001, for Accessory Buildings with gross floor area larger than four percent (4%) of the total lot area in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as presented. The motion was seconded by Commissioner Buck. EI M• r. Frank stated he has reviewed and agrees to abide by the Conditions of Approval and Development Standards as presented.
