It is not necessary and does not have anything to do with the zoning change request. 2. It is approved as is by the county and was approved and moved because of the same concerns addressed in 2014 that Public works has not addressed as of today. 3. The access has been there for decades and the request is a recommendation based on the possible construction of county road 54, which will require the county to purchases an estimated 600 feet by 30 feet of Lot 1. If access needs to be moved it can be done when and if construction starts. The owner of Lot 1 must sell part of their lot to widen the highway; access should be addressed at that time if needed, 4. It is not only the access for Lot 1 but for other people and companies as well and that has not been addressed by Public Works. 5, Lots 1,2,6,7 all have existing permitted and approved buildings by the county that would or could be used for ADU use. A majority of the lots already have existing buildings and in no way affect the ADU zoning change request (example building envelopes, drainage, traffic, etc.) 6. A completed and accepted application was paid for in January of 2021 by all owners of the subdivision (total of 7 owners). The access change has never been brought up as a possibility or even a concern until April 7#"', 2021. In fact at the meeting in Johnstown in 2018, that was held by the county/ We were assured with the possible construction of the Freedom Parkway it would not affect Lot f's access. We have recently upgraded the gate system for about $ 5500.OD(see receipts) in March of this year because of the county's previous assurances. We had no reason to believe otherwise. 7. It is not only moving an access, it is moving a gate, large brick pillars, electrical and gravel at a great expense to the owner of Lot 1, this request is a recommendation based on what might happen if construction were to start on county road 54. It is our understanding the county has no projected or actual date of when construction could start. We would like to know the actual date or guarantee of when construction will start if it exists. (see pictures) 8. It is an unnecessary financial burden (see paid invoices and estimate) on the owner of Lot 1 on a possibility. We will provide more estimates of total cost to move access, unable to provide a l l estimates with such short notice. 9. By making the access change a condition of ACLU zone approval, the county will affect property values in the Lakota Lakes Ranch PUD, if not approved because of a recommended access change. I understand that you are requesting a change to Lot 1 access because it is possible that someday the county will widen county road 54. Could you clarify if the Freedom Parkway is fully funded and if construction is going to start and when? How many years will it be before county rd 54 in front of Lot 1 will start construction? Is it possible that county road 54 would never be widened? Or that the Freedom Parkway never is completed? Has it been started or is it in the planning stages? I notice that the reference exhibit states that Appendix J is Access Inventory and Recommendations. Does this mean that it is in planning stages and still working on details that could still change over the next 2-10 years before it even starts? We attended the 2018 Freedom Parkway meeting in Johnstown and were told that our access was not going to be taken, so imagine our surprise to find out on April 7th 2021 the public works department request to change access to Lot 1, after all the meetings, phone calls and paperwork and never once was brought u p «� It is access for ditch cleaning, out lot D, and a future right away as well as our driveway. If access is taken, is it taken from all people/companies needing access listed above? We are not completely opposed to moving our access but we have concerns that need to be addressed first. We have tried to set up a meeting but no one is available till April 23(d 2021. We want to notify the HOA as soon as possible and will be doing so on April 14th 2021 at our annual HOA meeting with a copy of this memo. It is our understanding that if county road 54 is widen, the county will be purchasing part of lot l to complete the 70 feet needed for the widening of cr54, access can be moved at that time if needed. The change of Lot l's driveway does not affect the zoning application to allow for ADU buildings in the Corrected Lakota Lakes subdivision. Dustin and I actually had a face to face meeting with Diana Aungst and maybe it was Zack in the beginning stages of the application. We had our 1st Pre -Application review request meeting on 7/17/2020 and this was never brought up at that meeting or any other meeting. It has never been brought up throughout the whole application process, not even once, not even as a possibility until April 7th 2021, 13 days before our scheduled PC hearing. This is very alarming because the subdivision has paid thousands of dollars and there was never any indication that this could happen. We are aware that widening county road 54 will require us to sell part of lot 1, if construction progresses, but our current access has lots of room to be moved back from county road 54, It is wrong to bring this up last minute and make it a condition of an ADU approval; it does not affect the zoning request but does affect ALL the other homeowners at the La kota Lakes subdivision. The ADU zone Change is for limited use in Lakota Lakes Subdivision and is limited to 1000 square feet. If your ADU building is larger than that, then a commitment letter from Little Thompson Water District is required. We have applied for a commitment letter and are waiting their decision. Finally we moved our access in 2014 and county approved it because of easements and the location of the power box that was installed. We have found out that it was put in the wrong easement and a different one was granted which could affect lot 2 someday and actually the original easement was not removed. This is the way I understand it, It can be very confusing. We are not completely opposed to moving our access. If we move our access then we would like the county to guarantee that space remaining is large enough for a driveway to be built to any and all county and state codes and can easily be compiled without large financial investment. We are requesting the county will guarantee that there will be no liability to the owner or future owners of Lot 1, because there is no reason to change access at this time. This is a request on the possibility that the road will be widened someday. It has nothing to do with the zoning request for ADU usage. We also need the county to address all other people/businesses right to access the property from the access currently being used today. Please address the how each person or business will be affected. We changed the access in 2014 and the county approved the change of access because of easements and a power box; nothing has changed so they need to explain why access wasn't originally given in 2014. We still want to meet on April 23rd with public works in an effort to reach a resolution. we are asking that the BOCC approve the ADU zone request without change of access for the following reasons. 1. The change of access does not affect the request for zone change in any way and the ADU application was completed, reviewed and accepted by the county in January of 2021, all fees were paid. 2. The request to change access has been made after the completed application accepted with no indication that this could come up, only 13 days before PC meeting. 3. The request affects several land owners and they have a substantia! financial investment in the zone request change. 4. If the road is ever widened access can be moved at that time at no harm to the other landowners or the county.
