HomeMy WebLinkAbout20213262.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO WEDNESDAY, NOVEMBER 24, 2021 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, November 24, 2021, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Steve Moreno, Chair Commissioner Scott K. James, Pro-Tem Commissioner Perry L. Buck Commissioner Mike Freeman Commissioner Lori Saine Also present: Assistant County Attorney, Karin McDougal Acting Clerk to the Board, Houstan Aragon Controller, Chris D'Ovidio ... = MINUTES: Commissioner Buck moved to approve the Minutes of the Board of County Commissioners meeting of November 10, 2021, as printed. Commissioner Saine seconded the motion, and it carried unanimously. CERTIFICATION OF HEARINGS: Commissioner James moved to approve the Certification of Hearings conducted on November 10, 2021, as follows: 1) COZ21-0003 — Highpoint Operating Corporation, do JSB Interests, LLLP. Commissioner Buck seconded the motion, which carried unanimously. El PUBLIC INPUT: Sonia Miller, City of Greeley resident, expressed her disapproval of Weld County's Facebook posts regarding the COVID-19 vaccine. Jamie Weber, City of Greeley resident, also expressed her concerns regarding the COVID-19 vaccine and information shared by government agencies. Timothy Phippard, Town of Kersey resident, likewise referenced the COVID-19 vaccine flyers sponsored by the Department of Public Health and Environment. In response, Commissioner James clarified the Board accepted grant funds from the State of Colorado and have used $6,000.00 of said funds to research the rate of vaccination of Weld County residents. He further stated he and his fellow Commissioners have heard the concerns of the public and will no longer be advertising information pertaining to COVID-19 vaccinations. Chair Moreno explained Commissioners Buck and Saine were not elected to the Board of County Commissioners at the beginning of the pandemic and may not have reviewed and approved all grant applications related to COVID-19. Commissioner Saine stressed the importance of personal responsibility and medical freedom. Commissioner Freeman stated he, Commissioner James, and Chair Moreno discussed Weld County's policy to not enforce mask or vaccine mandates with Governor Jared Polis. 1/3 Minutes, Wednesday, November 24, 2021 Page 1 2021-3262 BC0016 El AMENDMENTS TO AGENDA: There were no amendments to the agenda. El CONSENT AGENDA: Commissioner James moved to approve the Consent Agenda, as printed. Commissioner Freeman seconded the motion, and it carried unanimously. Ei BIDS: 1) PRESENT BID #B2100140, FIRE ALARM MESH RADIO EQUIPMENT - FACILITIES DEPARTMENT: Rob Turf, Purchasing Department, stated staff received eight (8) bids and will make a recommendation for approval on December 8, 2021. El 2) PRESENT BID #B2100143, 1417 'O' ST DEMOLITION PROJECT - FACILITIES DEPARTMENT: Mr. Turf stated staff received seven (7) bids and will make a recommendation for approval on December 8, 2021. IR NEW BUSINESS: 1) CONSIDER CONTRACT ID #5392 NON-EXCLUSIVE LICENSE AGREEMENT FOR CONSTRUCTION, MAINTENANCE, AND/OR USE OF IRRIGATION FACILITIES WITHIN COUNTY ROAD 66 RIGHT-OF-WAY, AND AUTHORIZE CHAIR TO SIGN - BLISS LATERAL COMPANY, AKA BLISS IRRIGATION COMPANY: Clay Kimmi, Department of Public Works, stated the non-exclusive license agreement allows Bliss Lateral Company to relocate into the right-of-way on County Road (CR) 66 as a part of the CRs 66 and 41 Intersection Improvements Project, in exchange for a deed of dedication for donated land on the north side of CR 66. Commissioner Freeman moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner James and it carried unanimously. El 2) CONSIDER ACCEPTANCE OF DEED OF DEDICATION FOR PUBLIC ROAD RIGHT-OF-WAY FOR CRS 66 AND 41 INTERSECTION IMPROVEMENTS PROJECT AND AUTHORIZE CHAIR TO SIGN - BLISS IRRIGATION COMPANY, AKA BLISS LATERAL COMPANY: Mr. Kimmi stated the deed of dedication is in relation to Item #1 under 'New Business' and is in exchange for the non-exclusive license agreement as stated above. Commissioner James moved to accept and approve said deed of dedication and authorize the Chair to sign. Seconded by Commissioner Buck, the motion carried unanimously. El 3) CONSIDER QUIT CLAIM DEED TO TRANSFER PROPERTY FROM WELD COUNTY TO JAMES AND ALICE SMITH AS PART OF THE CR 49 CORRIDOR PROJECT AND AUTHORIZE CHAIR TO SIGN: Cameron Parrott, Department of Public Works, stated the quit claim deed is to transfer interest in ownership in an area that was part of the County Road 49 land swap. Commissioner Freeman moved to approve said quit claim deed and authorize the Chair to sign. Commissioner James seconded the motion and it carried unanimously. 4) CONSIDER CANCELLATION OF CERTAIN OUTSTANDING ACCOUNTS RECEIVABLE FOR THE WELD COUNTY TREASURER - PERSONAL PROPERTY, REAL ESTATE, AND OIL AND GAS ACCOUNTS: John Lefebvre, Weld County Treasurer and Public Trustee, provided a brief overview of the items deemed as uncollectable and stated approximately $79,000.00 is requested to be cancelled. In response to Commissioner Buck, Mr. Lefebvre stated he typically requests around $30,000.00 - $50,000.00 to be cancelled, but this year's request is higher due to business disruptions in response to the events over the past year. Commissioner Freeman moved to approve said cancellation of certain outstanding accounts receivable. The motion was seconded by Commissioner Saine and it carried unanimously. The motion was seconded by Commissioner Buck and it carried unanimously. ;, 6) CONSIDER REAPPOINTMENT TO JUVENILE COMMUNITY REVIEW BOARD: Commissioner Buck moved to approve said reappointment. The motion was seconded by Commissioner James and it carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
