HomeMy WebLinkAbout20213325.tiffRESOLUTION RE: APPROVE AMENDED BYLAWS FOR UTILITIES COORDINATING ADVISORY COMMITTEE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated September 10, 1986, the Board ratified the Bylaws for the Utilities Coordinating Advisory Committee, and WHEREAS, the Board has been presented with revisions to said Bylaws, and WHEREAS, after review, the Board deems it advisable to amend said bylaws, a copy of which are attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the amended Bylaws for the Utilities Coordinating Advisory Committee, be, and hereby are, approved. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 6th day of December, A.D., 2021. B k Lori Saine CC go cc(ycF), PL(rpIKR), CA(ALL) 12/i5 /2 I 2021-3325 PL0084 BYLAWS UTILITIES COORDINATING ADVISORY COMMITTEE Article I - Name of Committee The Committee shall be called the Utilities Coordinating Advisory Committee in conformance with the resolution creating the committee which was adopted by the Board of County Commissioners on August 19, 1970, as subsequently amended. Article II - Functions of the Committee The functions and duties of the Utilities Coordinating Advisory Committee are to assist and advise the Board of County Commissioners of Weld County to obtain and maintain the following purposes: X To provide an orderly and efficient planning process for any service or utility using the public thoroughfares. X To review all subdivision plats for conformance with established industry standards for the placement of utilities within subdivisions. Article III - Membership of Committee A. Membership - The Committee shall consist of six (6). The membership shall include four (4) members from the following group: (1) One representative from a Sanitation district or municipal sewer department; or (2) One representative of a gas utility; or (3) One representative of an electric utility; or (4) One representative of a telephone utility; or (5) One representative of a water district; or (6) One representative of a fire protection district; or (7) One representative of a ditch company. The membership shall include as the fifth and sixth members a representative from both the Weld County Public Works Department and the Weld County Planning Department. Page 1 of 4 Pages B. Appointment of Members - The members of the Committee, except for the Director of the Weld County Public Works Department (or his/her designee) and the Director of the Weld County Planning Department (or his/her designee), shall be appointed by the utilities, districts, or departments which they represent using a method acceptable to those entities. If the utilities, districts, or departments cannot agree upon a representative for appointment, or if the utilities, districts, or departments for any reason do not appoint a representative, then the Board of County Commissioners shall make such appointment at the discretion of the Board. C. Terms of Members - The terms of members of the Committee shall be for such time as the utilities, districts, or departments they represent desire. All represented utilities, districts, and departments shall notify the Board of County Commissioners of the name and term of their representative. No regular member of the Committee shall be absent for more than one-third (1/3) of the meetings of the Committee during any consecutive three (3) month period. D. Alternate Members - Each member shall designate an alternate member who may attend Committee meetings in the member's absence and have the full rights and responsibilities of membership. Article IV - Officers A. The Committee shall elect from its own members a Chairman and Vice -Chairman. Term of office shall be for one year. B. In the absence of the Chairman, the Vice -Chairman will act in that capacity. C. In the absence of the Chairman and the Vice -Chairman, a temporary Chairman will be selected by the Committee. D. A recording secretary shall be provided by the Weld County Department of Planning Services. Article V - Nomination and Election of Officers The annual nomination and election of officers shall be held during the first regular meeting of each calendar year. Each nomination shall be seconded to be placed on the ballot, and elections shall be written ballot unless there is no contest for the office. Page 2 of 4 Pages Article VI - Meetings A. Regular meetings of the Committee will be on the second and fourth Thursdays of each month provided there is business to conduct. B. Written notice of all regular meetings will be mailed at least one week prior to the meeting date. C. Special meetings may be called when deemed necessary by the Chairman or the Department of Planning Services. D. A quorum shall consist of not less than three members of the Committee. Attendance may be by telephone or other electronic communications. A quorum will be necessary at any meeting where the agenda includes: (1) (2) (3) (4) Changes in bylaws. The concurring vote of a majority of those present shall be required to report favorably any recommendations to the Board of County Commissioners. Votes to abstain shall neither be considered a "yes" nor a "no" vote. F. Robert's Rules of Order shall prevail to the extent they are not in conflict with specific provisions of these Bylaws. Article VII - Duties of Chairman It shall be the responsibility of the Chairman to call all regular meetings, preside at all meetings, appoint committees, when and as required, and carry out general chairman responsibilities. Article VIII - Duties of Vice -Chairman It shall be the responsibility of the Vice -Chairman to assume the duties of the Chairman in Page 3 of 4 Pages his absence. Also, he shall perform other duties assigned by the Chairman. Article IX - Duties of Secretary It shall be the responsibility of the secretary to send members notices of all meetings, and keep minutes of all such meetings. Article V - Amendment of Bylaws These Bylaws may be amended at any meeting of the Committee by vote of the majority of the entire membership of the Committee, provided seven (7) days notice has been given to each member of the Committee, and then by approval of such amendment(s) by an affirmative vote of the Board of County Commissioners of Weld County. Page 4 of 4 Pages MINUTES OF THE WELD COUNTY UTILITIES ADVISORY COMMITTEE A regular meeting of the Weld County Utilities Coordinating Advisory Committee was held on Thursday, November 18, 2021 at 10:01 a.m., in the Hearing Room of the Weld County Planning Department at 1555 N 17th Ave, Greeley, Colorado. Members Present: Mike McRoberts, Amy Mutchie, Mark Alessi, Robert Fleck, Denise Beltran, and Shelly Bergstrom. Members Absent: Michael Wailes, Jared Rauch, Jerry Adams, Jeremy Young, and Lucas McConnell. Also Present: Michael Hall and Kris Ranslem, Department of Planning Services and Michelle Wall, Secretary. Kris Ranslem, Planning Department, presented the proposed Amendments to the Utilities Coordinating Advisory Committee's Bylaws. She stated that there was a staff reorganization which included moving the Engineering representative from the Department of Public Works to the Department of Planning. Therefore, staff is requesting that the Bylaws reflect one representative from both the Department of Public Works and the Weld County Planning Department to serve on the Utilities Coordinating Advisory Committee. Motion: Accept the proposed amendments to the Utilities Coordinating Advisory Committee Bylaws and recommend approval to the Board of County Commissioners, Moved by Mark Alessi, Seconded by Robert Fleck.
