RE: APPROVE VACATION OF SPECIAL USE PERMIT, SUP -338 - CLOUDWALKER
DYNASTY, LLC, C/O ARTHUR MAESTAS, III
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution #77-0229, dated October 26, 1977, the Board approved
Special Use Permit, SUP -338, for a gravel pit in the A (Agricultural) Zone District, for Curtis Strong
on the following described real estate, to -wit:
Lots A and B of Recorded Exemption, RECX19-0002; Lot A
of Amended Recorded Exemption, AMRE-2151; Lots A
and B of Corrected Recorded Exemption, RE -2152;
Lots 1-3 of Pence Minor Subdivision; and part of Lot B of
Amended Recorded Exemption, RE -2151 (CDOT-ROW), all
in Section 21, Township 3 North, Range 67 West of the
6th P.M., Weld County, Colorado
WHEREAS, the Board has received a request from one of the current property owners,
Cloudwalker Dynasty, LLC, c/o Arthur Maestas III, 14151 County Road 19, Platteville,
Colorado 80651-9114, to vacate said Special Use Permit, SUP -338, and
WHEREAS, the Department of Planning Services staff recommended the vacation of
Special Use Permit, SUP -338, due to the applicant's request and non -active Colorado
Department of Natural Resources, Division of Reclamation, Mining, and Safety Permit,
#M-1997-0150, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendation of the
Department of Planning Services staff and all of the exhibits and evidence presented in this matter
and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Special Use Permit, SUP -338, be, and hereby is, vacated.

NARRATIVE: The Department of Planning Services, on January 27, 2021, received the
attached letter from Arthur Maestas III, manager of Cloudwalker Dynasty, LLC,
requesting a vacation of the gravel mining use by special review permit, SUP -
338, covering his property, Lots A and B of RECX19-0002.
The permit also covers several other properties, including the Pence Minor
Subdivision. The first notice was sent to all affected property owners on January
29, 2021. One objection was received via phone indicating that mining was still
a desired future possibility on the site, so the vacation request was put on hold.
However, it has come to staff attention that the DRMS permit, M1997-0150,
associated with SUP -338 is no longer active. A new permit would be required
by the state, should a new mine be desired in this location. Therefore, since the
associated DRMS permit is defunct, staff finds grounds to request the vacation
in spite of the objection. A new USR permit would be required with a new DRMS
permit for future mining activity.
Second notice will be sent prior to the vacation hearing. The draft notice is
attached.
The Department of Planning Services staff has reviewed this request and recommends that this
request be approved.

M1997-0150 does not exist at the State as an active or inactive status DRMS Permit.
Therefore, I would accept the request to vacate the USR for mining.
I would also suggest that a Certified Letter be sent to the representative for Strong Farms informing this group of this decision.
If there are valid documents demonstrating that a State Permit remains active ask for such documentation

Hi, Angela,
I'm the Realtor hired by Mr. Maestas to sell Lot A of his recorded exemption. The property is under
contract and the buyer was told that the mineral rights are owned by 'Ready Mix Sand and Gravel Co.', that
they have the right to mine that property whenever they want to, and building is not allowed on the
property.
When I passed along that information to Mr. Maestas, he said he thought all mining on the property
occurred way back in the 1950-1970's, wherein a part of that process was to remove the railroad tracks
from an abandoned line that ran across the property, at that time. He thought dirt was brought in
afterwards and, since then, there is no more right to mine the property.
I attached some information about the property, along with a handwritten note from Mr. Maestas, which
was previously emailed to you, for the County, removing said right to mine.
Are you able to verify the accuracy of this information, and, if not, can you please point me in the direction
of someone who can? Ultimately, what I'm looking for, is any proof I can give to the new buyers that mining
is no longer allowed on this land and that the buyer can, indeed, build his home and some outbuildings
there.

plat to review from a sun'eyor and there are outstanding conditions that were never completed. For each three month extension (plat was due
May 6, 2019), there is a S50 charge. If you with to proceed with the application, you must contact us to explain your extenuating
circumstance for not meeting conditions in a timely manner. If we do not hear from you within two weeks of this email (April 6, 2020), then
we will expire the conditional approval and you will need to submit a new application if you would like to still split your property by recorded
exemption.

RE: APPROVAL OF SPECIAL USE PERMIT ?OR A GRAVEL PIT TO CURTIS
STRONG, P. O. BOX 10, PLATTEVILLE, COLORADO 80651.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, held a public hearing on the 26th day of October, 1977,
at the hour of 2:00 o'clock p.m., in the Chambers of the Board
of County Commissioners, for the purpose of hearing the appli-
cation of Curtis Strong, P. O. Box 10, Platteville, Colorado 80651,
for the granting of a Special Use Permit for a gravel pit on the
following described real estate, to -wit:
A parcel of ground located in the Northeast Quarter (0)
and in the East Half (Eh) of the Southeast Quarter (SEA}
of Section 21, Township 3 North, Range 67 West of the
6th P.M., Weld County, Colorado, being more particularly
described as follows:
Beginning at the Southeast Corner (SE Cor) of said
Section 21, and considering the East line of said
Section 21 as bearing North 00°11'24" West, with all
other bearings contained herein relative thereto;
Thence North 00°11'24" West along the East Line of said
Section 21, 5295.10 feet to the Northeast Quarter
(NE Cor) of said Section 21;
Thence North 88°54'27" West along the North line of said
Section 21, 2012.29 feet to a point on the Easterly right-
of-way line of the Union Pacific Railroad; Thence
South 11'25'46" West along said Right -of -Way line 2000.00
feet; Thence South 81°55'51" East, 1257.9 feet;
Thence South 01°25'51" West, 2555.35 feet; Thence
South 42°20'19" East, 464.31 feet;
Thence South 12°07'25" East 293.02 feet to a point on the
South line of said Section 21; Thence South 89°11'26" East
along the South line of said Section 21, 870.00 feet to
the Point of Beginning.
Said described parcel of ground contains 191,301 Acres
more or less, including strips of ground 30 feet in width
along the South and East lines containing 4,225 Acres, more
or less, are reserved for County Road Right -of -Tay purposes,
and is subject to any other rights -cif -way or other easements
as may be granted or reserved by instruments of record or
as now existing on said parcel of ground.

WHEREAS, evidence was presented in support of the grant of
the Special Use Permit for the gravel pit on the above -described
real estate, and
WHEREAS, Section 3.3. E.4.1. of the Weld County Zoning
Resolution authorizes such a use in an Agricultural District
on the grant of a special use permit by the Board of County Com-
missioners, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, heard all the testimony and statements of those present,
has studied the request of the petitioner and the recommendations
of the Weld County Planning Commission and all of the exhibits
and evidence presented in this matter, and having been fully
informed and satisfied that the request for a Special Use Permit
for a gravel pit on the hereinabove described real estate, com-
plies with all of the conditions as set out in Section 3.3.E.4.1.
of the Weld County Zoning Resolution;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the application of
Curtis Strong, P. O. Box 10, Platteville, Colorado 80651, for
a Special Use Permit for a gravel pit on the hereinabove describ-
ed tract of land, be, and hereby is, granted subject to the
Reclamation and Extraction standards contained in the Special
Use Permit.
BE IT FURTHER RESOLVED by the Board of County Commissioners,
that the reasons for approval contained in the Planning Commis-
sion recommendations dated September 6, 1977, be, and hereby are,
incorporated as the findings of fact of the Board of County Com--
missioners in this matter.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 26th day of
October, A.D., 1977.
