The building permit (ASN21-0006) is valid until 01/26/2022. I will be sending him a courtesy reminder advising that if he
does not finish the building by the due date, my violation case will be reopened and immediately forwarded to the
County Attorney's Office.

Thank you for the update.
Is there any indication of WHEN the new 'building' will occur? ...or can we expect the half -dozen
storage containers to remain as they are for years to come?
I'm sure that you can appreciate our disappointment with the outsome. Apparently our relief at being
rid of an eyesore was precipitate; it seems that even denial of a USR can be converted to a win for
the owner of said eyesore.
That said, we appreciate your efforts.

First, thank -you for taking your time to bring your concerns to our attention. As USR20-0016 (which was to permit 6 cargo
containers as individual structures) was denied, I am responding to your inquiry.
Regarding 2831 175th Ave (Owner: Bryan Edwards Parcel #: 146733101003): I personally looked at numerous titles, bill
of sales and registrations regarding the vehicles that Mr. Edwards has in his back yard. The on -site vehicles do belong to
him and/or his roommate. The Screening of a Noncommercial Junkyard is an allowed use in the Agricultural Zone
District, such as Ranch Eggs is zoned and was never part of the Use by Special Review (USR) application.
Additionally, Mr. Edwards did apply for a building permit to convert 6 - 8x40 cargo containers into a single structure as our
code allows. Please reference ASN21-0006 which was issued on January 26, 2021.

The recent photo [attached] shows that the property associated with USR20-0016 continues to house
containers and vehicles in excess of county allowance. This e-mail is a request for an update.
As a refresher, the USR request to continue housing these vehicles was rejected by Weld's BOCC on
10/14/20. Planning was tasked with verifying ownership [via titles] of the vehicles and, following that,
ensuring that the extra cargo containers and non -titled vehicles were removed. The recent photo
shows 4 cargo containers and no apparent reduction in the number of vehicles.
Would you please report progress made in the past 10 months?
What can we expect in future and in what timeframe?

Screening Options for
Noncommercial
Junkyards
The purpose of this document is to
provide guidance to all Weld County
citizens regarding available screening
options for noncommercial (private)
junkyards in the Agricultural Zone
District. The Weld County Code
requires noncommercial junkyards to
be completely screened from all
adjacent properties and public rights -
of -ways.
Definitions ...
NONCOMMERCIAL JUNKYARD: An
area where any waste, JUNK or used or
secondhand materials are stored or
handled, including but not limited to scrap
iron and other metals, paper, rags, rubber
tires, building materials and bottles. A
NONCOMMERCIAL JUNKYARD may also
include the storage or keeping of
DERELICT VEHICLES registered last or
currently registered under the property
owner and/or tenant's name. This definition
does not include COMMERCIAL
VEHICLES. If the Zone district allows, the
NONCOMMERCIAL JUNKYARD shall be
totally ENCLOSED within a BUILDING or
STRUCTURE or visually SCREENED from
all ADJACENT properties and PUBLIC
RIGHTS -OF -WAY.
JUNK: Scrap brass, iron, lead, tin, zinc; all
other scrap metals and alloys; bones; rags;
used cloth, rope, rubber, tinfoil, bottles, old
or used machinery of any type; used tools;
used appliances; used lumber or crates;
building materials; fabrication of any
material; used pipe or pipe fittings; used
conduit or conduit fittings; used automobile
parts; DERELICT VEHICLES; used tires
and other manufactured goods that are so
worn, deteriorated or obsolete as to make
them unusable in their existing condition.
DERELICT VEHICLE: A vehicle that is
inoperable (unable to move under its own
power); is partially or totally dismantled; has
all or portions of its body work missing or is
substantially damaged; does not have valid
registration with the State, as required by
C.R.S. Sections 42-4-202(4), 42-12-301 or
42-12-401, and/or the number plate
assigned to it is not permanently attached to
the vehicle, as required by C.R.S. Section
42-3-202; or is lacking proper equipment to
the extent that it would be unsafe or illegal
to USE on PUBLIC STREET/ROAD
RIGHTS -OF -WAY or otherwise not
equipped with lamps and other equipment,
as required in C.R.S. Sections 42-4-204 to
42-2-230. This definition shall not include
implements of husbandry, farm tractors or
vehicles customarily operated in a
FARMING operation.
SCREENED: Construction and
maintenance of fences, earth berms or the
USE of LANDSCAPING materials or other
materials USED with the approval of the
Department of Planning Services to lessen
the noise, light, heat or visual impacts of a
USE on surrounding uses. A SCREENING
PLAN shall be submitted and approved by
the Department of Planning Services.

Do's & Dont's of Fences...
The entire fence shall be
constructed of the same material, style,
and appearance.
Building Permits are not
required, unless it is a retaining or
structural wall that exceeds 4 feet in
height.
Fences may NOT be installed in
the right-of-way or easement without the
consent or approval of the interested
party.
Fences may extend to the
property line provided it does not create
a traffic hazard, such as reduced
visibility of on -coming traffic.
Fences typically range in height
from 6 to 8 feet in height.
All fences shall be maintained in
good structural condition and in good
repair at all times. This includes paint,
stain, panels or pieces, and holes.
A fence is NOT allowed in the
Flood way. A Floodplain Development
Permit (FHDP) is required for a fence in
the Floodplain Overlay District.

Proposed variations from the above
materials can be requested by
submitting a picture of the type of
material and general description of
installation to your designated
Compliance Officer.
Policy: Cargo Containers as a Structure

Purpose: The purpose of this policy is to provide staff direction when multiple cargo containers are
utilized as 1 (one) continuous engineered structure.
Responsibility: All Staff
Policy:
This policy is intended to recognize multiple cargo containers when structurally engineered to be
utilized as 1 (one) structure.
When the containers are used as components of the structure (walls), they may be stacked or modified,
provided they are designed, engineered and drawings stamped by a Licensed Colorado Engineer and
plans are provided to our office at time of application. The structure must comply with Zoning
Regulations per Chapter 23, as amended. Cargo Containers shall not be allowed as "Ag Exempt"
structure due to the requirements of engineered plans and zoning regulations.
When the structure is completed, prior to obtaining a Final Approval or Certificate of Occupancy,
pictures must be submitted to the Director of Planning for a determination regarding the appearance.
It must be aesthetically pleasing and not appear to be a cargo container or series of cargo containers.
Possible ways of achieving this, may include, but are not limited to, painting all containers the same
color as the rest of the structure, skinning the outside, et cetera.
