ASSISTANCE FUND (EIAF) PROGRAM FOR COUNTY ROAD 43 IMPROVEMENTS
PROJECT (MARCH CYCLE -TIER I) AND AUTHORIZE ELECTRONIC SUBMITTAL
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Grant Application for the Energy and
Mineral Impact Assistance Fund (EIAF) Program for the County Road 43 Improvements Project
(March Cycle -Tier I) from the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of the Department of Public Works, to the
Colorado Department of Local Affairs, Division of Local Government, with further terms and
conditions being as stated in said application, and
WHEREAS, after review, the Board deems it advisable to approve said application, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Grant Application for the Energy and Mineral Impact Assistance
Fund (EIAF) Program for the County Road 43 Improvements Project (March Cycle -Tier I) from
the County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, on behalf of the Department of Public Works, to the Colorado Department of Local
Affairs, Division of Local Government, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that Elizabeth Relford, Department of Public
Works, be, and hereby is, authorized to submit said application electronically.
The above and foregoing Resolution was, on motion duly made and seconded, adopted

SUBJECT: DOLA Application — 2021 March Cycle
In accordance with the work session held on October 13, 2020, Public Works is requesting
the Commissioners submit a Tier I energy and mineral impact grant to the Department of
Local Affairs (DOLA) for the March 1st cycle.
Public Works recommends submittal of the Tier 1 - $200,000 application for improving
WCR 43 from SH 263 (WCR 60.5) to SH 392. Total project cost is estimated at
$1,295,000. Therefore, the county's local match for this project would be $1,095,000. If
awarded, Public Works will use the grant funds to assist with purchasing cement treated
base (CTB) and asphalt materials for our crews to construct full depth reconstruction
(FDR) for this 3.75 -mile corridor. Pursuant to grant funding and the winter months, this
HARP project is anticipated to begin in the summer of 2021.

The Department of Local Affairs' (DOLA) Energy and Mineral Impact Assistance Fund (EIAF) program was created to assist
political subdivisions that are socially and/or economically impacted by the development, processing, or energy conversion of
minerals and mineral fuels. Funds come from the state severance tax on energy and mineral production and from a portion of the
state's share of royalties paid to the federal government for mining and drilling of minerals and mineral fuels on federally -owned
land. The creation of the fund is outlined in C.R.S. 34-63-102 (Federal Mineral Lease) and C.R.S. 39-29-110 (Severance). Grant
dollars are to be awarded for the planning; design, construction. and maintenance of public facilities and for the provision of
services by political subdivisions.
Requests in this Cycle 21-05 are for Tier I projects that are limited at up to $200.000 with a 50/50 match requirement. Tier I award

This project is needed due to the continued wear and tear occurring on this major collector connection due to heavy truck traffic.

Weld County requests funding to assist with the full depth reconstruction (FDR) of approximately 3.75 miles of WCR 43 from SH
263 (WCR 60.5) to SH 392. Weld County Public Works Crews will mill off the existing asphalt to a depth suitable for mixing
cement treated base (CTB) into the subgrade. The CTB will reinforce the subgrade structure to strengthen the foundation for the
asphalt to better handle heavy truck traffic. Then Public Works will pave the roadway with 6" of polymer asphalt. The asphalt
thickness along with the CTB will improve the lifecycle of the road with high truck traffic.

D. DEMONSTRATION OF NEED
The statutory purpose of the Energy and Mineral Impact Assistance program is to provide financial assistaice to "political
subdivisions socially or economically impacted by the development. processing or energy conversion of minerals and mineral
fuels."
a. Demonstration of need
Why is the project needed at this time? (2,500 character limit)
This project is needed to improve the safety of the WCR 43 corridor. WCR 43 is an important collector roadway between SH 263
(WCR 60.5) and SH 392 that serves many oil and gas operations as well as the agriculture community. See attached land use map.

Yes, completion of this project addresses the need and not only serves the oil and gas industry haul route with increased safety
but extends the life cycle of the road. which reduces the carbon footprint.

Weld County is trying to proactively improve the routes most impacted by the oil & gas industry. These grant funds are supplied
by the industry and vetted through DOLA to make us all partners in mitigating impacts created by the industry.

If funding is not awarded, this project will have to be deferred and this segment of road will succumb to increased traffic and
continue to deteriorate becoming an even greater safety issue than it is currently today.

This is a busy collector corridor having numerous oil & gas operations in the vicinity, a thriving agricultural community and
continued population growth. This project will enhance the livability of the region by improving the safety of this transportation
corridor.

Will this project implement an energy efficiency/strategy that could result in a reduction of the community carbon footprint,
increased conservation of energy, or does it capitalize on renewable energy technology? If yes, please describe. (2,500 character

Yes. this project builds on the strategies identified in the 2010 Colorado Resiliency Framework for achieving a resilient vision
pertaining to the Building & Infrastructure (BI) Sustainability goals by supporting a project that is climate and hazard resilient,
while also being environmentally sustainable. It will reduce the carbon footprint by constructing a more resilient corridor utilizing
recycled materials as well as more efficient trucking equipment which reduces vehicle emissions. Consistent with many
north/south roads being flooded in 2013, the reconstruction of this corridor will make it more resilient to future natural hazard
events, such as flooding.

Improvement Plan (CI P).

road impacted by the industry. Therefore, Weld County is requesting DOLA's partnership to ensure this project can be
implemented in a timely manner.

J. ENERGY & MINERAL RELATIONSHIP
a. Community energy or mineral impact
Describe how the applicant is, has been, or will be impacted by the development, production, or conversion of energy and mineral
resources (2,500 character limit).
Weld County is the #1 producing oil and gas county in the entire state, and therefore, is the most impacted county. The majority of
the county's traffic is attributed to the oil and gas industry.
b. Use data
Cite actual use data that documents direct impact as it relates to the need for the project. For example, "heavy truck traffic
directly related to energy development activities is impacting County Road X. A traffic count done in May 2020 showed energy
related truck traffic increased from 100 trips per day to 300." (2,500 character limit)
This corridor has current traffic counts for WCR 43 between SH 263 to SH 392 (3.75 mile segments). -Segment one is from SH
263 to WCR 62 and has 1,556 vehicles per day (vpd) with 33% of them being trucks. -Segment two is from WCR 62 to WCR 64
and has 1,501 vpd with 29% being trucks. -Segment three is from WCR 64 to WCR 66 and has 1, 668 vpd with 32% being trucks. -
Lastly, segment four is from WCR 66 to SH 392 and has 1,793 vpd with 42% of them accounting for trucks. The amount of trucks
on this corridor continue to contribute to the deterioration of the existing roadway.
K. MANAGEMENT CAPACITY

How will you separate and track expenditures, maintain funds and reserves for the capital expenditures and improvements as

Weld County's Accounting Department is recognized as a Tier 3 local government by the state. We manage all invoicing and
payments through our Banner Accounting System. In addition, Public Works uses project management software called PubWorks
to assist with grant management tracking.
b. Project sustainability
Describe the funding plan in place to address the new operating and maintenance expenses generated from the project? (2,500

If the grant is approved, the Commissioners will direct the funding be encumbered for this project. Weld County will cover any
unanticipated cost overruns with this project as part of our local match.

Based on our history to complete projects in a timely manner, Weld County Public Works has several engineers on staff with
proven expertise in roadway improvement projects. Barbara Connolly is the point of contact for this grant and Elizabeth Relford
will be responsible for managing the construction project.

This is a safety project and does not duplicate service capacity but enhances it. Current service is inadequate and inefficient to
meet current demands.
L. RESILIENCY CRITERIA
The Energy and Mineral Impact Assistance Program is required to integrate resilience criteria into the program. By bringing
resiliency considerations into project planning and implementation, projects should be better poised to benefit a number of sectors
(economy.. health, infrastructure, etc.), minimize long-term risks, and anticipate or be better prepared to respond to changing
conditions faced by Colorado communities.
The 2020 Colorado Resiliency Framework provides nine Resiliency Prioritization Criteria that can serve as a guide when planning a
project to enhance its long-term resilience. More information on the Resiliency Prioritization Criteria can be found at

Like all construction projects, the WCR 43 project adapts to uncertainty and changing climate, soc al znd economic
conditions by taking past challenges, such as flooding and a pandemic in order to prepare us for developing an informed and
improved construction project that is mindful of taxpayer dollars and schedule in order to be an example to other agencies so
they can also better respond to future uncertainty.

produce more economic benefits than it costs to implement it. Weld County crews self perform the improvements, which
reduce overhead and administration costs typically seen by contracting similar projects. As a result, more Weld County
residents will see sustainable benefits through improved physical and social conditions.

Weld County does not conduct projects in a vacuum. We coordinate with our surrounding communities and build projects
based on similar activities underway or recently completed, such as the City of Greeley's improvements on SH 263 (E. 8th
Street). We have met with our oil & gas partners and surrounding farmers in order to maximize efforts and reduce potential
conflicts.

The WCR 43 project addresses potential risks and vulnerabilities for infrastructure. Reconstruction of this corridor is taking
into consideration strategies, such as updated floodplain analysis to reduce vulnerabilities to the infrastructure and housing
sectors. Reinforcing this infrastructure will support the impacted unincorporated areas of Weld County classified as
vulnerable populations/communities, which this project applies.

The WCR 43 project allows Weld County to continue to be a pioneer in roadway projects. Unlike archaic construction
methods, Weld County has developed a full depth reconstruction (FDR) model that can be implemented by other agencies
experiencing high truck volumes on all types of roads. This project relies on new construction techniques, which require
equipment that can accept GPS surfaces to ensure construction efficiencies.

Weld County believes this project reaches the elderly, under -employed and minority populations. which is why the project
includes an improved roadway with paved shoulders to serve not only transit populations but safer bicycle/pedestrian
facilities, which builds community capacity. In addition, the Commissioners offer many public options to solicit public input,
including but not limited to social media, public meetings and Board hearings.

Weld County follows current construction best practices in the field and goes above and beyond implementing the minimum
construction standards. This philosophy is based on best management practices that provide a road map for success based on
performance measures, such as, fiscal responsibility with taxpayer dollars, high level project management expectations,
implementation of construction and grant schedules.
M. HIGH PERFORMANCE CERTIFICATION PROGRAM (HPCP) COMPLIANCE
Colorado Revised Statutes (C.R.S. 24-30-1305.5) require all new facilities, additions, and renovation projects that meet the following
criteria to conform with the High Performance Certification Program (HPCP) policy adopted by the Office of the State Architect (OSA)
if:
• The project receives 25% or more of state funds: and
• The new facility, addition, or renovation project contains 5,000 or more building gross square feet; and
• The building includes an HVAC system: and
• In the case of a renovation project, the cost of the renovation exceeds 25% of the current value of the property.
The H PCP requires projects that meet the criteria above to achieve third party verification with the target goal of LEED Gold or Green
Globes -Three Globes. Projects are strongly encouraged to meet the Office of the State Architect's (OSA) Sustainable Priorities in
addition to the LEED prerequisites. Projects funded through DOLA that meet the above applicability criteria are required to complete
the DOLA registration and tracking process. See DOLA's H PCP web page at: https://cdola.colorado.gov/community-development-
planning/high-performance-certification-program for more information or contact your DOLA regional manager.
In instances where achievement of LEED Gold or Green Globe -Three Globes certification is not achievable, an applicant may request a

By using vehicles fueled by natural gas rather than diesel this project significantly improves the air quality benefit realized
during construction. One heavy duty truck operating on natural gas is the air quality equivalent benefit of removing 325 cars
off the road. In addition, the use of GPS motorgraders reduces the number of paths the trucks take whizh also reduces air
quality emissions.

PROJECT (MARCH CYCLE -TIER I) AND AUTHORIZE ELECTRONIC SUBMITTAL
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County. Colorado, and
WHEREAS, the Board has been presented with a Grant Application for the Energy and
Mineral Impact Assistance Fund (EIAF) Program for the County Road 43 Improvements Project
(March Cycle -Tier 1) from the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of the Department of Public Works, to the
Colorado Department of Local Affairs, Division of Local Government, with further terms and
conditions being as stated in said application, and
WHEREAS, after review, the Board deems it advisable to approve said application, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Grant Application for the Energy and Mineral Impact Assistance
Fund (EIAF) Program for the County Road 43 mprovements Project (March Cycle -Tier I) from
the County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, on behalf of the Department of Public Works, to the Colorado Department of Local
Affairs, Division of Local Government, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Bcard that Elizabeth Relford, Department of Public
Works, be, and hereby is, authorized to submit said application electronically.
