Sorry for the delay — I was off getting hitched! I only had one fee to review in Appendix 5-0, which was the right-of-way vacation fee, and all of the liquor license fees in Appendix 5-H. 5-0 is a little complicated, which is why I'm pulling in Elizabeth Relford. No changes to Appendix 5-H. Appendix 5-D In 2020, we realized that the right-of-way vacation fee was only in the application form itself, and not actually in a fee chart in the Code. We added the fee as item #37 through Ordinance #2020-04. Ordinance #2020-14 was approved on an emergency basis the same day #2020-04 was approved on final reading. Somehow, the right-of-way fee didn't get added by Municode, despite being approved. Esther and I think it was just a clerical oversight because the two Ordinances were running concurrently. Luckily, the procedures for processing right-of-way vacations have since changed and, with Elizabeth's approval, I was going to recommend that the fee be removed from Appendix 5-D (WC Government Fees) and placed in Appendix 5-M (Department of Public Works Permit Application Fees) anyways. The fee itself hasn't been updated since ifs creation, so I'm sure Elizabeth will want to pursue a cost analysis at some point too. Esther is contacting Municode to confirm, but we essentially have two paths we could pursue. If Municode views the missing fee as just an oversight and adds it back in, we just need to relocate the fee from 5-0 to 5-M. Or, if the fee no longer exists in 5-0, we just need to add it to 5-M as a new entry. Of course, this is all given that Elizabeth would like the fee to live with her other permit fees in 5-M. Jen/Esther/Elizabeth — please let me know if I can be of any help. Thank you, Chloe A. When looking at the links for Ordinance #2020-04, it reflects the addition of item #37 under Appendix 5-D, so I am going to be drafting our new Fees ordinance as if it were currently published online. However, we are going to be moving it from 5-D to 5-N and also changing the amount. I'll defer to you, but I'm thinking it may be less confusing if you were go make the correction to add #37 to Appendix 5-D in the interim, so that when our annual Fee amendment Ordinance comes through later this year, it will make sense where the edits are coming from. Under definitions, 1041 WOGLA Zone had changes that are not captured. On page 3, the way you have it is fine, but we are not changing the definition of Hydraulic Fracturing, it is just moving to be in alphabetic order. Oil and Gas Operations had a change that wasn't captured. Oily Waste had a couple commas added that weren't captured. 21-5-300.B. — the comma after County can be deleted. Under Table 405 A.1 — too much is deleted, LZ needs to stay but everything else can go. 21-5-425.A.1. — we had a comma after wildlife. Do we need that or no? 21-5-430 - I don't have this as an addition...I don't believe we changed anything to this section from the current code. Did you include the changes to Appendix 5-D in another attachment? Just checking, I didn't see anything on the document you sent... Thank you so much for all your help with this! Thank you, Jason S.
