RE: CHANGE OF ZONE, COZ20-0009, FROM THE A (AGRICULTURAL) ZONE DISTRICT
TO THE 1-2 (MEDIUM INDUSTRIAL) ZONE DISTRICT - DURAN ENTERPRISES, LLC
A public hearing was conducted on March 10, 2021, at 10:00 a.m., with the following present:

The following business was transacted:
El I hereby certify that pursuant to a notice dated January 22, 2021, and duly published
January 24, 2021, in the Greeley Tribune, a public hearing was conducted to consider the request
of Duran Enterprises, LLC, for a Change of Zone, COZ20-0009, from the A (Agricultural) Zone
District to the I-2 (Medium Industrial) Zone District. Bob Choate, Assistant County Attorney, made
this a matter of record.
Angela Snyder, Department of Planning Services, presented a brief summary of the proposal
and provided the general location of the site. She cited Weld County Code for a list of potential
uses in the I-2 (Medium Industrial) Zone District, which include the current uses of the property,
and indicated a construction company and mini storage are currently permitted by MUSR15-0010.
As a USR is only permitted in the A (Agricultural) Zone District, Planning staff has recommended
Condition of Approval (COA) #4, which reads, "The applicant shall be allowed 120 days from the
date the plat is recorded to submit a Site Plan Review (SPR) application" and is requesting the
applicant be able to operate the approved uses, according to the above referenced MUSR, during
that time. She relayed the site is located within a Weld County Opportunity Zone, noted, per the
referral from the City of Greeley indicated annexation would be required should the property
require sanitation and water services in the future, and industrial uses in the area comply with
future land use plans for the area. She mentioned a minimal portion of the property is in a
floodplain, where the site's detention is flowing, described the surrounding zoning and uses and
relayed the site is within the North Greeley Rail Corridor. She stated Planning staff received one
letter of correspondence from the property owner to the south, who requested a berm on the
southern edge of the property, as the site is developed further. Ms. Snyder explained the property
contains a strip of farmland of statewide importance but affirmed the land has not been farmed
for quite some time. She entered the favorable recommendation of the Planning Commission into
the record as written and displayed images of the site and surrounding views. In response to

Chair Moreno, Ms. Snyder clarified the signage currently on the site and responding to
Commissioner James, she re -displayed the surrounding zoning map.
IR Mike McRoberts, Department of Public Works, stated access is on O Street and 71st Avenue,
presented the drainage requirements and indicated any offsite roadway improvements
necessitated by the applicant's traffic information will be addressed with a subsequent SPR.
la Lauren Light, Department of Public Health and Environment, stated the site's water is
currently provided by the North Weld County Water District and there are several commercially
permitted septic systems. She indicated if a future use requires sewer service it would be up to
the City of Greeley to require the applicant to connect to the City's sewer service or allow the use
of a septic system.
IR Kris Pickett, JKP Consulting, LLC, represented the applicant and stated they are requesting
the COZ primarily to be able to utilize building signage, which is not allowed in the current USR.
No public testimony was offered concerning this matter.
In response to Chair Moreno, Mr. Pickett indicated, on behalf of the applicant, he had
reviewed, and agreed to abide by, the Conditions of Approval.
E Commissioner James moved to approve the request of Duran Enterprises, LLC, for a Change
of Zone, COZ20-0009, from the A (Agricultural) Zone District to the I-2 (Medium Industrial) Zone
District, based on the recommendations of Planning staff and the Planning Commission, with the
Conditions of Approval as presented. The motion was seconded by Commissioner Freeman, and
it carried unanimously. There being no further discussion, the hearing was completed at 10:32
a.m.
